Polish Border Guard and the Government Protection Bureau are uniformed services whose status officers and the rules of the service are regulated in a similar manner. However, in the case of the disciplinary proceedings in both services there are significant differences in the legislation governing the liability of officers. A Polish Border Guard officer is subject to disciplinary action for the violation of professional discipline, ethics violations and other cases established by law. The list of acts for which he is liable to disciplinary action is closed. However, an officer of the Government Protection Bureau renders himself liable to disciplinary action for violation of professional discipline and in other cases provided for by law, and therefore the list of disciplinary offenses is open. A disciplinary superior in Polish Border Guard and the Government Protection Bureau combines the functions of the entity engaged in the disciplinary proceedings and adjudicating, and an accused officer can use the help of a professional attorney. The rights of accused officers should be strictly observed by their disciplinary superiors. Weaknesses in this area result in the repeal of disciplinary decisions by the administrative courts. The penalty catalogue in both of the uniformed services is similar. However, the decision on the sentence should always provide reasons for the choice and severity of penalty. The disciplinary superior justifying the penalty should rely on the objectives of proceedings, the nature of the offense and the attitude of the punished officer. No ruling shall be allowed, unless it provides reasons for disciplinary punishment.

Przedmiotem artykułu jest kwestia swoistego rodzaju odpowiedzialności represyjnej, jaką jest odpowiedzialność dyscyplinarna. Jest to istotne zagadnienie, albowiem dotyczy osoby sędziego, który nie wykonuje już funkcji orzeczniczej. W szczególny zatem sposób odczytane być winny dwa podstawowe powody zainicjowania postępowania dyscyplinarnego. Autorka rozważa przesłanki wszczęcia takiego postępowania, jego bieg, jak też konsekwencje poszczególnych możliwych orzeczeń. W szczególności podkreślone zostały skutki orzeczenia przez sąd dyscyplinarny najsurowszej z kar dyscyplinarnych, jaką jest kara pozbawienia sędziego prawa do stanu spoczynku wraz z prawem do uposażenia.

The objective of this article is a question of a particular kind of repressive liability as disciplinary liability. It is a significant issue as it concerns the judge who does not perform jurisprudence any more. In a particular way then there should interpreted two basic reasons of disciplinary proceedings initiating. The author considers circumstances of such proceedings, their course and consequences of particular possible judgements. There were emphasised consequences of the judgement of the most severe disciplinary punishments issued by the disciplinary court as the punishment of deprivation the judge of the right to retirement together with the right to be granted the pension.

Der Artikel ist eine Antwort auf die Frage nach der Bestrafungshaftung, die disziplinarische Haftung ist. Dies ist ein wichtiges Thema, da es eienen Richter betrifft, der seine richterlichen Aufgaben nicht ausführt. Es gibt zwei Hauptgründe für die Disziplinarmaßnahmen. Der Autor betrachtet die Voraussetzungen für die Eröffnung eines solchen Verfahrens, den Verlauf, sowie die möglichen Konsequenzen einzelner Entscheidungen. Er betont insbesondere die Aufmerksamkeit auf die Auswirkungen der schwersten Disziplinarmaßnahme, die die Strafe der Aberkennung des Rechts zum Ruhestand und des Rechtes zur Vergütung ist.
