This article deals with the pastoral care of migrants in the Czech Republic. It starts from a description of the ethnic composition of inhabitants of the Czech Republic and of permanently settled foreigners from 1918 to the present. It also acquaints the reader with the principles and individual structures of pastoral care for migrants coming from special Church documents and codes of canon law. On this basis, it presents specific structures existing in the Czech Republic and evaluates them.

According to the teaching of the Vatican Council II, the proclaiming of the Word of God is the main function of the bishop. The teaching function of bishops can exercise personally in communion with the Roman Pontiff or collegial within the framework of the conference of bishops, what is one of the indicative of affective collegiality. Bishops assembled within the framework of the conference of bishops realize the legislative competences in the range of the teaching function issued general decrees. A conference of bishops has power to issue general decrees in cases where the Code of Canon Law of 1983 has prescribed it or a special mandate of the Apostolic See has established it either motu proprio or at the request of the conference itself (can. 455 § 1), and each and every bishop has given consent (can. 455 § 4).

The article is an attempt to show the structure, competences and procedure of the realization of the competences of the mediation council. The legal basis for the establishment of this council is in the Code of Canon Law of 1983 in can. 1733 § 2. In the article there are presented entities which are competent to establish the mediation council: conference of bishops and diocesan bishop. Functions of the council are to seek and suggest equitable solutions. Detailed competences of this mediation body, its structure and procedure should be specified in the statutes which erect the mediation council. The author proposes for the establishment of the mediation council in polish particular law following particular law of the other countries, in which this kind of solution led to the reduction of administrative disputes. What is more, it seems advisable to adopt basic rules of the mediation procedure from the state law in force to the ecclesiastical law.

The article presents the possibilities of applying the provisions of the 1983 Code of Canon Law in the legal system of Ukraine. A historical outline of the shaping of the structures of the Latin Church from the achievement of independence by Ukraine in 1991 and their current state is presented. Then the canonical status of structures of the Latin Church in Ukraine was shown and the legal way of existence and creation of these structures in the Ukrainian legal order was analyzed. It was emphasized that the disadvantage in the legal system of Ukraine is the failure to recognize the legal personality of the Church resulting from its nature. It was suggested that signing the concordat with the Holy See would avoid unnecessary and dreadful wording in the statutes of religious organizations, so that they could enjoy the recognition of legal personality in Ukrainian legislation while maintaining their legal and canonical status.

W artykule ukazano możliwości zastosowania regulacji Kodeksu Prawa Kanonicznego z 1983 r. w systemie prawnym Ukrainy. Przedstawiono rys historyczny kształtowania się struktur Kościoła łacińskiego od uzyskania niepodległości przez Ukrainę w 1991 r. oraz ich obecny stan. Następnie ukazano kanoniczny status struktur Kościoła łacińskiego na Ukrainie oraz przeanalizowano prawny sposób istnienia i działania tychże struktur w ukraińskim porządku prawnym. Podkreślono, że wadą w systemie prawnym Ukrainy jest nieuznawanie osobowości prawnej Kościoła wynikającej z jego natury. Zasugerowano, że podpisanie konkordatu ze Stolicą Apostolską pozwoli uniknąć zbytecznych i karkołomnych sformułowań w statutach organizacji religijnych, aby te mogły cieszyć się uznaniem osobowości prawnej w ukraińskim ustawodawstwie zachowując swój prawno-kanoniczny status.
