The article aims to present the problem of the ineffectiveness of international legal instruments for the protection of cultural heritage. It presents examples of where such laws were violated and suggests that international criminal law can contribute to a better condition of cultural property. The author emphasizes that the International Criminal Court should play an important role in safeguarding such property from destruction in the future. In that context, the article presents inter allia the case of Ahmad Al Faqi Al Mahdi, which is claimed to be a milestone in the protection of cultural heritage.
Przedmiotem niniejszych rozważań jest zagadnienie społecznej ochrony dziedzictwa kulturowego jako obszaru potencjalnego oddziaływania turystyki. Cel artykułu koncentruje się wokół ukazania edukacyjnego potencjału praktyk poznania turystycznego i ich roli w budowaniu więzi z dziedzictwem kulturowym. Autor w oparciu o literaturę przedmiotu oraz obserwacje uczestniczące rozpatruje intelektualny i emocjonalny kontekst tej specyficznej relacji pomiędzy poznaniem a ochroną. Główny wątek dociekań dotyczy specyfiki zachowań turystów w spotkaniu z dziedzictwem kulturowym i edukacyjnych implikacji tegoż spotkania, które w rezultacie umożliwiają refleksyjną postawę względem reliktów przeszłości, pozwalając na kształtowanie zachowań sprzyjających ochronie wytworów dawnej kultury. Zważywszy na masowość podróży turystycznych w świecie zachodnim, poznanie turystyczne pomimo wielu niedoskonałości i ograniczoności wydaje się odgrywać żywotną rolę w procesie społecznej ochrony reliktów przeszłości. Szczególne znaczenie ma tutaj emocjonalna strona poznania, co potwierdza tezę, że to emocje otwierają drogę do rozumienia i stymulacji postaw ludzi w procesie społecznej reprodukcji dziedzictwa.

The subject of this article is the issue of the social protection of cultural heritage as a sphere of the potential influence of tourism. The objective is to show the educational potential of tourist cognition practices and their role in creating bonds with cultural heritage. The author analyses the intellectual and emotional aspects of this specific relationship between cognition and protection based on the literature on this subject and his own observations. The main subject of consideration is the specific behaviour of tourists coming into contact with cultural heritage and the educational outcomes of that contact, which enable adopting a reflective attitude towards the relics of the past and thus enable shaping behaviours favourable to the protection of cultural property. Taking into account the prevalence of tourism in the West, tourist cognition, despite its many imperfections and limits, seems to play an active part in the process of the social protection of relics of the past. The emotional aspect of cognition occupies a prominent role in this respect, which supports the thesis that emotions open the way to understanding and stimulating people’s attitudes in the process of social regeneration of heritage.
Celem artykułu jest przybliżenie kwestii ochrony dóbr kultury jako jednego z podstawowych problemów bezpieczeństwa kulturowego oraz przedstawienie podejmowanych działań w tym zakresie. Praca rozpoczyna się od rozważania wstępnego, w którym zostaje wyjaśnione zainteresowanie wymienionym obszarem w kontekście konfliktów zbrojnych. Następnie autorka, opierając się na przepisach międzynarodowego prawa humanitarnego, a zwłaszcza Konwencji Haskiej, wymienia główne założenia prawne, a także wskazuje na działania Ministerstwa Obrony Narodowej oraz praktyczne ćwiczenia wojskowe w zakresie ochrony dóbr kultury. W artykule omówiono również kwestię współpracy cywilno-wojskowej w tym obszarze.

The aim of the text is to present issues protection of cultural heritage as one the fundamental problems of cultural security and to present actions taken in this field. The construction of this study was preceded by a preliminary contemplating in which as a result of military conflict, interest mentioned in this area has begun. Then, author list the main assumptions law, based on the provisions of international humanitarian law in particular the Hague Convention. The continuation this problem is to point the activities the Ministry of National Defence and practical military exercises in the protection of cultural heritage. In the article is also a analyzed the issue of civil-military cooperation in this area. At the end of the text author summarizing the reflections on the main issues.
This article provides an overview of EU policy in the field of cultural heritage protection with particular emphasis on post conflict countries. The analysis describes and evaluates the overall EU’s approach in all areas of EU engagement in this domain, towards the subject of effective mandate implementation of civilian CSDP Missions with the protection of cultural assets in their field of operation. The concluding remarks compare achievements and shortcomings of ongoing missions against their mandates and objectives, outlining some selected EU initiatives which aim at improving the EU’s performance and propose further steps in the protection of cultural heritage. The EU has contributed to reconstruction, restauration or revitalisation of cultural heritage affected by recent conflicts and crises in Libya, Iraq, Yemen, promoting at the same time social cohesion, new job creation and reconciliation. Part of recovery processes, the projects in Cameroon, Somalia, Israel, Occupied Palestinian Territory, Kosovo, Republic of Moldova, etc. have contributed to improved inter-community trust through cultural heritage protection. Resent Russian invasion of Ukraine, which has caused thousands of deaths and major economic damages, brought destruction of civilian infrastructure and considerably affected cultural heritage. Monuments, museums, archaeological sides and archives, etc. were fully destroyed or brutally damaged. This triggered EU to recognise the importance of ensuring synergies and coordination between the EU and its Member States for maximization of the impact of our actions in support for cultural heritage in conflicts and crises, and in line with the EU Integrated Approach to External Conflicts and Crises.

Niniejszy artykuł zawiera przegląd polityki UE w dziedzinie ochrony dziedzictwa kulturowego, ze szczególnym uwzględnieniem krajów pokonfliktowych. Analiza opisuje i ocenia ogólne podejście UE w różnych obszarach swojego zaangażowania w tej dziedzinie, a także w zakresie skutecznego wykonywania mandatu cywilnych misji Wspólnej Polityki Bezpieczeństwa i Obrony (WPBiO) posiadających w zakresie swojego działania ochronę dóbr kultury. W uwagach końcowych przedstawiono wybrane inicjatywy UE, które mają na celu poprawę wyników UE, a także zaproponowano dalsze kroki w zakresie ochrony dziedzictwa kulturowego. UE przyczyniła się do odbudowy, restauracji lub rewitalizacji dziedzictwa kulturowego dotkniętego niedawnymi konfliktami i kryzysami w Libii, Iraku i Jemenie, promując jednocześnie spójność społeczną, tworzenie nowych miejsc pracy i pojednanie. Jako część procesów odbudowy projekty w Kamerunie, Somalii, Izraelu, Okupowanych Terytoriach Palestyńskich, Kosowie, Republice Mołdawii itp. przyczyniły się do poprawy zaufania między społecznościami poprzez ochronę dziedzictwa kulturowego. Niedawna rosyjska inwazja na Ukrainę spowodowała tysiące ofiar śmiertelnych, jak również poważne szkody gospodarcze, przyniosła także zniszczenia infrastruktury cywilnej i obiektów mieszkalnych oraz znacząco wpłynęła na dziedzictwo kulturowe kraju. Zabytki, muzea, kolekcje sztuki, biblioteki, archiwa zostały całkowicie zniszczone lub poważnie uszkodzone. Skłoniło to UE do uznania konieczności zapewnienia synergii i koordynacji między organami UE i państwami członkowskimi w celu maksymalizacji wpływu wspólnych działań na rzecz wsparcia dziedzictwa kulturowego w konfliktach i sytuacjach kryzysach oraz zgodnie ze zintegrowanym podejściem UE do konfliktów i kryzysów zewnętrznych.
