The donation may also include an agreement on the “contractual substitution”: The donee is obliged to give the gift to another person as a subsequent donee in the specified case. The Austrian Supreme Court applies to the above-mentioned agreement the provisions on hereditary fideicommissary substitution. Its jurisprudence, however, has been criticized by legal scholars in the recent years. The subject of criticism is the admissibility of time-limited property, to which the application of the provisions on hereditary fideicommissary substitution leads. The subject of the contribution is a proposal for a solution which, within the Czech civil code, will ensure the right of the subsequent donee the protection (which the Austrian Supreme Court seeks) and which at the same time will not contradict the principles whose violation expresses the Austrian legal science.

Predmetom darovacej zmluvy môže byť aj dohoda o zmluvnom nástupníctve: Obdarovaný má v určenom prípade predmet daru vydať ďalšej osobe ako následnému obdarovanému. Rakúsky najvyšší súd na dohodu uvedeného typu analogicky uplatňuje ustanovenia o dedičskej fideikomisárnej substitúcii, jeho judikatúra však v posledných rokoch naráža na kritiku právnej vedy. Objektom kritiky je prípustnosť časovo obmedzeného vlastníctva, ku ktorému uplatnenie ustanovení o dedičskej fideikomisárnej substitúcii vedie. Predmetom príspevku je návrh riešenia, ktoré v medziach českého občianskeho zákonníka právu následného obdarovaného zaistí ochranu (o ktorú sa usiluje rakúsky najvyšší súd) a zároveň nebude odporovať princípom, ktorých porušenie uplatnením ustanovení o fideikomisárnej substitúcii namieta rakúska právna veda.
