The paper is dedicated to the personality and activities of Antonín Randa, eminent personality of the Czech jurisprudence and Czech University in Prague in the 19th and at the beginning of the 20th centuries.Although Randa’s biography, despite his great importance, has not been written yet, a number of authors – researchers as well as his contemporaries – paid attention to his personality and to his work in several studies.His predominantly positive image, as an important central-European researcher and Czech patriot was surprisingly taken over by Marxist jurisprudence in 1950s, however, Randa’s legacy was forgotten later only to be rediscovered again after 1989. His position within the academic milieu, in the patriotic society and in politics,where his role has been more or less ignored up to now, can be examined not only by analysing his scientific works, but also with the use of new personal documents (diaries, memoirs and correspondence) that reflect Randa’s personalityand work from different points of view. The article aims to offer a more balanced, yet varied image of Randa’s public activities than has been the case so far.

Článek je věnován osobě a působení Antonína Randy, profilové osobnosti české právní vědy a české univerzity v Praze v 19. a na počátku 20. století. Ačkoliv se Randa přes svůj velký význam dosud nedočkal vlastní biografie, řada autorů – badatelů i Randových současníků – se v dílčích studiích věnovala jeho osobě i dílu. Přestože veskrze pozitivní obraz významného středoevropského vědce a českého vlastence poměrně překvapivě z „buržoazní tradice“ recipovala i marxistická právní věda 50. let 20. století, upadl Randa posléze v zapomnění. Znovuobjevení se dočkal až po roce 1989. Jeho místo v právní vědě, univerzitním světě, vlastenecké společnosti, ale i v dosud u něj opomíjené politice nyní umožňují nahlédnout nejen analýzy jeho vědeckých spisů, ale především mnohé nové egodokumenty (deníky, paměti, korespondence), které Randovu osobnost i působení nahlížejí z různorodějších úhlů, nežli tomu bylo dosud. Článek tak usiluje nabídnout vyváženější a různorodější obraz Randova působení, nežli tomu bylo dosud.

On the anniversary year of both the death and birth of Czech lawyer Viktorin Kornel ze Všehrd, the text is mainly devoted to exploring the existing research on Všehrd since the last major conference in 1960. The older research before this conference was dominated by legal historians. But the generational changes among them – the aging and dying of a strong older generation of legal historians during the 1970s and the early 1980s broke the research continuity. In contrast, since the 1970s, the activity of literary scientists, historians, and linguists has prevailed. Knowledge of Všehrd’s life, work, and of his relationships with his contemporaries have been enriched by many important new insights over the past 60 years. From the point of view of history of literature Všehrd’s book “On the Laws of the Land of Bohemia” was highly rated as an accomplished manifestation of humanist literature. An important figure of Všehrd’s friend and intellectual companion Jíra, the radical utraquist priest, was convincingly identified with two other important persons of the same name. The most striking finding of the past sixty years, however, was the existence of the unknown Všehrd’s book, printed in Venice. Heated but unproductive has been the literary controversy over the Všehrd’s importance and about national humanism (i. e. humanist writing in the national [vernacular] languages) in 2014. On the other hand, it has not yet been possible to prepare a critical scientific edition of the complete Všehrd’s literary work.

Text se u příležitosti výročí úmrtí i narození českého právníka Viktorina Kornela z Všehrd věnuje především zkoumání výzkumu o Všehrdovi od poslední velké konference roku 1960. Starší výzkum byl dominován právní historiografií. Vlivem generačních změn v ní – stárnutím a umíráním silné starší generace právních historiků v 70. a 80. letech 20. století však došlo k přerušení této výzkumné kontinuity. Naopak od 60. let převažovala aktivita literárních vědců, historiků a lingvistů. Poznání Všehrdova života i díla, stejně jako jeho vztahů se současníky, bylo v uplynulém šedesátiletí obohaceno mnoha důležitými novými poznatky. Z pozice studia humanistické literatury došel vysokého hodnocení jeho spis O právích země české. Bylo dovozeno Všehrdovo první manželství a byla přesvědčivě rekonstruována důležitá postava Všehrdova přítele a výrazného muže – kněze Jíry. Nejpozoruhodnějším zjištěním uplynulých šedesáti let však byla informace o existenci Všehrdova spisu, tištěného v Benátkách, dosud neidentifikovaného. Hlučná, avšak neplodná naopak byla literárněvědná polemika o Všehrda a o pojem národního humanismu roku 2014. Na druhé straně se dodnes nepodařilo připravit kritickou vědeckou edici celého Všehrdova díla.

The paper summarizes the life and work of the important Czech legal historian Jiří Kejř, focusing on the period of his twenty-year tenure at the Institute of State and Law of the Czechoslovak Academy of Sciences. His research interests focused on the Czech Middle Ages, specifically on the administrative and legal history of the Hussite period, especially the history of medieval cities, the University of Prague, the personality of Master Jan Hus and codicology. Moreover, Jiří Kejř authored a number of analytical studies and several synthesizing monographs. His works were based on a thorough study of manuscripts. His works from periods of oppression of freedom bear no trace of the ideological pressure prevailing at the time of their creation. They still have a high scientific value, so other researchers cannot neglect his work.

Příspěvek shrnuje život a dílo významného českého právního historika Jiřího Kejře se zaměřením na období jeho dvacetiletého působení v Ústavu státu a práva Československé akademie věd. Jeho badatelský zájem se soustředil na český středověk, konkrétně na správní a právní dějiny období husitství, zvláště na dějiny středověkých měst, pražské univerzity, na osobnost Mistra Jana Husa a také na kodikologii. Byl autorem množství analytických studií i několika syntetizujících monografií. Jeho práce byly založeny na důkladném studiu rukopisů. Díla, která napsal v časech nesvobody, nenesou stopy ideologického tlaku panujícího v době jejich vzniku. Stále mají vysokou vědeckou hodnotu, takže další badatelé nemohou jeho práce opominout.
