Counterpublics of Polish Constitutionalism Illustrated with the Example of Women’s Rights

The article discusses the issue of the place and presence of women in the public sphere, and tries to answer the question of how these matters are impacted by the institution of the Constitutional Tribunal. Applying the method of discourse analysis, I have examined the Polish Constitutional Tribunal’s decisions and looked into the media discussion, with both revealing dominant trends regarding women’s rights in Polish constitutionalism. Using the category of counterpublics, I also cover emancipation movements important on account of women’s rights and their presence in the public domain. I also address the common myths concerning the Constitutional Tribunal. There are also mentions of room for the materialisation of emancipation processes in Polish constitutionalism.

We usually associate memory with facts. A simple gesture of leaving a lipstick trace, a kiss, used for several decades by Ewa Partum, is a form of leaving your mark, as well as representing your emotional state. It has become the artist’s trademark. At first, it was her individual gesture, a kind of artistic signature. In 2006 Partum invited a group of South African immigrants to perform the signature with her. I’d like to find out what is actually included in this artistic act, how it surpasses the border between the private and the public and how it becomes a specific form of materialised universalism, the practice of a shared thing.

Girlhood‟s political potential does not lie in the power of individual girls, however magnificent, but in acknowledging the commonalities and multiplicities of all girls‟ experiences. Rejecting the individualistic “girl power” paradigm opens up new, sometimes contradictory narrations and representations of contemporary girlhood. This non-heroic approach to girlhood reveals not only the intricate workings of exclusion mechanisms, but also the various inclusive tactics and resistance strategies at work. Engaging with the concepts of counterpublics, the gendered right to the city, and feminist theory more broadly, I look closely at selected examples of girl resistance from popular culture to demonstrate how girls‟ interventions in urban places usually coded as masculine can subvert cultural, gender, racial, and class codes, reappropriate narrations about themselves, and execute their right to the city. Even if some of the gestures and tactics I discuss in the paper may seem too mild to have any political power, I propose that it is exactly such unassuming forms of resistance that promise real change and deserve our urgent attention.

Polityczny potencjał siły dziewczyńskości nie tkwi w sile jednostki, ale w dostrzeżeniu wspólności i wielości dziewczyńskich doświadczeń. Odrzucenie postawy heroicznej i wyjście poza indywidualistyczny paradygmat girl power pozwalają na uwidocznienie różnych, nierzadko sprzecznych ze sobą narracji i reprezentacji składających się na współczesne dziewczyństwo, co z kolei pozwala nie tylko na identyfikację kompleksowych mechanizmów wykluczenia, ale też wytworzenie inkluzywnych taktyk i strategii oporu wobec nich. W oparciu o literaturę feministyczną oraz przykłady dziewczyńskiego oporu z kultury popularnej staram się pokazać, w jaki sposób dziewczyny, dokonując interwencji w miejscach zakodowanych jako męskie, łamią kody kulturowe, płciowe, rasowe i klasowe, stawiają opór, przechwytują narracje o sobie samych i egzekwują swoje prawo do miasta. Choć niektóre z omawianych przeze mnie gestów, taktyk i strategii mogą się wydawać zbyt łagodne, żeby mieć siłę polityczną, proponuję, że właśnie tym niepozornym formom wyrażania oporu warto się bliżej przyjrzeć, stosując w ich analizie kategorię kontrpubliczności i upłciowionego prawa do miasta.

Artykuł porusza kwestię miejsca i obecności kobiet w sferze publicznej, a także wpływania na nie przez instytucję, jaką jest Trybunał Konstytucyjny. Za pomocą analizy dyskursu autorka badała orzeczenia Trybunału Konstytucyjnego, a także dyskurs medialny, które ukazują dominujące tendencje dotyczące praw kobiet w polskim konstytucjonalizmie. Autorka, używając kategorii kontrpubliczności, przybliża także ruchy emancypacyjne istotne ze względu na prawa kobiet i ich obecność w sferze publicznej. Przygląda się także mitom dotyczącym Trybunału Konstytucyjnego. W polskim konstytucjonalizmie dostrzega pole do zaistnienia procesów emancypacyjnych.

The basic categories of the article are the concepts of counter-public sphere and counterpublics. The article has theoretical-empirical character. It offers the analysis in terms of conceptual history as well as the investigation on “anarchist urban movements” with particular emphasis put on specific types of discursive and self-organization practices necessary for the construction and reproduction of anarchist counterpublics. The counter-discourses present in selected anarchist press publications, with particular emphasis on “Przegląd Anarchistyczny” [“Anarchist Review”], were subjected to a detailed study.

Centralnymi kategoriami artykułu są pojęcia sfery kontrpublicznej oraz kontrpubliczności. Artykuł ma charakter teoretyczno-empiryczny. Jego celem jest, z jednej strony, analiza historyczna i pojęciowa kategorii sfery kontrpublicznej, z drugiej zaś analiza użyteczności centralnego pojęcia dla analizy „anarchistycznych ruchów miejskich” oraz wskazanie na określone typy praktyk: dyskursywnych i samoorganizacji, niezbędnych dla konstruowania i reprodukcji sfery kontrpublicznej. Przedmiotem analizy są tu kontrdyskursy obecne na łamach wybranych publikacji anarchistycznych, ze szczególnym uwzględnieniem „Przeglądu Anarchistycznego”.
