W wyroku z 19 grudnia 2012 r. Trybunał Konstytucyjny wypowiedział się w kwesti i zgodności z Konstytucją przepisów ustawy z dnia 13 stycznia 2012 r. o zmianie ustawy o emeryturach i rentach z Funduszu Ubezpieczeń Społecznych oraz niektórych innych ustaw (Dz.U. poz. 118; dalej też jako ustawa przejściowa), która wprowadziła w 2012 r. kwotową waloryzację świadczeń emerytalno-rentowych wymienionych w ustawie. Z wnioskiem o zbadanie jej konstytucyjności wystąpił Prezydent RP oraz Rzecznik Praw Obywatelskich. Odnosząc się do zarzutów wnioskodawców, sąd konstytucyjny uznał, iż ustawodawca nie naruszył przepisów Konstytucji, a wprowadzona przez niego nowelizacja jest uzasadniona zasadami równowagi fi nansów publicznych państwa oraz solidarnością społeczną.

In the ruling of the 19th of December 2012 the Constitutional Tribunal gave its views on the constitutional nature of the regulations of the act of the 13th of January 2012 on changes to the act on retirement and social security pensions from the Social Security Fund as well as on matters derived from other acts (Legal Gazette position 118; subsequently also as a transitionary act) which brought into force in 2012 a quota indexation for those retirement-social security pensions enumerated in the act. Both the President of the Polish Republic and the Polish Ombudsman brought a motion for the constitutionalism of the said to be verifi ed. In reply to the accusations of the applicants the Constitutional Court ruled that the legislator had not contravened any regulations of the Constitution and that the amendment brought is in accordance with the principles of both balance within state fi nances as well as social solidarity.
