W artykule podjęto dyskusję z rozpowszechnionym w polskiej praktyce działań rewitalizacyjnych, a błędnym, poglądem dotyczącym ograniczenia możliwości oddziaływania gminy na właścicieli nieruchomości nabytych od gminy w drodze sprzedaży. Aby działania rewitalizacyjne mogły być uruchomione na szerszą skalę, niezbędne jest zaangażowanie środków prywatnych i zbycie przez gminy części terenów – zwłaszcza poprzemysłowych – potencjalnym inwestorom. Stereotyp braku możliwości kształtowania warunków ponownego zagospodarowania sprzedanego terenu jest powszechny, najczęściej wzbogacany brakiem odpowiednich narzędzi w systemie planowania przestrzennego. Celem artykułu jest przegląd zapisów umownych umożliwiających wprowadzenie wymogów konkretnego zagospodarowania zbywanych gminnych nieruchomości.

The paper discusses one of the more common misunderstandings in Polish revitalization concerning the limitation of the possibility for the municipality to induce property owners to defined investment. For revitalization activities to be launched on a wider scale, it is necessary to involve private funds and sell some of the land, especially post-industrial, to potential investors. The stereotype of the lack of opportunity to shape the conditions for redevelopment of the land sold is widespread, most often enriched by the lack of appropriate tools in the spatial planning system. The purpose of this article is to review the contractual provisions that make it possible to introduce the requirements for the specific development of the disposed communal real estate.
