As far as individual’s rights are inheritable, its freedom of will goes beyond its death. For a limited time that may be mandated in the interest of an effective life-time protection of its personality rights. The same applies to the post mortem right to the use of its name and to data protection. This contribution analyzes in detail the post mortem limitations of subjective rights with special regard to the genetic and digital estate of the deceased.

Existují subjektivní práva člověka, jež nejsou předmětem dědictví, ale některá práva jsou časově omezena v zájmu účinné ochrany osobnostních práv. Totéž platí i pro posmrtné právo na užívání jména a osobních dat. Tento článek analyzuje podrobným způsobem taková omezení subjektivních práv po smrti člověka se zvláštním důrazem na genetickou a digitální výbavu zemřelého.
