Spory między przedsiębiorcami a organami administracji gospodarczej są głównie rozpoznawane przez sądy administracyjne. W pozostałym zakresie weryfikacja działań administracji gospodarczej odbywa się przed sądami powszechnymi. Kontrola sądów administracyjnych rozciąga się na zarówno stanowienie, jak i wykonywanie publicznego prawa gospodarczego. Wzorce kontroli działań administracji gospodarczej są budowane z norm Konstytucji RP, prawa unijnego oraz ustaw. Pomyślny rozwój działalności gospodarczej w państwie wymaga bezstronnej, niezależnej, niezawisłej i sprawnej władzy sądowniczej.

Disputes between entrepreneurs and economic administration bodies are mainly heard by administrative courts. In the remaining scope, the verification of economic administration activities takes place before ordinary courts. This court-administrative control extends to both the making and enforcement of public economic law. Control patterns of economic administration activities are built from the following standards: the Polish Constitution, EU law, and parliamentary legislation. The successful development of economic activity requires an impartial, independent, and efficient judicial authority.

This article discusses the issues of applying the institutions of civil law in the activities of the economic administration based on the example of the administration of measures on the grounds of implemented tasks regarding the assessment system of conformity of goods with the essential requirements. The aim of the article is to identify new areas of applications of the civil law in the administration of measures and new legal phenomena taking place in the relations of administration authorities with entrepreneurs which are implied by the technical development in the area of metrology. Furthermore, the evaluation of their effects on the economy is presented both from the perspective of the protection of state interest and the interest of an individual entrepreneur. The following phenomena taking place under the influence of the appliance of civil-legal regulation method in metrology are presented: privatisation of public tasks from the field of metrology, appliance of civil-legal agreements in the activity of the administration of measures and the change in the status of administrative entities (offices of measures) as well as the situation of notified entities of the administration of measures in the conditions of parallel performed tasks in the conformity assessment system regarding the measuring instruments.

Artykuł omawia zagadnienie stosowania instytucji prawa cywilnego w działalności administracji gospodarczej na przykładzie administracji miar na gruncie realizowanych zadań z zakresu oceny zgodności wyrobów z zasadniczymi wymaganiami. Celem artykułu jest próba identyfikacji nowych obszarów zastosowania prawa cywilnego w działaniach administracji miar i nowych zjawisk prawnych zachodzących w relacjach organów administracji z przedsiębiorcami implikowanych postępem technicznym w dziedzinie metrologii. Następnie dokonana została ocena ich skutków dla gospodarki z perspektywy ochrony interesu państwa i interesu jednostkowego przedsiębiorcy. Zaprezentowane zostały zjawiska prawne zachodzące pod wpływem stosowania cywilnoprawnej metody regulacji w metrologii: prywatyzacja zadań publicznych z zakresu metrologii, zastosowanie umów cywilnoprawnych w działalności administracji miar oraz zmiana statusu podmiotów administrujących (urzędów miar) i sytuacja jednostek notyfikowanych administracji miar w warunkach równoległego wykonywania zadań publicznych w systemie ocenie zgodności przyrządów pomiarowych.
