Prawne przesłanki powstania obowiązku przyłączenia do sieci przedsiębiorstwa energetycznego

W artykule przedstawiono problematykę związaną z przyłączaniem do sieci energetycznych podmiotów ubiegających się o przyłączenie. Poprzedzony ją wprowadzeniem do europejskiej polityki infrastrukturalnej oraz zagadnieniami teoretycznym z zakresu uznania obowiązku przyłączenia do sieci za obowiązek o charakterze publicznym. Opisano cztery przesłanki powstania obowiązku przyłączenia do sieci. Z jednej strony dotyczące przedsiębiorstwa energetycznego, tj. istnienie warunków technicznych i ekonomicznych przyłączenia. Z drugiej strony dotyczące podmiotu ubiegającego się o przyłączenie, tj., posiadanie tytułu prawnego do nieruchomości oraz spełnianie warunków do przyłączenia. W artykule omówiono procedurę zawierania umowy o przyłączenie do sieci oraz regulacje związane z odmową przyłączenia. Wskazano na aktualne projekty zmian regulacji zawartych w „tzw. małym trójpaku energetycznym” oraz „w tzw. trójpaku energetycznym”, polegających na doprecyzowaniu regulacji w zakresie istnienia warunków technicznych oraz ekonomicznych przyłączenia.

The article presents the issues concerning connecting to the energy network by entities applying for it. There is an introduction to the European infrastructure policy and also some theoretical issues concerning the recognition of the obligation (public duty) to connect to the network in the article. It contains a description of four terms and conditions of obligation to connect to the network. On the one hand concerning the energy company, i.e. the existence of technical and economic conditions of the attachment. On the other hand it concerns entities applying for attachment, i.e. legal title to the property and conditions of attachment. The article discusses the procedure for concluding contracts for network connections and regulations relating to the refusal of attachment. It has been pointed out to the current draft amendments to regulations contained within a small energy three pack and the bills of energy three pack. The changes consist in clarifying the regulation of the existence of the technical and economic connection.
