The article presents the issue of so called grey area in Poland and the process of ,,escaping” into it by some of the employers, as well as employees. Entrance into the grey area creates has its advantages for the former and the later, and that is why it is interesting for both of the aforesaid subjects. However, these are benefits incurred against the law. The article also discusses the determinants of the spreading of this area, with the accent on the high costs of work in Poland.
W artykule omówiona została ogólnie problematyka reżimu prawnego pracy świadczonej przez skazanego odbywającego karę pozbawienia wolności na podstawie skierowania dyrektora zakładu karnego. Kanwą rozważań jest zagadnienie prawne skierowane do rozstrzygnięcia Sądowi Najwyższemu w sprawie III PZP 3/20, które brzmiało następująco: „Czy roszczenie o ustalenie istnienia stosunku pracy i wynagrodzenie dochodzone przez skazanego skierowanego do pracy w czasie odbywania kary pozbawienia wolności powinny zostać uznane za »sprawę cywilną« w rozumieniu art. 1 k.p.c. i podlegać weryfikacji w drodze powództwa cywilnego (art. 2 § 1 k.p.c.)”. Sąd Najwyższy odmówił podjęcia uchwały w tej sprawie. Nie zwalnia to jednak od podjęcia próby wyjaśnienia, czy świadczenie pracy przez skazanego na podstawie skierowania dyrektora zakładu karnego odbywa się w ramach stosunku pracy w rozumieniu art. 22 k.p. oraz czy dopuszczalna jest droga sądowa (art. 199 § 1 pkt 1 k.p.c.) dla dochodzenia przez skazanego roszczeń od zakładu karnego wynikających z faktu wykonywania takiej właśnie pracy, a zatem czy sprawa o takie roszczenie jest sprawą cywilną w rozumieniu art. 1 k.p.c.

The article discusses in general the issues of the legal regime of work provided by a convict serving a sentence of imprisonment on the basis of a job placement by the director of a penitentiary institution. The basis for considerations is the legal issue referred to the Supreme Court in the case III PZP 3/20 with the following wording: “Is a claim to establish the existence of an employment relationship and remuneration asserted by a convict sent to work while serving the sentence of imprisonment should be considered as ‘a civil matter’ within the meaning of art.1 of the Civil Code and be subject of verification by means of a civil action (art.2 §1 of the Civil Code)”. The Supreme Court refused to pass a resolution on the matter. However, this does no exempt from making an attempt to clarify whether the provision of work by the convict on the basis of a job placement by the director of a penitentiary institution takes place under an employment relationship in the meaning of art.22 of the Labour Code and whether legal action is permitted (art.199 §1(1) of the Civil Code) for assertion of claims by a convict against a penitentiary institution arising from the fact of providing such work, and therefore, whether the case for such a claim is a civil matter within the meaning of art.1 of the Civil Code.
In the article, the Author discusses the subject of the legal nature of contributions which are financed by the employing entities for participants to the Employee Capital Plans (ECP). The Author points out that despite the private nature of the ECP (which is declared by the legislator), this institution contains many elements of a public law nature. She particularly notices the public perspective at the obligations of employing entities which are related to ECP, especially in the field of their financing of basic contributions. In her opinion the nature of additional contributions financed by employing entities is more heterogeneous.

W artykule autorka porusza temat charakteru prawnego wpłat przez podmioty zatrudniające dla uczestników do Pracowniczych Planów Kapitałowych (PPK). Autorka zwraca uwagę, że pomimo deklarowanego przez ustawodawcę prywatnego charakteru środków PPK, instytucja ta zawiera wiele elementów natury publicznoprawnej. Dostrzega w szczególności perspektywę publicznoprawną w obowiązkach podmiotów zatrudniających związanych z PPK, zwłaszcza w zakresie finansowania przez nie wpłat podstawowych. Charakter wpłat dodatkowych finansowanych przez podmioty zatrudniające jest jej zdaniem bardziej niejednorodny.
