The purpose of this article is to present the functioning of the quotes from the Bible in the “Monitor” magazine in the first decade of its publishing (1765-1774). The phenomenon is interesting because the era of the Enlightenment is commonly associated with the move away from the Church and the fight against religion. However, the longest appearing periodical contains quotations from the Bible (both in Latin and Polish). They are most often cited as the final argument. This shows that the Bible was the indisputable authority for the editors and readers of “Monitor” in the Enlightenment.

Celem artykułu jest przedstawienie tego, jak funkcjonowały cytaty biblijne w czasopiśmie „Monitor” w pierwszym dziesięcioleciu jego ukazywania się (1765-1774). Zjawisko jest interesujące, gdyż epoka oświecenia powszechnie kojarzona jest z odchodzeniem od Kościoła i walką z religią. Najdłużej ukazujący się periodyk z tych czasów zawiera cytaty z Pisma Świętego (zarówno w wersji łacińskiej, jak i polskiej). Przytaczane są one najczęściej w funkcji ostatecznego argumentu. Świadczy to o tym, że w oświeceniu dla redaktorów i czytelników „Monitora” Biblia była niepodważalnym autorytetem.
The article is devoted to the role of quotations as a tool to measure the impact of humanism on the example of letters of Piotr Wolfram – a Polish lawyer educated in Italy, participant of the Council of Constance, and ambitious official of the curia. Wolfram’s borrowings from Petrarch, Cicero, Quintilian, and Ovid have been analysed and it has been indicated for the last three that they did not have to be borrowed directly from their authors’ writings but could have been taken from medieval anthologies.

Artykuł poświęcony jest roli cytatów jako miernika wpływów humanistycznych na przykładzie listów Piotra Wolframa – polskiego prawnika wykształconego we Włoszech, uczestnika soboru w Konstancji i ambitnego kurialisty. Zawarte w nich zapożyczenia z Petrarki, Cycerona, Kwintyliana i Owidiusza zostały poddane analizie i dla ostatnich trzech wykazano, że nie musiały zostać zaczerpnięte bezpośrednio z dzieł autorów starożytnych, ale mogły pochodzić ze średniowiecznych antologii.
This article discusses references to Polish literary works found in novels by Poznań-based author Małgorzata Musierowicz (born 1945). The protagonists of the 22-volume Jeżycjada series are literature lovers. They often quote famous Polish writers, from Ignacy Krasicki to another writer from Poznań – Marek Obarski (1947–1997). Quotations from literature, thanks to their wide platform of dissemination through school, songs and films, become part of the reproduced content category (reproduced word-groups). The novels by M. Musierowicz are also a platform of dissemination for Polish literary fiction.
As a point of departure the author comments on the fragmentary (quotation-like) presence of Shakespeare in contemporary culture. Then he goes on to use Roman Jakobson’s model of communication to analyse several examples of how the Shakespeare quotation has been appropriated by means of transference into a new context. Using Jakobson’s model enables us to study the changes which the original text undergoes in the process of cultural transmission.

Punktem wyjścia są konstatacje na temat fragmentarycznej („cytatowej”) obecności Szekspira w kulturze współczesnej. Następnie wykorzystano schemat komunikacji Romana Jakobsona do analizy wybranych przykładów przywłaszczeń tekstu szekspirowskiego w postaci cytatu przeniesionego w nowy kontekst. Zastosowanie schematu umożliwia wniknięcie w przetworzenia, jakim ulega znaczenie oryginału w procesie transferu kulturowego.
Uzasadnienie wyroku sądu jest niewątpliwie dokumentem urzędowym, aczkolwiek w literaturze podnoszone są co do tej kwestii pewne wątpliwości. Konieczne jest odróżnienie orzeczeń od ich uzasadnień, co ma istotne znaczenie w aspekcie prawa autorskiego. Uzasadnienie jest utworem, ale nie stanowi przedmiotu prawa autorskiego jako dokument urzędowy w rozumieniu art. 4 ust. 2 ustawy z dnia 4 lutego o prawie autorskim i prawach pokrewnych. Treści uzasadnień są niewątpliwie zbyt obszerne, pisane językiem hermetycznym, przez co niezrozumiałe dla nieprawników. Zakres treści zawartych w uzasadnieniu określają przepisy procesowe. Fragmenty uzasadnień wyroków przejmowane są bez zmian do prac naukowych, często bez wskazania źródła. Niekiedy zauważalny jest proces odwrotny. Fragmenty utworu nie tracą jednak prawnoautorskiej ochrony. Uzasadnienia wyroków sądów wyższej instancji kopiowane są do uzasadnień wyroków niższych instancji. Zjawisko to dotyczy także kopiowania fragmentów aktu oskarżenia i pism procesowych stron.

The justification of a court judgment is undoubtedly an official document, although some doubts are raised in the literature on this issue. It is necessary to distinguish the judgments from their justification, which is important in terms of copyright. The justification of the judgment is a work, but not a subject of copyright, as an official document within the meaning of art. 4 sec. 2 of the Copyright and Related Rights Act. The content of the justifications is undoubtedly too extensive, written in hermetic language, which is incomprehensible to not lawyers. Sometimes the opposite is noticeable. Fragments of the work don’t lose legal protection. Justification of the judgments of higher courts is copied to the justifications of lower court judgments. This phenomenon also applies to the copying of excerpts and pleadings from the parties.
Fotografia, po spełnieniu przesłanek ustawowej ochrony, stanowi utwór w rozumieniu przepisów prawa autorskiego. Ustawodawca ogranicza prawa autorskie twórcy z powodu nadrzędnych interesów, takich jak informowanie czy prawo do informacji. Artykuł zwraca uwagę na specyfikę utworu fotograficznego i praw w nim występujących oraz na cel ograniczeń najistotniejszych dla utworu fotograficznego, takich jak w szczególności: przedruk fotografii reporterskich, cytat, wykorzystanie w ramach satyry lub karykatury.

The photograph, after fulfillment of the statuary requirements constitutes a work – as defined in the Polish copyright law. The Legislator infinite the copyright for the overriding reasons, such as informing, or the right of access to the information. The article draws attention to the specifics of the rights appearing in the photographic work and purpose of this limitation. Special emphasis is being put on issues related to reprint of reporter’s photographs, citation, as well as the usage of photograph in satire and caricature.
The article concerns the roles played by quotations and short literary forms in the process of popularizing literature through social media. Its main purpose is to review the most popular websites in Poland and the phenomena related to the subject in the title. The research methods used in the publication are qualitative methods, mainly: critical analysis of text, image and one of the newest methods: autoethnography. The qualitative assessment of this issue is complemented by the quantitative data of the social media, including the number of recipients of the pages, the coverage of the posts and the information provided. The article discusses the history of literature, the origins of literature on the Internet, Explains the issues of social media, and carefully analyzes selected cases of popularizing literary forms on the Internet.
