Purpose: The purpose of the paper is to identify the factors that affect the development of the models of financial market state supervision and to identify the factors that have influenced the evolution of the supervision model in Poland. Methodology: critical analysis of literature, legal provisions and documents. Findings: The completely integrated and the fully dispersed model of supervision are located at the opposite ends of the spectrum. A variety of the hybrid models can be identified between them. Factors that affect supervision organization are both economic and non-economic. Factors that have influenced the Polish model of supervision include political aspects, administration costs and, in due course, also the development of the financial market. Research implications: The variety of state supervision structures, combined with the ambiguity and multiplicity of factors that affect their evolution create a new research challenge. Significant problems in accessing documents have been identified. Originality: The author presents an overview of models of state supervision of financial markets and factors affecting the evolution and structure of supervision. Conclusions drawn from the analysis were used to identify factors that influence the evolution and supervision of the Polish financial market.
For several years now, there has been more and more information on the difficulties of the co-operative credit union sector in Poland. The Financial Supervision Authority in its reports has pointed to poor financial performance of the sector, intricate capital and personal links between the companies operating within the SKOK Holding S.a.r.l. and, finally, a growing number of credit unions being subject to recovery proceedings . This paper attempts to present the credit union sector in Poland and its current financial situation. The conclusions of the paper confirm that the condition of the credit union sector is weak and that corrective actions such as recapitalization of the sector, its acquisition by the banking sector or other financial institutions as well as the creation of the so-called “bad bank” are absolutely necessary.
The main subject of this article is an attempt to resolve whether and on what principles active financial market participants were entitled to continue their activities related to trading in financial instruments during the so-called transition period determined by the provision of Article 29 of the Act of 1 March 2018 amending the Act on Trading in Financial Instruments and certain other acts (Dz.U. [Journal of Laws] of 2018, item 685). To this end, the authors have interpreted this provision in the context of the overall regulation of the amending act, with particular attention paid to the new wording of the definition of trading in financial instruments. The analysis of the indicated issues is carried out primarily from the point of view of active participants of the financial market, which constitutes a significant enrichment of the studies that have so far dealt with the discussed problem. Against the background of the above considerations, the authors draw attention to the influence of the Polish Financial Supervision Authority (Financial Supervision Commission) on other financial market participants, especially in relation to the supervisory proceedings conducted by the Authority and the supervisory measures applied. As a result of the conducted deliberations, the authors notice that the imprecision and incompleteness of the content of the analysed legal acts may be connected with significant negative consequences for the financial market participants, primarily in the form of financial sanctions.
The financial crisis that began in the United States as a result of the downturn in residential property values quickly spread to the global economy. The new risks which emerged during the breakdown highlighted the significant limitations and gaps in the existing regulatory system. The aim of this article is to examine the nature of the last crisis (its reasons and course), outline the new regulatory proposals of the main international bodies (the International Monetary Fund and the Basel Committee on Banking Supervision) in the financial sphere and to present the implementation of these proposals in the European Union and the United States in light of the G-20 summit arrangements.

Usługi oferowane przez tego typu instytucje przyciągają klientów wysokim oprocentowaniem depozytów oraz, jednak ich działalność opiera się gównie na kredytowaniu. Dostęp do szybkiej gotówki bez zbędnych formalności stwarza łatwo dostępne źródło finansowania dla klientów, którzy z różnych powodów nie mogą skorzystać z oferty na rynku tradycyjnych usług bankowych. Dynamiczny rozwój shadow banking może być przyczyną wielu zagrożeń. Ciemna strefa bankowości stwarza ryzyko wzrostu zadłużenia społeczeństwa, co w efekcie może prowadzić do utraty płynności oraz upadłości konsumenckiej. Brak odpowiednich przepisów regulujących funkcjonowanie podmiotów w szarej strefie bankowej stwarza zagrożenie dla sektora bankowego, dlatego działalność shadow banking należy objąć regulacjami, poddać ścisłej kontroli Komisji Nadzoru Finansowego lub całkowicie wyeliminować z rynku usług finansowych.

Shadow banking is currently taking up more and more space in the financial services market. The services offered by such institutions attract customers with high interest rates on deposits but their business is primarily based on lending. Access to fast cash without unnecessary formalities creates an easily accessible source of financing for customers who for various reasons can not benefit from the offer of traditional banking market. The dynamic development of shadow banking can cause many threats. The dark banking sector poses a risk of increasing public debt, which in turn can lead to liquidity loss and consumer bankruptcy. Lack of adequate provisions regulating the functioning of entities in the shadow banking sector poses a threat to the banking sector, so shadow banking should be regulated, subjected to tight scrutiny by the Financial Supervisory Commission or completely eliminated from the financial services market.
W artykule przeprowadzono analizę funkcjonowania depozytów w bankach komercyjnych i spółdzielczych oraz spółdzielczych kasach oszczędnościowo-kredytowych. W związku z tym, że prowadzenie działalności przez podmioty świadczące usługi finansowe narażone jest na oddziaływanie turbulentnego otoczenia, zarówno dalszego, jak i bliższego, podjęto się określenia zmian w ich prawnym otoczeniu, dotyczących zapewnienia bezpieczeństwa składanym w nich depozytom. Uwzględniono oddziaływanie Bankowego Funduszu Gwarancyjnego oraz Komisji Nadzoru Finansowego. Zwrócono również uwagę na unię bankową, w szczególności na jej filar – europejski system gwarantowania depozytów.

The article analyzes the functioning of deposits in commercial banks, cooperative banks and cooperative savings and credit unions. In connection with the fact that the conduct of business of financial services providers is exposed to the effects of the turbulent environment, both distal and proximal, the Authors undertook to determine changes in their legal environment concerning security of deposits. The impact of the Bank Guarantee Fund and the Financial Supervision Commission was considered. The article takes notice also on the banking union, in particular the European system of deposit insurance.
The author analyses the position of a candidate for member of a governing body in an entity supervised by the Polish Financial Supervisory Authority (PFSA) and discusses the related problems. The aim of the article is to identify the area of an increased risk level in financial institutions in the process of appointing members of the governing bodies of supervised entities. The PFSA assumes that the selection of the candidates for members of the governing bodies in Pension Fund Companies may be carried out by either the management board or the supervisory board. This leaves a large space for the activity of the boards. The management board can gain influence over the course of these proceedings. When the selection is conducted by the supervisory board, the risk is significantly reduced. The second aspect addressed therein concerns the position of a candidate for member of the governing bodies in supervised entities in legal proceedings. In jurisprudence it has been established that a candidate is to be treated as a party to the proceedings. The administrative courts found that inadmissibility of a candidate as a party would violate Article 77(2) of the Constitution by closing the judicial path for the candidate and preventing them from asserting protection of their rights and freedoms. Despite this, the Act of 21 July 2006 on Financial Market Supervision (Journal of Laws of 2020, item 2059, as amended) was amended in April 2021 to the effect that a candidate was not a party to the proceedings thus enhancing the risks, including conflicts of interest. The effect of these provisions has been instrumentalisation of those to whom a great deal of responsibility is entrusted – if the approval of the PFSA is obtained. The PFSA's decisions may affect the career path of candidates. In certain cases, they may even 'block' it, leaving little room for defence and narrowing the possibilities of adjusting the competence level to the positions held. There is also no timeframe for the PFSA’s decision. The risks associated with such situation have been described in the article.
Stabilization of the financial system and counteracting economic crises are among the pressing challenges and public authority tests. In recent years, in many rankings, it was possible to see that the institutional paths of the new "macroprudential perspective", which in the letters to the supplements to date, cover the entire financial system. Simultaneously, a new conceptual network has emerged, which seems to ignore the existing terminological conventions. In particular, the term "supervision" is misused instead of "policy" or is sometimes used synonymously. The thesis also applies to EU legal and national law (e.g., in Poland) and the nomenclature used in the literature, where there is no in-depth, interdisciplinary analysis in this area and comparative summaries of the terms used. Therefore, the purpose of this paper is to systematize the most important terms used in the area of financial stability and to clarify their meaning by indicating the correct conceptual designations.

Na przestrzeni ostatnich lat, w wielu państwach można było zaobserwować procesy instytucjonalizacji nowej „perspektywy makroostrożnościowej”, która w przeciwieństwie do dotychczasowych rozwiązań obejmuje cały system finansowy. Równocześnie powstała pewna nowa siatka pojęciowa, która jednak zdaje się ignorować dotychczasowe konwencje terminologiczne. W szczególności błędnie używa się pojęcia „nadzór” zamiast „polityka” lub niekiedy pojęcia te traktuje się jako synonimy. Teza ta dotyczy zarówno aktów prawnych UE, jak i prawa krajowego (np. w Polsce), a także nazewnictwa stosowanego w literaturze, gdzie brakuje pogłębionej, interdyscyplinarnej analizy w tym zakresie, jak również zestawień porównawczych pozwalających uporządkować używane pojęcia. Dlatego celem tego opracowania jest usystematyzowanie najważniejszych terminów stosowanych w obszarze stabilności finansowej oraz doprecyzowanie ich znaczenia poprzez wskazanie właściwych desygnatów pojęciowych.
In recent years, there has been a significant increase in interest in the subject of financial stability on a global scale, mainly due to regulatory, economic, and social implications of the 2007–2009 financial crisis. Organizations supervising credit institutions play a crucial role in ensuring their financial stability. Individual supervision models functioning in European Union member states differ from each other, for example in the degree of the central bank’s involvement in supervising activities. After the financial crisis, the supervision of the largest and most connected financial institutions operating across borders was unified to improve the security and stability of banking system in countries around the world.

W ostatnich latach na całym świecie zauważa się rosnące zainteresowanie tematyką stabilności finansowej, głównie z powodu regulacyjnych, ekonomicznych i społecznych następstw kryzysu finansowego lat 2007–2009. Jednostki nadzorujące instytucje kredytowe odgrywają kluczową rolę w kontekście zagwarantowania ich stabilności finansowej. Poszczególne modele nadzoru funkcjonujące w krajach Unii Europejskiej różnią się od siebie, na przykład stopniem zaangażowania banku centralnego w działania nadzorcze. Po kryzysie finansowym nadzór nad największymi oraz najbardziej powiązanymi instytucjami finansowymi działającymi transgranicznie został ujednolicony w celu poprawy bezpieczeństwa i stabilności systemów bankowych na całym świecie.
In 2018, there were many changes in corporate bond market in Poland. One of them was an increase in the nominal value of subordinated bonds issued by some financial institutions to 400 000 PLN. The main aim of the article is to analyze the sense and consequences of the increase in the nominal value of subordinated bond. The author put forward a thesis, which assumes that increase nominal value of these instruments will have a negative impact on the bank bonds market development in Poland.

Celem artykułu jest analiza zasadności i konsekwencji takiego rozwiązania. Autor postawił hipotezę, że podwyższenie wartości nominalnej tych instrumentów będzie miało negatywny wpływ na rozwój rynku obligacji bankowych w Polsce.
W artykule przedstawiono specyfikę ostatniej edycji ogólnoeuropejskich testów warunków skrajnych (TWS 2014), w których aktywnie uczestniczyły największe banki z krajów Unii Europejskiej. Niekonwencjonalny charakter edycji TWS 2014 wynikał z konieczności ich wkomponowania w szerszy proces wszechstronnej oceny tych europejskich instytucji finansowych, które przechodziły pod wspólny nadzór europejski. Mimo że Polska nie jest de facto państwem członkowskim strefy euro, polski organ nadzoru finansowego zdecydował się nie tylko aktywnie włączyć w przeznaczone dla wszystkich krajów UE testy warunków skrajnych, lecz również wykorzystać opracowaną przez EBC metodykę badania jakości aktywów do oceny portfeli kredytowych największych polskich banków. Wyniki badań potwierdziły odporność polskich banków na potencjalne sytuacje szokowe oraz ich stosunkowo dobre skapitalizowanie.

In his paper, the author outlines the basic features of the 2014 EU-wide stress tests in which major banks from the European Union participated. The unconventional character of the 2014 edition of stress tests was determined by the need of their incorporation into a wider process of comprehensive assessment of European financial institutions leading under the single supervisory supervision (SSM). Although Poland is not a euro area member state, the Polish Financial Supervision Authority decided not only to actively participate in the EU-wide stress tests devoted to all EU countries but also to apply the ECB methodology on asset quality review to assess the credit portfolios of the biggest Polish banks. The results have proved the resilience of Polish banks to potential shocks and their relatively good capital base.
Celem artykułu jest przedstawienie nowych narzędzi z zakresu nadzoru makroostrożnościowego jako czynników pozytywnie wpływających na bezpieczeństwo w europejskim systemie bankowym. Badaniu poddano bufory kapitałowe, wprowadzone do prawodawstwa unijnego przez pakiet CRD IV/CRR, ukazano ich tło historyczne, a następnie metodą analizy porównawczej pokazano zakres ich wdrożenia w poszczególnych państwach UE. Otrzymane wyniki pozwalają na stwierdzenie, że działania nadzorcze podjęte w odniesieniu do banków o znaczeniu systemowym, mających siedzibę w UE istotnie poprawiły ich kondycję kapitałową. Przez odpowiednią kalibrację wskaźników buforów kapitałowych możliwe jest zmniejszenie ryzyka systemowego, co ma duże znaczenie z punktu widzenia działalności tych banków. Uruchomienie systemu zapobiegania upadłościom instytucji finansowych przyczynia się także do redukcji kosztów społecznych ponoszonych przez podatników.

An aim of the article is to present new tools in the field of macroprudential supervision as the factors positively affecting security in the European banking system. The research covered capital buffers introduced to the EU legislation through the CRD IV/CRR package. The authors presented their historical background; then, by the method of comparative analysis, they showed the scope of implementation thereof in individual EU member states. The obtained results allow stating that supervisory measures undertaken in relation to banks of the systemic importance, with their seats in the EU, have significantly improved their capital condition. It is possible, through an adequate calibration of the indices of capital buffers, to reduce the systemic risk, what is of a great importance from the point of view of these banks’ activities. The launch of the system of preventing bankruptcies of financial institutions also contributes to reduction of social costs incurred by taxpayers.
W artykule omówiono rezultaty europejskich testów warunków skraj-nych z 2016 roku, przeprowadzonych według spójnej metodologii Euro-pejskiego Urzędu Nadzoru Bankowego (European Banking Authority – EBA). Aktualne wyniki testów stresowych 51 największych europejskich banków ogólnie potwierdziły ocenę ich kondycji kapitałowej prezento-waną dotychczas przez EBA. Konsekwencją odbudowy bazy kapitałowej w ostatnich latach był wzrost odporności większości badanych banków na potencjalne wstrząsy w gospodarce i na rynkach finansowych. W rezultacie wolumen kapitału najwyższej jakości CET1 (Common Equ-ity Tier 1) 51 badanych banków był wyższy o 180 mld euro na koniec 2015 roku w porównaniu z końcem 2013 roku i w warunkach recesji w gospodarce europejskiej oraz wstrząsów na rynkach finansowych ich współczynnik CET1 obniżyłby się z relatywnie wyższego poziomu w stosunku do początku poprzedniej edycji ćwiczenia (z 13,2% na koniec 2015 roku do 9,4% na koniec 2018 roku). Jednocześnie straty kapitałowe wynikałyby w głównej mierze z tytułu materializacji ryzyka kredytowe-go, a w mniejszym stopniu – z ryzyka rynkowego i operacyjnego.

In this paper, the outcomes of the 2016 EU-wide stress tests, based on the uniform methodology of the European Banking Authority (EBA), were discussed. The results confirmed the EBA’s assessment of the capi-tal position of the biggest European banks, which have been presented so far. As a consequence of restoring the capital base by the majority of banks in recent years, they have managed to improve their resilience to potential shocks in real economy as well as in financial markets. This has been reflected in increasing their highest quality capital volume by 180 bn euros at the end of 2015 in comparison to the end of 2013 (the starting point of previous EU-wide 2014 stress tests). Moreover, under the stress conditions and recession in European economy, their capital CET1 ratio would have dropped from the higher level in comparison to the starting point of previous exercise (from 13.2% at the end of 2015 to 9.4% at the end of 2018). Simultaneously, the capital loses would result mostly from materialisation of credit risk as well as – although to the lower extent – from the market and operational risk.
The consumer as an active participant in the financial market, plays an important role in it. The establishment of appropriate rules to protect his rights is necessary to maintain the stability of the market. The current regulatory framework and institutional protection of consumers of financial services, based on the obligation to adequately inform him about the conditions of their contract, have proved inadequate. Creation of a complete system of consumer protection in financial services should involve three groups of participants: consumers , financial institutions and public authorities, including financial supervision. This would help not only to increase the level of consumer protection in complicated financial market, but raise the stability of the entire financial sector.

Konsument jako aktywny uczestnik rynku finansowego odgrywa w nim istotną rolę. Ustanowienie właściwych zasad jego ochrony jest niezbędne dla utrzymania stabilności tego rynku. Obecne ramy regulacyjno-instytucjonalne ochrony konsumentów usług finansowych, opierające się na paradygmacie informowania go o warunkach zawieranej umowy, okazały się niewystarczające. W kształtowaniu pełnego systemu ochrony konsumentów usług finansowych powinny brać udział trzy grupy podmiotów: konsumenci, instytucje finansowe oraz organy administracji publicznej, w tym nadzoru finansowego. Przyczyni się to nie tylko do zwiększenia stopnia ochrony konsumentów na skomplikowanym rynku finansowym, ale też podniesie stabilność całego sektora finansowego.
This article presents certain aspects of the banking supervisory process in selected European countries. The aim of the author is to analyze historical and present organizations of supervision models in France and Switzerland. The economic situation in Europe after last financial crisis (2007–2009) has resulted in a large number of transformations in supervisory organizations, both on the European level and in individual countries. In practice the most changes was addressed on the model based on two pillars, where the first institution is responsible for prudential supervision (both macro and micro) and the second – for overall functioning supervised institution. The main goal is to present if the transformation on the European level – in fact – determine similar direction in transformation of organization of financial supervisory model in two selected countries. This analysis is concentrated on one of the financial area – banking services.

W artykule przedstawiono niektóre aspekty procesu nadzoru bankowego w wybranych krajach europejskich. Celem autora jest analiza organizacji historycznych i obecnych modeli nadzoru we Francji i Szwajcarii. Sytuacja gospodarcza w Europie po ostatnim kryzysie finansowym (2007–2009) zaowocowała dużą liczbą przemian w organizacji nadzoru, zarówno na poziomie europejskim, jak i w poszczególnych krajach. W praktyce większość zmian została skierowana na model oparty na dwóch filarach, gdzie pierwsza instytucja jest odpowiedzialna za nadzór ostrożnościowy (zarówno makro, jak i mikro), a druga – za ogólne funkcjonowanie nadzorowanych instytucji. Głównym celem jest pokazanie, czy transformacja na poziomie europejskim – w rzeczywistości – określa podobny kierunek transformacji organizacji modelu nadzoru finansowego w dwóch wybranych krajach. Analiza ta koncentruje się na jednym obszarze finansowym – usług bankowych.
The article delves into what the author terms a deposit war in the Polish banking sector, a process that has been under way since 2008, according to Mokrogulski. The author analyzes the causes and outcomes of the process. The research is mainly quantitative and incorporates a single‑equation econometric model. However, the analysis is also comparative in nature, Mokrogulski says, because the Polish banking sector is evaluated against its counterparts in other EU member states. The analysis is supplemented with institutional issues related to financial supervision in Poland. The author’s calculations show that the “deposit war” mostly applies to deposits with maturities ranging from one to six months. Due to interest rate rises, banks reported a significant increase in their short‑term deposit volumes, the author says. His models show that an increase in interest on deposits by 1 percentage point led to an average growth of the deposit volume by 2.7 % on a monthly basis. In the case of deposits with original maturities of over 1M up to 3M the growth was 5.4 %, the author says. Moreover, despite higher interest costs at the time of the deposit war, the financial condition of Polish banks did not deteriorate compared with their counterparts in other countries in Europe, according to Mokrogulski. Liquidity measures introduced by the Polish Financial Supervision Authority (KNF) additionally encouraged banks to maintain liquid assets and funds at sufficiently high levels. In the future, providing long‑term funding to banks could help prevent further deposit wars, the author concludes.

Celem artykułu jest ukazanie zjawiska wojny depozytowej w polskim sektorze bankowym od roku 2008 wraz z podaniem genezy zjawiska oraz próbą oceny skutków. Badanie koncentruje się na ilościowym opisie zachodzących procesów i zawiera jednorównaniowy model ekonometryczny. W pracy dokonano również oceny sektora bankowego w Polsce na tle innych krajów Unii Europejskiej. Analiza ma zatem również charakter porównawczy. Całość uzupełniono o wątek instytucjonalny związany z działalnością nadzoru nad rynkiem finansowym w Polsce. Z przeprowadzonych obliczeń wynika, że wojna depozytowa dotyczyła przede wszystkim terminów pierwotnych powyżej 1 miesiąca do 3 miesięcy oraz powyżej 3 miesięcy do 6 miesięcy. W związku z podwyżką oprocentowania, banki zanotowały znaczący wzrost wolumenu lokat dla ww. tenorów. Wyniki modelowania pokazały, że wzrost oprocentowania depozytów o 1 pp. implikował zwiększenie wolumenu depozytów przeciętnie o 2,7 % w skali miesiąca. W przypadku depozytów o terminie pierwotnym (1M; 3M> ów wzrost wynosił 5,4 %. Ponadto, pomimo zwiększenia kosztów odsetkowych w okresie wojny depozytowej, banki w Polsce nie odnotowały spadku wyników finansowych na tle banków europejskich. Dodatkowym czynnikiem zachęcającym banki do utrzymywania odpowiednio wysokiego poziomu płynnych środków są normy płynnościowe Komisji Nadzoru Finansowego (KNF), wprowadzone w 2008 r. W przyszłości powstawaniu wojen depozytowych może zapobiegać pozyskanie przez banki finansowania długoterminowego.
In 2017 as a result of the statutory amendment in polish credit union sector, a new type of cooperatives was appeared – a small credit union. Institutions that meet the criterion of a small credit union may offer only a limited range of financial services compared to other cooperatives, however, the burdens resulting from financial supervision have been mitigated. This change has resulted of the implementation of the Constitutional Tribunal’s judgment recognizing the supervision of small credit unions as unconstitutional. The aim of the study is to assess the introduced changes in the supervision of small credit unions in conjunction with their financial condition compared to the entire credit union sector in two time span; in 2014 and 2017. The regulatory changes introduced in small credit unions are minor, their purpose was primarily to fulfill the obligation arising from the judgment CT. In 2017, there were nine small credit unions, representing over ¼ of the sector institutions, and the share of their balance sheet total in this sector was below 1%. On the other hand, small credit unions are characterized by greater stability although they have a similar profitability compare to the entire sector.

W 2017 r. w sektorze spółdzielczych kas oszczędnościowo-kredytowych, w wyniku nowelizacji ustawowej wyodrębniono nową kategorię spółdzielni – małą kasę. Instytucje spełniające kryterium małej kasy mogą oferować ograniczony zakres usług finansowych w porównaniu do innych spółdzielni, jednak złagodzono wobec nich wymogi sprawozdawcze wynikające z nadzoru finansowego. Zmianę tę wprowadzono w następstwie wyroku Trybunału Konstytucyjnego uznającego nadzór nad małymi kasami za niezgodny z konstytucją. Celem opracowania jest ocena wprowadzonych zmian w nadzorze nad małymi kasami w powiązaniu z ich kondycją finansową na tle całego sektora SKOK w dwóch ujęciach czasowych; w 2014 i 2017 r. Wprowadzone w małych kasach zmiany regulacyjne są nieznaczne, niekiedy mają jedynie charakter deklaratywny, a ich zasadniczym celem było formalne wypełnienie obowiązku wynikającego z wyroku TK. W 2017 r. małymi kasami było jedynie dziewięć instytucji, co stanowiło ponad ¼ liczby kas ogółem, a udział ich sumy bilansowej w tym sektorze wynosił poniżej 1%. Natomiast małe kasy charakteryzują się większą stabilnością, choć mają rentowność zbliżoną dla całego sektora.
During past few years we have witnessed a significant increase in the use of unmanned aerial vehicles. The main aim of this paper is to present selected aspects of the liability for damages caused by drones. The article is composed of six parts. The introduction shows the development of the droned-powered industry and some negative issues related hereto i.e damages that they might cause. Subsequently, the international and polish regulations connected to subject matter are outlined. The author discusses also the issues related to third-party insurance for drone operators. Finally, a brief conclusion is provided where de lege ferenda proposals are suggested.

Publikacja ma na celu analizę regulacji odnoszących się do problematyki odpowiedzialności za szkody na powierzchni Ziemi spowodowane przez bezzałogowe statki powietrzne. W jej toku omówione zostanie pojęcie bezzałogowego statku powietrznego, którego definicja nie jest jednoznaczna. Następnie określone zostaną ramy prawne normujące odpowiedzialność za szkody na powierzchni naszego globu spowodowane przez tego rodzaju statki powietrzne ze szczególnym uwzględnieniem rodzaju odpowiedzialności oraz wskazaniem podmiotów, które ją ponoszą. Zarysowana zostanie także problematyka ubezpieczeń od odpowiedzialności cywilnej właściwych dla operatorów bezzałogowych statków powietrznych. Analizowane akty prawny będą miały charakter międzynarodowy, europejski, jak również krajowy.
The purpose of this article is to present changes of selected mechanisms constituting the protection system of investors participating in the Polish capital market through an investment firm, which effective application and enforcement by the supervisory body in theoretical terms ensure the optimal level of capital market regulation. As a rule, regulatory mechanisms limit the scale and growth opportunities on the capital market, but at the same time provide theoretical protective mechanisms that allow to obtain investor confidence in terms of willingness of investing investor's own funds. In recent months, significant changes in the architecture of capital market regulations have taken place in connection with the implementation of the so-called MiFID II package. The subject of this article seems to be particularly timely in the context of current events on the capital market, related to the so-called the affair of Getback SA, which, also in the assessment of financial supervision, significantly undermined confidence of the investors in the entire financial market. The above seems particularly important in the context of expectations of the growing involvement of retail investors in financial instruments, which is a base of the development of the capital market, and positively correlated with the development of this market, asymmetry of information among its participants.

Celem niniejszego artykułu jest przedstawienie zmian wybranych mechanizmów składających się na system ochrony inwestorów uczestniczących w polskim rynku kapitałowym za pośrednictwem firmy inwestycyjnej, których efektywne stosowanie i egzekwowanie przez organ nadzoru ma w ujęciu teoretycznym zapewnić optymalny poziom regulacji rynku kapitałowego. Mechanizmy reglamentacyjne co do zasady ograniczają skalę i możliwości wzrostu rynku kapitałowego, ale jednocześnie zapewniają teoretyczne mechanizmy ochronne pozwalające na uzyskanie, kluczowego z punktu widzenia skłonności do inwestowania własnych środków pieniężnych, zaufania inwestorów. W ostatnich miesiącach istotne zmiany w architekturze regulacji rynku kapitałowego miały miejsce w związku z implementacją tzw. pakietu MiFID II. Tematyka niniejszego artykułu wydaje się być szczególnie aktualna w kontekście bieżących wydarzeń na rynku kapitałowym, związanych z tzw. aferą Getback S.A., która, także w ocenie nadzoru finansowego1, istotnie podważyła zaufanie do całego rynku finansowego. Powyższe wydaje się szczególnie istotne w kontekście oczekiwań co do rosnącego stopnia zaangażowania inwestorów detalicznych w instrumenty finansowe, stanowiącego warunek rozwoju rynku kapitałowego oraz pozytywnie skorelowanej z rozwojem tego rynku, pogłębiającej się asymetrii informacji pomiędzy jego uczestnikami.
The aim of the article is to present the process of financial market integration within the European Union and its assessment. The article explains the concept of financial integration and presents steps taken by the European Union in order to integrate the financial market and the level of that integration, and also indicates challenges that the European Union must meet to further integrate its financial market. The analysis that was carried out lets the author state that the attempts to create a uniform financial market within the European Union have been unsuccessful so far. Nevertheless, the steps taken by the European Union, i.e. the implementation of FSAP, the introduction of the euro, common financial policy, TARGET or SEPA, greatly contributed to the increase of the level of the EU financial market integration. The development of the integration can be especially seen on the wholesale financial services market. Retail market keeps being poorly integrated. The 21st century financial crisis clearly showed that the process of integration requires an introduction of some changes which mainly regard the issues of financial market supervision.
