On 1-st of January 2015 we celebrate 50-th anniversary of the entry into force of the Polish Code of Civil Procedure Act adopted on 17-th of November 1964. This anniversary is an excellent opportunity to analyze changes to the nature of the civil proceedings in terms of its inherent characteristics, which is a procedural formalism and, more precisely - changes in the degree of formalization of civil procedure. The examination leads to the conclusion that during last 50 years we can distinguish three stages in the evolution of formalism of Polish civil procedure. The first stage falls for the years 1965-1996. This stage is characterized by a reduced degree of formalization of the procedure (moderate procedural formalism), which was connected with then existed the social model of civil procedure. The second stage (1996-2009) was a period of significant increase of degree of procedural formalism, which was related to the reconstruction of the model of civil procedure in a liberal direction. The end of this stage was mainly caused by the Constitutional Court, which in the case law of the years 2007-2009 contested the legislative solutions and the practice of the Supreme Court and common courts in the field of procedural formalism. The last stage (2009 - nowadays) is characterized by reduction of the degree of procedural formalism, both by the legislature, as well as legal practitioners.
The purpose of this article is to discuss selected problems related to conducting evidentiary hearings in civil proceedings, with a special emphasis on the essence of a motion for evidence and on the option to file it. The performed analysis covered both primary and secondary legislation concerning the formal matters related to filing motions for evidence, the possibilities of admitting evidence, the procedure of taking evidence, and the deliberations on the outcome of the evidentiary hearings. The regulations as they are in force at present offer no possibility to present evidence at the discretion of the parties and participants of the proceedings. It is therefore very important to use the evidence in accordance with the legislator’s suggestions so as not to be deprived of the chance to receive a favourable court decision only because the court finds the motion for evidence as having been filed too late.
The role of the prosecutor in the legal system is traditionally perceived in the context of performing tasks relating to the prosecution of offences and upholding the rule of law. It is worth mentioning, however, that pursuant to Article 7 sentence 1 of the Code of Civil Procedure the prosecutor may petition to institute proceedings in any civil matter as well as participate in any pending proceedings if he considers his presence necessary to protect the rule of law, citizens’ rights or social interest. While the broad competence range of the prosecutor in civil proceedings has been assessed with high criticism in the literature on numerous occasions, it is with great caution that one should view possible tendencies towards exclusion of the prosecutor as an attendant of proceedings, without affiliation to either party, when the public interest calls for their participation. Especially in the cases where the court notifies the prosecutor of the need to participate in proceedings, one ought to conclude that it is the moment when the principle of effective legal protection becomes most fully realized through equalizing the litigious position of the parties and prevention of the occurrence of a defect which might invalidate the proceedings. The author postulates transforming notification of the need to participate in proceedings served on the prosecutor into summons for attending it.
The subject of the petition is a request to launch a legislative initiative to amend the provisions of the Code of Civil Procedure relating amount in controversy in cases of employees’ claims concerning the establishment, the existence or termination of employment relation and service of documents in civil proceedings. The opinion calls into question the acceptability of the amendments specified in the petition and their compliance with national and European law.
The epidemic is a challenge to the justice. The court proceedings' conducting must take into account the principles of epidemiological safety. However, this must not lead to a violation of the rights of parties to court proceedings. Instruments enabling safe conduct of court cases are contained in the Code of Civil Procedure and in the Act of 2 March 2020. The aim of the article is to systematize and discuss the key regulations and institutions that allow for ensuring the proper administration of justice in the current difficult period with the use of the above-mentioned provisions. These solutions are not perfect, they need to be refined and adapted to the current needs and problems arising in the course of court proceedings. They require appropriate technical facilities both on the part of the courts and the parties, as well as skills and willingness to use them.

Stan epidemii jest wyzwaniem dla wymiaru sprawiedliwości. Prowadzenie postępowań sądowych musi uwzględniać zasady bezpieczeństwa epidemiologicznego. Nie może jednak prowadzić do naruszenia praw stron postępowań sądowych. Instrumenty umożliwiające bezpieczne prowadzenie spraw sądowych zawarte są w kodeksie postępowania cywilnego oraz w ustawie z 2.03.2020 r. Celem artykułu jest usystematyzowanie i omówienie kluczowych regulacji oraz instytucji, które pozwalają na zapewnienie należytego sprawowania wymiaru sprawiedliwości w obecnym trudnym okresie z wykorzystaniem wspomnianych przepisów. Rozwiązania te nie są idealne, potrzebują dopracowania oraz dostosowania do bieżących potrzeb oraz problemów pojawiających się w toku postępowań sądowych. Wymagają przy tym odpowiedniego zaplecza technicznego tak po stronie sądów, jak i stron, a także umiejętności oraz chęci ich stosowania.
The author of the opinion assesses that the proposed changes are largely the result of needs reported by the scientific and judicial community. However, the assumptions justifying the bill have not been fully implemented. In the context of the changes concerning the running of the limitation period relating to the motion for a summons to a conciliation session and to mediation, it was stressed that the bill in both cases does not refer to the effects of subsequent requests for summons to the conciliation session and the subsequent initiation of mediation. The author negatively assesses the change consisting in the introduction of a new premise of exploitation. He also does not see the need for changes in excluding from the group of persons liable for rent liabilities and fees for occupying premises adults who are unable to support themselves and who are dependent on their parents.
The author of the paper attempts to explain mutual relations existing between the general regulations regarding proceedings that are stipulated in the Code of Civil Procedure and regulations regarding separate proceedings in social insurance cases. In the author’s opinion, an analysis of regulations of Book One of the Code of Civil Procedure makes it possible to indicate four (named and described in the paper) categories of provisions that determine the aforementioned relations, taking into consideration the specifics of proceedings in social insurance cases that constitute civil cases in formal meaning.
Mediation is a method of alternative dispute resolution that uses a neutral third party to assist parties in resolving disputed issues. Mediator conducts the negotiation, but has no authority to decide. He is obliged to remain impartial, provide information to parties to the mediation proceedings as well as keep confidentiality of the information disclosed during the proceedings. Mediation is voluntary and allows disputing parties considerable flexibility in reaching a resolution. The article describes the German Mediation Act that is transposing Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters. Under new law judges are allowed to play the part of mediators in order to find an amicable solution in the course of conciliatory proceedings.
This article aims at presenting of influence the legal concepts of Prof. Eugeniusz Waśkowski on Polish modern civil procedure’s doctrine. It focuses three main areas: the importance of the very first Polish handbooks and systems written by Waśkowski, some articles of this author concerning crucial procedural issues and finally the variety of interests of Waskowski in his research in legal studies.

Hitherto, this issue has not been the subject of comprehensive in-depth considerations in the Polish doctrine. Meanwhile, this term used several times in the provisions of the aforementioned code may be understood in various ways, primarily due to the multiplicity of prohibited acts the commission of which may result in widely understood criminal liability. According to the authors, a narrow understanding of this concept in the provisions of the Code of Civil Procedure is justified what corresponds essentially to the meaning given to it under the provisions of the Criminal Code. Whereas, the term ‘offence’ in the Code of Civil Procedure does not include penal fiscal offences, fiscal petty offences or petty offences.

Celem opracowania jest ustalenie znaczenia pojęcia „przestępstwo” na gruncie kodeksu postępowania cywilnego. Zagadnienie to nie było dotąd przedmiotem pogłębionych rozważań w polskiej doktrynie. Tymczasem termin ten, używany kilkukrotnie w przepisach wymienionego kodeksu, może być różnorako rozumiany przede wszystkim ze względu na wielość czynów zabronionych, których popełnienie skutkować może szeroko rozumianą odpowiedzialnością karną. W ocenie autorów uzasadnione jest wąskie rozumienie tego pojęcia w przepisach kodeksu postępowania cywilnego, odpowiadające zasadniczo znaczeniu nadanemu mu w oparciu o przepisy kodeksu karnego. Pojęcie przestępstwa używane w przepisach kodeksu postępowania cywilnego nie obejmuje zaś przestępstw skarbowych, wykroczeń skarbowych ani wykroczeń. The article discuss the proposal included in the draft amendment from 27.11.2017, such as introduction to the civil proceedings of the admissibility of dismissing the claim as obvious groundlessness at a closed session in the context of providing to a person the right to a court. The author puts forward the thesis that in the light of Article 1911 Code of Civil Procedure, the “obvious groundlessness” of an action is a state in which the claim made by the claimant is unknown to the law. Otherwise, i.e. in the case of a too wide understanding of this institution, the dismissal of the action may lead to violation of the right of the individual to court in the light of Article 6 ECHR.

Artykuł omawia propozycję zawartą w projekcie nowelizacji z 27.11.2017 r. do Kodeksu postępowania cywilnego, tj. wprowadzenie do postępowania cywilnego dopuszczalności oddalenia roszczenia jako oczywiście bezzasadnego na posiedzeniu niejawnym w aspekcie zapewnienia i realizacji prawa jednostki do sądu. Autorka stawia tezę, że w świetle projektowanego art. 1911 Kodeksu postępowania cywilnego o „oczywistej bezzasadności” w rozumieniu tego przepisu można mówić jedynie w sytuacji, w której roszczenie powoda nie jest znane prawu. W przeciwnym razie, tj. w przypadku zbyt szerokiego zrozumienia tej instytucji, oddalenie powództwa jako „oczywiście bezzasadnego” może prowadzić do naruszenia prawa jednostki do sądu w świetle art. 6 EKPC.
W procesie cywilnym obowiązuje zasada kontradyktoryjności, zatem to strony mają obowiązek przedstawić wszelkie dowody na poparcie swoich twierdzeń. Jednym z dostępnych dowodów może być operat szacunkowy o wartości nieruchomości sporządzony bądź na zlecenie strony postępowania, bądź sądu. Zgodnie z utrwalonym orzecznictwem Sądu Najwyższego operat szacunkowy wykonany na zlecenie strony stanowi dowód prywatny. Większe znaczenie dla oceny materiału dowodowego ma operat szacunkowy sporządzony przez biegłego rzeczoznawcę majątkowego na zlecenie sądu. Wówczas sąd ocenia go pod względem zgodności z zasadami logiki i wiedzy powszechnej, poziomu wiedzy biegłego, a także sposobu motywowania oraz stopnia stanowczości wyrażonych wniosków. Celowa jednak mogłaby być próba zrównania wartości dowodowej operatu szacunkowego sporządzonego na zlecenie stron z opinią sporządzoną na wniosek sądu. Sytuacja taka mogłaby mieć wpływ na przyśpieszenie rozpoznania sprawy oraz ograniczenie kosztów postępowania.

Civil proceedings are based on the contradictory procedure. Thus, the parties are obliged to present all the relevant evidence to support their claims. Property valuation reports drawn up at the request of a party to proceedings or at the request of the court constitute valid pieces of evidence. According to the Supreme Court’s established case law, a property valuation report drawn up by a certified property valuer at the request of the court is more significant in the process of evaluation of evidence. In that case, the court evaluates the report in terms of logic and common knowledge, the valuer’s expertise level as well as the way of reasoning and the firmness of conclusions. However, it might be expedient to make the probative value of property valuation report prepared at the request of the parties to proceedings equivalent to an opinion prepared at the request of the court. This could accelerate the examination of cases and lower the costs of proceedings.
The article is focused on the determination of the amount of selected proceedings’ costs and their reimbursement in bodily harm compensation disputes. General comments are suppressed; the attention is mainly directed to answering practical questions and outlining solutions to the existing contradictions. Firstly, the article discusses in general the nature of the bodily harm compensation claims and types of proceedings’ costs. The following chapter is aimed at the determination of the amount of the court fee and the obligation to pay it in this type of dispute. Next chapter focuses on the quantification of the remuneration for representation by an attorney of law for the purposes of the proceedings’ costs reimbursement, including the recommendations to the plaintiff on proceedings’ tactics related thereto.

Článek se zaměřuje na problematické aspekty spojené s určením výše vybraných nákladů řízení a jejich náhradou ve sporech o náhrady při ublížení na zdraví. Obecné výklady jsou potlačeny, pozornost je směrována především na zodpovězení praktických otázek a na nastínění řešení existujících rozporů. Článek nejprve obecně pojednává o druzích a charakteru náhrad, které lze při ublížení na zdraví vymáhat, a o jednotlivých druzích nákladů řízení. Následuje kapitola podrobně se zabývající určením výše soudního poplatku a povinnosti k jeho placení v tomto typu sporů. Další kapitola je zaměřena na vyčíslení odměny za zastupování advokátem pro účely náhrady nákladů řízení, včetně doporučení pro žalobce týkajícího se vedení tohoto typu sporného řízení.
The purpose of this article is to clarify the legal nature and extent to which a civil court is bound by an administrative decision and establishing its legal basis. The author advocates for the view, according to which only the operative part of an administrative decision, i.e. the norm of conduct set up in an individual and specific normative act (administrative act), binds the court in civil proceedings. The civil court has no jurisdiction to deal with legal arrangements within the area reserved for administrative competence, i.e. in cases settled by an administrative act. While civil court may make its own establishments of facts, it is not authorized to derive from such facts any legal consequences that may only arise from an administrative act. The court is also not authorized to examine the correctness of an administrative act, even in case of its „absolute nullity”. The court is bound by a decision in matters of fact, or in matters of law. Binding in matters of law takes place if the decision is characterized by so-called „extended efficiency”, i.e. it regulates the legal regime of the property.

Celem niniejszego artykułu jest omówienie wybranych kwestii problematyki związanej z przeprowadzeniem postępowania dowodowego w procedurze cywilnej ze szczególnym uwzględnieniem istoty wniosku dowodowego oraz możliwości jego zgłoszenia. Analizie poddane zostały przepisy ustawowe i podustawowe dotyczące zarówno kwestii formalnych składania wniosku dowodowego, możliwości dopuszczenia dowodu, sposobu przeprowadzenia dowodu, a także roztrząsanie wyników postępowania dowodowego. Przepisy obowiązujące w obecnym kształcie nie dają możliwości zgłaszania dowodów według własnego uznania przez strony i uczestników postępowania, dlatego też niezwykle istotne jest stosowanie ich zgodnie z zaleceniem ustawodawcy, tak aby nie zostać pozbawionym wydania korzystnego rozstrzygnięcia tylko z tego powodu, że Sąd uzna wniosek dowodowy za spóźniony.
The article discusses changes in the provisions regarding the delivery of letters addressed to entrepreneurs under civil proceedings. The Code of Civil Procedure has been amended in this respect by the Act of 4.07.2019 amending the Act - Code of Civil Procedure and some other acts (Journal of Laws of 2019, item 1469). The article focuses in particular on the issue of the admissibility of using the fiction of delivery (serve by default) of the first letter in a case addressed to the entrepreneur. In addition to discussing the new regulation on delivery, the aim of the article is to present proposals for changes in the said document in the area primarily concerning entrepreneurs.

Kodeks postępowania cywilnego został w tym zakresie zmieniony ustawą z 4.07.2019 r. o zmianie ustawy - Kodeks postępowania cywilnego oraz niektórych innych ustaw (Dz.U. z 2019 r. poz. 1469). Artykuł koncentruje się w szczególności wokół kwestii dopuszczalności stosowania fikcji doręczenia pierwszego pisma w sprawie kierowanego do przedsiębiorcy. Poza omówieniem nowej regulacji dotyczącej doręczeń, celem artykułu jest również przedstawienie propozycji jej zmian w zakresie dotyczącym przede wszystkim przedsiębiorców.
The text presents the issue of the possibility of a party confirming actions in proceedings carried out by a person acting as a party's representative, who, however, is not eligible to be a representative. According to the Code of Civil Procedure, parties and their organs or statutory representatives may personally act before a court, or through proxies. The catalog of those who may be proxies has been strictly defined in the procedural act and is exhaustive. In the context of this regulation, the judicature presents different views on what are the results of actions undertaken by a person from outside of this catalogue, who is yet acting as a proxy and the possibilities of validating the action undertaken by such a person. According to one view, in case of validation of the actions undertaken by such person, it is impossible to consider the entire proceeding as invalid according to article 379 point 2 of the Code of Civil Procedure. According to a different approach, such a situation always leads to invalidation of the proceeding due to the proxy’s lack of empowerment. The article presents a broad perspective of the views expressed in the literature, especially prominent specialists dealing with the issues of civil proceedings, as well as a wide range of resolutions and rulings of the Supreme Court. The author conducts an in-depth interpretative analysis of the provisions enabling parties to be replaced by proxies, describing completely divergent views leading to the final conclusions closest to the author. The study presents a prevailing line in doctrine and case law, also supported by the author of the study, indicating the stabilization of legal thought in relation to the mandatory rules of Polish civil procedure. It a significant point that actions are recognized as unconditionally invalid when carried out by persons who are not eligible to be a representative at all.

W artykule przedstawiono kwestię możliwości potwierdzenia przez stronę czynności dokonanych przez osobę działającą jako pełnomocnik strony, która jednak nie może być pełnomocnikiem w postępowaniu cywilnym. Zgodnie z Kodeksem postępowania cywilnego strony i ich organy lub przedstawiciele ustawowi mogą działać przed sądem osobiście lub przez pełnomocników. Katalog osób mogących być pełnomocnikami został ściśle określony w ustawie procesowej i ma charakter zamknięty. Na tle tej regulacji w orzecznictwie sądów dostrzegana jest rozbieżność poglądów w odniesieniu do skutków występowania w charakterze pełnomocnika procesowego osoby nieuprawnionej oraz możliwości ewentualnego zatwierdzenia czynności dokonanych przez taką osobę. Z jednej strony wskazuje się, że w razie potwierdzenia czynności wyłączona jest możliwość uznania postępowania za nieważne na podstawie art. 379 pkt 2 k.p.c. Z drugiej strony podkreśla się, iż sytuacja taka zawsze prowadzi do nieważności postępowania wobec braku należytego umocowania pełnomocnika. Artykuł przedstawia poglądy prezentowane w doktrynie i judykaturze. Autor przeprowadził analizę interpretacyjną przepisów umożliwiających zastępowanie stron postępowania przez pełnomocników, opisując rozbieżne poglądy, prowadząc do końcowych konkluzji, wskazujących na bezwzględną nieważność czynności dokonanych przez osoby, które w ogóle pełnomocnikiem być nie mogły.
Elektroniczne postępowanie upominawcze było pierwszym udanym wdrożeniem informatycznym w procesie cywilnym. Przez dziesięć lat rola tego postępowania w systemie postępowania cywilnego była znacząca. Nadal ma potencjał do dalszego rozwoju. Regulacje prawne ulegały jednak wielokrotnym zmianom, a nowe przepisy prawne nie zawsze były trafne i spójne.

Electronic writ of payment was the first successful IT implementation in civil proceedings. For a period of ten years the role of this procedure in the civil procedure system was significant. It still has potential for further development. However, legal regulations have changed many times. The new legal regulations have not always been accurate and consistent.
Opracowanie jest próbą usystematyzowania funkcjonowania instytucji tajemnicy spowiedzi w polskim systemie prawnym i jego wpływu na prawo procesowe. W pierwszej kolejności autor wskazuje na uregulowania obowiązujące na gruncie prawa kościelnego, a następnie określa istotę indywidualnej spowiedzi i w jaki sposób kształtuje ona procedowanie przed polskimi sądami powszechnymi. W kolejnej części analizie poddane zostają kwestie ściśle związane z przesłuchaniem kapłana w charakterze świadka na okoliczności, o których powziął wiedzę w trakcie sakramentu spowiedzi na gruncie procesu karnego, gdzie ta okoliczność stanowi absolutny zakaz dowodowy. Z kolei proces cywilny przewiduje jedynie, iż informacje objęte tajemnicą spowiedzi stanowią jedynie podstawę do odmowy składania zeznań. W ostatniej części autor wskazuje na korelację między przepisami polskiego ustawodawcy i unormowaniami kodeksu prawa kanonicznego.

Develop an attempt to systematize the functioning of the institution secret confession in the Polish legal system and its impact on procedural law. The first attempts to define this structure to indicate the regulations then in canon law. Are then discussed the various regulations in the Code of Criminal Procedure, where the priest hearing the circumstances are subject to an absolute prohibition of confession evidence and the Code of Civil Procedure, where the secret of confession is the only basis for refusing to testify by a cleric listened as a witness. In the final part the author indicates the correlations between the laws of the Polish legislator, and unormowaniami law code of canon law.
The subject of the commentary is the resolution of the Supreme Court of 11 December 2018, III CZP 31/18 which states that in a situation where both parties are represented by professional representatives a copy of the letter containing the extension of the claim should be delivered to the defendant by the court. This issue has caused discrepancies in the case law of common courts and the jurisprudence of the Supreme Court. Therefore, the study analyzes the arguments presented by the Supreme Court in the justification of the said decision; additional circumstances are also cited, which, according to the author of the commentary, prove the legitimacy of the official notification extending the claim which will ensure the efficiency of the proceedings and will counteract legal uncertainty.
