Artykuł prezentuje narodziny ustroju Kazachstanu. Państwo to ma wyjątkowo długie i bogate doświadczenia konstytucyjne. Trzeba jednak pamiętać, że samo pojęcie państwa w społeczeństwach plemiennych jest przenoszeniem na grunt Azji pojęć europejskich. Tradycyjną postać chanatu trudno jest przecież postrzegać we współczesnych kategoriach państwa. Niemniej historiografia Kazachstanu mocno odwołuje się do najdawniejszych przejawów państwowości, czasami próbując nawet jej szukać trochę „na wyrost”, co z pewnością jest sposobem budowania tożsamości państwowej, a co w przypadku stosunkowo nowych i młodych organizmów państwowych jest rzeczą niebagatelną, a przez to także i na swój sposób oczywistą. W ewolucji konstytucjonalizmu kazachskiego wskazuje się najczęściej trzy zasadnicze etapy. Etap pierwszy to okres poprzedzający powstanie Związku Radzieckiego. Jest on mocno akcentowany, głównie po to aby udowodnić, że na terenach Kazachstanu państwo było strukturą wcześniejszą aniżeli państwowość kojarzona ze Związkiem Radzieckim. Drugi etap w rozwoju Kazachstanu to okres radziecki. Okres ten miał zasadnicze konsekwencje dla państwa. W tym okresie pojawiła się bowiem pierwsze prawdziwa konstytucja Kazachstanu. Schyłek tego okresu przesądził z kolei o współczesnym Kazachstanie jako niepodległym państwie. Stąd trzecim i ostatnim etapem w historii konstytucjonalizmu Kazachstanu jest etap tzw. konstytucjonalizmu niepodległego.

The article presents the birth of the political system of Kazakhstan. This state has a very long and rich experiences constitutional. But keep in mind that the concept of the state in tribal societies is moving on the ground Asia European concepts. The traditional form of the Khanate, it is difficult yet seen in modern terms the state. However, the historiography of Kazakhstan strongly refers to the ancient manifestations of statehood, sometimes even trying to look a little "over the top", which certainly is a way of building a national identity and, in the case of a relatively new and young state organisms it is trivial, and thus also your way clear. In the evolution of constitutionalism Kazakh usually indicates three fundamental stages. The first stage is the period preceding the rise of the Soviet Union. It is strongly emphasized, mainly to prove that the open structure of the Kazakh state was earlier than the state associated with the Soviet Union. The second stage in the development of Kazakhstan is the Soviet period. This period had fundamental consequences for the state. During this period appeared as the first real constitution of Kazakhstan. The end of this period sealed the turn of the modern Kazakhstan as an independent country. Hence, the third and final stage in the history of constitutionalism Kazakhstan step is called. constitutionalism independent.
