W glosie przytoczono stan faktyczny opisany w wyroku Wojewódzkiego Sądu Administracyjnego (WSA) w Warszawie z dnia 9 grudnia 2016 r., sygn. akt: VI SA/Wa 721/16. Glosowane orzeczenie ma duże znaczenie dla rynku usług hotelarskich w Polsce, dotyczy bowiem postawienia granicy pomiędzy decyzją o wykreśleniu z ewidencji w przypadku niespełniania wymagań ustawowych a decyzją o nakazie wstrzymania świadczenia usług do czasu usunięcia uchybień (Borek, 2021).
When dealing with anti-crisis corporate management, the major assumption – business continuity – is no longer valid, thus affecting the methods of accounting for income and expenses. As regards income statement items recognition in such a situation, the key moment is an inflow or outflow of cash; the legal aspect of busi-ness accounting prevails over the economic substance; the prudence principle and cost-related estimation rules lose their importance, and income and expenses clas-sification and presentation takes place after completion of the entire bankruptcy procedure or each of its stages.Study of the national bankruptcy regulations and accounting practice in Bela-rusian companies under bankruptcy proceedings has made it possible to develop more efficient procedures for income and expenses measurement and recognition in anti-crisis management, and to improve their classification. Improvement of the accounting treatment of income and expenses, related to the effectiveness of bank-ruptcy proceedings, should contribute to developing better anti-crisis management strategies.
An attempt is made to assess the Central Register and Information on Business Activity (CEIDG) as a teleinformation system operating in conjunction with other electronically accessible public registers. The need for an integrated system of public registers results from the Act on freedom of economic activity of 2 July 2004 that provides, among others, for a system of verification of the data already entered in the Register. As the analysis shows, the Act did not originally provide for the necessity to transfer to the Central Register and Information on Business Activity the data entered in other public registers, but merely imposed an information obligation on concession authorities, registers of regulated business activity as well as relevant licencing authorities. Currently, the statutory provisions regulating the freedom of economic activity provide that economic courts, the Central Information unit of the National Court Register, the National Criminal Record, ward guardians and relevant organs deciding upon incapacitation, organs of state administration issuing or withdrawing permits to foreigners wishing undertake business activity in Poland as well as concession authorities, registers of regulated business activity and licencing authorities are obliged to make their data and information available to the CEIDG. The imposed obligation, however, does not mean that the above entities comply with its provisions. As practice shows, the Exchange of information between the Central Register and Information on Business Activity and the obliged entities is still negligent. The paper also indicates certain other problems related to the functioning of the Central Register and Information on Business Activity, and the availability of an entrepreneur’s address if the same as the place in which business is conducted, in particular. Despite the shortcomings, however, there are advantages as well, such as. e.g. a fast track procedure for those wishing to undertake economic activity, or a creation of a register of representative offices. Nevertheless, the current regulation requires further amendments to improve the existing system.

Artykuł dotyczy oceny funkcjonowania Centralnej Ewidencji i Informacji o Działalności Gospodarczej (CEIDG) jako sytemu teleinformatycznego powiązanego z innymi rejestrami publicznymi dostępnymi w formie elektronicznej. Konieczność istnienia takiego powiązania wynika wprost z treści ustawy z dnia 2 lipca 2004 r. o swobodzie działalności gospodarczej np. w celu weryfikacji danych wpisanych do CEIDG. Przeprowadzone w tej mierze badania wykazały, że początkowo ustawodawca nie uwzględniał konieczności przekazywania do CEIDG informacji zamieszczanych w innych rejestrach publicznych, ograniczając się wyłącznie do nałożenia na organy koncesyjne, organy prowadzące rejestry działalności regulowanej oraz organy właściwe do spraw zezwoleń i licencji obowiązków informacyjnych. Obecnie przepisy ustawy o swobodzie działalności gospodarczej zakładają udostępnianie danych i informacji do CEIDG przez sądy gospodarcze, Centralną Informację Krajowego Rejestru Sądowego, Krajowy Rejestr Karny, opiekunów i kuratorów w zakresie postanowień o ograniczeniu lub utracie zdolności do czynności prawnych, organy administracji rządowej w zakresie utraty przez cudzoziemców uprawnień stanowiących podstawę podejmowania działalności gospodarczej na terytorium RP, a także organy koncesyjne, organy prowadzące rejestry działalności regulowanej oraz organy właściwe do spraw zezwoleń licencji. Nie oznacza to jednak, że obowiązki te są wypełniane zgodnie z przepisami ustawy. Jak ukazuje praktyka, mimo istnienia obowiązków informacyjnych i funkcjonowania rejestrów publicznych wymiana informacji między tymi rejestrami a CEIDG jest znikoma. W dalszej części opracowania wskazano na problemy związane z funkcjonowaniem CEIDG, w szczególności w zakresie udostępniania adresu przedsiębiorcy jeśli jest taki sam jak miejsce wykonywania działalności. Nie sposób jednak nie dostrzec korzyści regulacji ułatwiającej podejmowanie działalności gospodarczej poprzez zintegrowanie wniosku (tzw. jedno okienko) czy też utworzenie rejestru przedstawicielstw. Wydaje się jednak, że obecna regulacja wymaga dalszych zmian w celu jej udoskonalenia.
Celem rozważań jest pokazanie sytuacji biur podróży na rynku polskim. Omówiono zasady wpisu do ewidencji oraz pokazano dane statystyczne pochodzace z Centralnej Ewidencji Organizatorów i Pośredników Turystycznych oraz dynamikę zmian. Imformacje obejmujądane dotyczące biur podróży według struktury przestrzennej, struktury własnościowej, rodzaju prowadzonej działalności, zakresu działania oraz typu gwarancji. Zgodnie ze stanem na dzień 27 listopada 2014 roku, w Centralnej Ewidencji Organizatorów Turystyki i Pośredników Turystycznych zarejestrowano 3790 podmiotów, które uzyskały zezwolenie na prowadzenie działalności organizatora turystyki lub pośrednika turystycznego, tj. o 265 czyli o 7,5% podmiotów więcej niż w roku ubiegłym. Największa koncentracja biur występuje na terenie województw mazowieckiego, małopolskiego, śląskiego i dolnośląskiego, a zdecydowanie najmniejsza w województwach: lubuskim, świętokrzyskim, opolskim i podlaskim. Na koniec omówiono dalsze możliwości i perspektywy rozwoju biur podróży.

An aim of considerations is to show the situation of travel agencies in the Polish market. The author discussed the rules of filing and presented the statistical data originating from the Central Register of Tourism Organisers and Intermediaries as well as the dynamics of changes. The information covers the data concerning travel agencies by the spatial and ownership structure, type of activities being carried out, the scope of activity, and the type of guarantees. As of the state on 27 November 2014, the Central Register of Tourism Organisers and Intermediaries filed 3790 entities that had obtained the permit to carry out activities of the tourism organiser or tourism intermediary, i.e. by 265, or by 7.5% of entities more than a year before. The highest concentration of agencies takes place in the territory of Mazovian, Lesser Poland, Silesian and Lower Silesian Provinces, while definitely the lowest in the Lubuskie, Świętokrzyskie, Opolskie and Podlaskie Provinces. In the final part of the article, the author discussed further opportunities and perspectives of travel agency development.
The purpose of the article is to present a method of measuring and recording settlements with employees in respect of remuneration, and to present the results of empirical research. A thesis was adopted according to which a system of remuneration measurement, settlement and documentation that is complicated and incomprehensible to employees significantly reduces the implementation of the pay incentive function, which is also a factor characterized by a negative form of motivation. The subject of the study was the method of organizing the measurement and record of settlements with employees within the accounting system, and the scope of the analysis was limited to the basic principles of calculating remuneration. The results of the analysis of settlement with employees in the examined company showed that the adopted principles (recommendations) of effective motivation are not properly respected in the system and the process of settlement with employees in respect of remuneration. In particular, this applies to the principle of proportionality of inputs made and effects achieved, the principle of maintaining incentive thresholds and the principle of internalization of organizational goals and others. The research used the method of analyzing impact factors, case analysis and expert method.

Celem artykułu jest przedstawienie sposobu pomiaru i ewidencji rozrachunków z pracownikami z tytułu wynagrodzeń oraz prezentacja wyników badań empirycznych. Przyjęto tezę, zgodnie z którą skomplikowany i niezrozumiały dla pracowników system pomiaru, rozliczania i dokumentacji wynagrodzeń znacząco zmniejsza realizację motywacyjnej funkcji płac, co więcej – stanowi czynnik odznaczający się ujemną formą motywacji. Jako przedmiot badań przyjęto sposób organizacji pomiaru i ewidencji rozrachunków z pracownikami w ramach systemu rachunkowości, a zakres analizy ograniczono do podstawowych zasad naliczania wynagrodzeń. Wyniki analizy rozrachunku z pracownikami w badanym przedsiębiorstwie wykazały, że przyjęte zasady (zalecenia) skutecznego motywowania nie są odpowiednio respektowane w systemie i procesie rozrachunku z pracownikami z tytułu wynagrodzeń. W szczególności dotyczy to: zasady proporcjonalności ponoszonych nakładów i uzyskanych efektów, zasady zachowania progów bodźcowych, zasady internalizacji celów organizacyjnych, i innych zasad. W badaniach wykorzystano metodę analizy czynników wpływu, analizę przypadku i metodę ekspercką.
Rozporządzenie Ministra Finansów z 19 stycznia 2012 roku wprowadziło zmiany porządkujące zapisy na kontach, między innymi w oświatowych jednostkach budżetowych. Zmianie uległy nazwy kont: 072, 080, 132, 140. Ujednolicono, pod kątem zapisów ustawy o rachunkowości, również opisy poszczególnych kont w punkcie II załącznika nr 3 do rozporządzenia. Skutki tych zmian znalazły odzwierciedlenie w sprawozdawczości finansowej. Zmieniły się tytuły wierszy w poszczególnych częściach sprawozdania oraz dodano pozycję „Informacje uzupełniające istotne dla oceny rzetelności i przejrzystości sytuacji finansowej” do wzoru Rachunku zysków i strat oraz do wzoru zestawienia zmian w funduszu.

The Finance Minister’s decree, dated 19/01/2012, brought changes to the budgetary unit accounting for educational institutions. The account names have been changed for the following accounts: 072, 080, 132 and 140. The descriptions of the particular accounts have also been standardised and brought in line with the Accounting Act, as per the point nr II of the appendix nr 3. Effects of these changes have been reflected in the financial reporting. The titles of the lines in the particular parts of the financial reporting have been changed and an additional line item (as listed below) has been added to the Profit and Loss (P&L) and the Balance Sheet to enhance reliability and transparency of the financial position: „Informacje uzupełniające istotne dla oceny rzetelności i przejrzystości sytuacji finansowej”.
Handel bronią i amunicją zazwyczaj jest kojarzony bądź z działalnością państwa (sił zbrojnych), bądź organizacji przestępczych. Na rynku broni i amunicji funkcjonują jednak także legalnie działające prywatne podmioty gospodarcze ściśle kontrolowane przez organy państwa. Kontrolę tych podmiotów umożliwiają przepisy zawarte zarówno w akcie rangi ustawowej, jak i w kilku aktach wykonawczych. Nakładają one na przedsiębiorców nie tylko obowiązek uzyskania koncesji, lecz także prowadzenia szczegółowej ewidencji obrotu i przekazywania ściśle określonych informacji wyznaczonym organom państwa. Dzięki sprawnemu obiegowi informacji państwo dysponuje możliwością wglądu w działalność sprzedawców i nabywców, ograniczając tym samym możliwość niekontrolowanego przepływu broni i amunicji oraz jej dostępność na czarnym rynku. Autor dokonuje szczegółowego przeglądu przepisów dotyczących sposobu ewidencjonowania obrotu bronią i amunicją oraz przekazywania informacji właściwym organom. Omawia także konsekwencje, jakie mogą ponieść przedsiębiorcy nieprzestrzegający obowiązków ewidencyjnych i informacyjnych. Autor proponuje również rozwiązania, które nie tylko mogą ułatwić wykonywanie omawianych obowiązków, lecz także usprawnić kontrolę działalności koncesjonowanej.

Arms and ammunition trade is usually associated either with activities of the State (armed forces) or criminal organizations. However, on the market of arms and ammunition there are also legally functioning, private business entities, which are strictly controlled by the authorities of the state. This control is enabled by a number of provisions contained in both - the act of statutory rank, as well as in several implementing acts. They impose on entrepreneurs, not only the obligation to obtain a license, but also keep detailed records of trade and transfer of specific information to designated authorities of the state. Through efficient cycle of information, the state has the power to inspect activities of sellers and buyers, thereby limiting the possibility of uncontrolled movement of arms and ammunition as well as its availability on the black market. The author provides a thorough review of the provisions concerning methods of registering arms and ammunition trade as well as providing information to competent authorities. Also discussed are consequences to be suffered by entrepreneurs not complying with registration and information obligations. The author also proposes solutions that not only facilitate exercising discussed obligations, but also improve the control of licensed activities.
The topic of “reason and faith in God” has challenged philosophers and theologians since the beginning of their disciplines, and it has left many inquirers confused. The key notions of faith and reason are often left unclear, and this complicates inquiry about faith in God. Many inquirers end up puzzled about the significance of the distinction between reason and faith. This paper outlines an approach to reason and faith in God that explains how faith in God can be well-grounded in reason as evidence, even if reason as an argument does not apply in a case. It identifies distinctive roles for experience and defense in an account of faith in God.

Problem „rozum a wiara w Boga” stanowił wyzwanie dla filozofów i teologów od samego początku istnienia ich dyscyplin, lecz wiele dociekań na ten temat wciąż pozostaje niewyjaśnionych. Nawet kluczowe pojęcia „wiary” i „rozumu” często pozostają niejasne, co komplikuje badanie na temat wiary w Boga. Dla wielu badaczy znaczenie rozróżnienia między rozumem i wiarą ostatecznie okazuje się zagadką. Niniejszy artykuł zarysowuje podejście do zagadnienia rozumu i wiary w Boga, które wyjaśnia, w jaki sposób wiara w Boga może być mocno oparta na rozumie oraz ewidencji przedstawianej przez rozum, nawet jeśli argumentacja rozumowa nie ma zastosowania w danym przypadku dotyczącym wiary w Boga. Artykuł określa również różne role, jakie spełniają doświadczenie oraz argumentacja apologetyczna w wyjaśnianiu wiary w Boga.
Many Christians seek to understand how their Christian faith relates to what goes by the name “philosophy.” They eventually see that no single well-defined subject goes by the name “philosophy.” It does not help matters that the term “philosophy” is among the most variably used terms in the English language, even among academic philosophers. This raises the question of how a Christian philosopher should proceed with inquiry about the relation between Christian faith and philosophy. This paper offers an answer in terms of “Christ-shaped” philosophy, and replies to some criticisms from William Hasker.

Wielu chrześcijan stara się zrozumieć, w jaki sposób ich wiara chrześcijańska odnosi się do tego, co znane jest pod nazwą „filozofia”. Ostatecznie przekonują się oni, że nie istnieje jeden wyraźnie określony przedmiot, który w sposób wyłączny określałaby nazwa „filozofia”. Nie ułatwia sprawy fakt, że termin ten należy do najbardziej wieloznacznie używanych terminów języka angielskiego, nawet wśród filozofów akademickich. Powstaje zatem problem, w jaki sposób filozof chrześcijański ma prowadzić badania w zakresie relacji, jaka zachodzi między wiarą chrześcijańską a filozofią. Niniejszy artykuł proponuje odpowiedź na to pytanie w kategoriach filozofii „ukształtowanej przez Chrystusa”; odpowiada on również na niektóre zarzuty ze strony Williama Haskera.
The solutions concerning the Central Register and Information on Economic Activity (CEIDG) regulated in the Act of 6 March 2018 on the Central Register and Information on Economic Activity and the Information Point for Entrepreneurs are analysed. The starting point of the analysis are the assumptions set out in the rationale for the draft act. Next, the changes introduced by the new act in terms of these assumptions, in particular with regard to the ordering of regulations, the division of data contained in CEIDG, their exchange and facilitations for entrepreneurs are assessed. The authoress also analyses the activities that are not subject to entry in the CEIDG (not registered) introduced by the provisions of the Act of 6 March 2018: Law on Entrepreneurs.

Za punkt wyjścia przyjmuje założenia określone w uzasadnieniu projektu ustawy i ocenia zmiany, jakie wprowadza nowa ustawa pod kątem tych założeń, w szczególności w zakresie uporządkowania przepisów, podziału danych zawartych w CEIDG, ich wymiany oraz ułatwień dla przedsiębiorców. Autorka analizuj także tzw. działalność niepodlegającą wpisowi do CEIDG (tzw. nieewidencjonowaną) wprowadzoną przepisami ustawy z 6 marca 2018 r. Prawo przedsiębiorców.
