The article is a critical appraisal of one of the most vital publications concerning Norwid and his biography: Kalendarz życia i twórczosci Cypriana Norwida [Norwid’s life and work calendar], published by Wydawnictwo Poznańskie in 2007. This ample publication has 141 publication sheets that is 1816 printed pages (vol. 1 – pp. 800, vol. 2 – pp. 800, vol. 3 – pp. 216). It constitutes an enormous achievement of the Poznan-based Polish Studies milieu. It is a collective publication, developed by a research team headed by Professor Zofia Trojanowiczowa (co-authors being as follows: Elżbieta Lijewska, Zofia Dambek and Małgorzata Pluty, Jolanta Czarnomorska and Iwona Grzeszczak). The author of the review makes a number of corrections as regards dates and facts, yet he approaches the results of the huge collective research effort with a great deal of researcher’s humility, indispensable in pursuit of historical facts. In his analyses, the author employs the contextual apparatus: historical and philological. The author proves that Norwid’s Calendar is an undeniable source of invaluable knowledge, yet he shows that in this kind of research there is always “endless work of History” waiting ahead.

The text deals with the question of proprietary claims in the Polish civil law, which are exempted from prescription. The existence of such claims is a clear exception from the general rule set forth in Article 117 of the Civil Code (hereinafter: “CC”), which embraces all the proprietary claims with the general concept of prescription after the elapse of particular term (specified further in the following provisions). The article tries to explore the premises behind the general concept of lack of prescription, as well as to identify particular reasons for disapplication of Article 117 CC on the grounds of particular types of claims. The statute exempts explicitly two types of claims from prescription. It is the case of Article 223 § 1 CC, declaring lack of prescription for the damage claims supplementary to vindicatory claim. Similarly, according to Article 220 CC prescription does not embrace a claim for dissolution of co-ownership.  In the other instances, the similar conclusion is derived in interpretation, mainly upon functional and systematic arguments. The case-law and the private law scholarship identify five examples of such claims. In all of these instances, the main reason behind disapplication of prescription rules is the close link of this claims with real property. Prescription of these claims and, hence, the possibility to transform them into natural obligations, seem from this perspective counter-functional and difficult to reconcile with the other principles and provisions of property law.  It pertains, first of all, to the claims for establishing a way of necessity ease (Article 145 and 146 CC). Secondly, the same view is adopted for art. 151 CC, regarding another type of easement – available in the case of unintentional introducing a building or another facility behind the border of the somebody else’s ground. Thirdly, in the similar case of the intruding with a construction into another real property, the lack of prescription is adopted as regards the claim for transfer of title to the occupied part of the ground (Article 231 § 1 CC). Fourthly, the lack of prescription has been approved for the claim for establishing a transmission servitude (art. 3052 CC). Fifthly, the same solution has been proposed for the claim for transfer of title in performance of the contract with solely obligatory effects. This interpretation has been, however, rejected in the subsequent case-law and does not seem to be acclaimed currently.

La mort de Basile de Cesaree est traditionnellement datee le 1 janvier 379, c’est pourąuoi l’annee 1979 etait l’occasion de celebrer la mćmoire du grand ćveque de Cappadoce (les colloques sur s. Basile a Romę, Toronto, Chevtogne, Palermo, Lublin).

The suspension of energy supply is one of the farthest-reaching powers of energy entrepreneur with whom a recipient had signed an agreement. Therefore, it is not right which can be used in every situation, but must be met certain conditions, even if the basis for suspension of supply is the lack of payment by the recipient. It may rise dispute between the trader and the recipient concerning the validity of cutting-off delivery of electricity. It is necessary to determine whether the action of the energy trader was in accordance with the law, which was preceded by all the required law actions, including whether it has been preserved obligation to provide information in relation to the contractor. It is not sufficient that the recipient is in default for a specified period of payment for energy, but must be notified in writing of its intention to terminate the contract. In addition, it must be designated an additional two-week deadline for payment of outstanding and current liabilities. It’s important to define the conditions of keeping by the operator of the energy information’s obligation, including the starting date for calculating the additional period set for payment of arrears. This raises doubt whether the principle derived from Article. 61 of the Civil Code can be applied directly to the energy law, which aims to protect recipients. This is more important that consumers more often than not are recipients of electricity, so far the weaker party of a contract for the sale and delivery of electricity.
