Subject of the article is constituted by an analysis of his­torical and first of all contemporary systems of legal regulation of prostitution, and their influence on a social position of persons involved in sex business. Historical legal systems, which regulated the notion of social functioning of prostitution in 19th and 20th century, despite the social and customary transformations, still exert some influence on the definition of that phenomenon. They also influence directions of current legislative and administrative actions, towards the persons providing sex services, their clients and persons, who organize and facilitate their operation. The main purpose of the article is to analyze the legal systems currently discussed in Europe and around the world: criminalization, decriminalization, depenalization and legalization of prostitution. The article poses an analysis of arguments raised in the debate, and potential results of introduction of the proposed solutions, for a situation of persons providing sex services, and first of all of the level of social marginalization that they experience.

Podstawą artykułu jest analiza literatury przedmiotu dotyczącej regulacji prawnych prostytucji w XIX i początkach XX w., a także aktualnie toczących się debat na ten temat. Na jej podstawie wyróżniono i opisano historyczne oraz współczesne modele regulacji prostytucji. W artykule skoncentrowano się na sytuacji kobiet świadczących usługi seksualne oraz wpływie konkretnych regulacji prawnych na ich sytuację społeczną. Rozwiązania prawne składające się na zaprezentowane modele regulacji prostytucji w różnym stopniu przyczyniają się do zmiany zakresu marginalizacji społecznej doświadczanej przez zaangażowane w nią kobiety.
