This article explores the involvement of members from both Polish and foreign consular posts in the process of taking evidence in criminal proceedings. Specifically, it examines the participation of Polish consular officers in the interrogation of witnesses and defendants, as outlined in Article 177 § 1b(2) of the Polish Code of Criminal Procedure. Additionally, the article discusses interrogation of these parties by consuls acting on behalf of Polish courts. Governed by both Polish and international law, this process is situated within the realm of international criminal proceedings and consular law. The article also delves into the right to decline to give evidence, a privilege granted to members of consular posts based on their official functions. In this context, we introduce the concept of ‘consular secrecy’, which can be likened to professional secrecy or secrecy associated with the official roles of certain individuals.

The text is an analysis of normative solutions regarding the participation of members of consular offices (Polish and foreign) in evidentiary activities undertaken in criminal proceedings. The issue of participation of Polish consular officials in the interrogation of defendants and witnesses was discussed (Article 177 § 1b point 2 of the Code of Criminal Procedure), as well as the interrogation of these participants in criminal proceedings by the consul as the body replacing the Polish court in this respect. These activities, in accordance with the will of the Polish legislator and the law of nations, are included in what is called criminal proceedings in international relations, but also in consular law. Considerations were also made regarding the right to refuse to testify, which members of consular posts are entitled to in the circumstances related to their function. In the author’s opinion, there may be consular secrecy in this respect, which is a form of functional or professional secrecy.

Tekst stanowi analizę rozwiązań normatywnych dotyczących udziału członków urzędów konsularnych (polskich i obcych) w czynnościach dowodowych podejmowanych w procesie karnym. Omówiono problematykę udziału polskich urzędników konsularnych w przesłuchaniu oskarżonych i świadków (art. 177 § 1b pkt 2 k.p.k.), a także przesłuchania tych uczestników postępowania karnego przez konsula jako organu zastępującego w tym zakresie sąd polski. Czynności te, zgodnie z wolą polskiego ustawodawcy, ale i prawa narodów, mieszczą się w tym, co określa się mianem postępowania karnego ze stosunków międzynarodowych, ale także i prawa konsularnego. Podjęto tu także rozważania odnośnie do prawa do odmowy zeznań, które przysługuje członkom urzędów konsularnych w zakresie okoliczności związanych z pełnioną przez nich funkcją. W ocenie autora można mówić o istnieniu w tym zakresie tajemnicy konsularnej, która stanowi odmianę tajemnicy funkcyjnej lub zawodowej.

This article examines the extent to which state officials are subject to prosecution in foreign domestic courts for international crimes. We consider the different types of immunity that international law accords to state officials, the reasons for the conferment of this immunity and whether they apply in cases in which it is alleged that the official has committed an international crime.

Zostały rozważone różne rodzaje immunitetu, jakie prawo międzynarodowe przyznaje urzędnikom państwowym, powo-dy przyznania tego immunitetu i czy mają zastosowanie w przypadkach, w których zarzuca się, że urzędnik popełnił przestępstwo międzynarodowe.
