The aim of this article is to look into the issue of an access to firearms in Poland. The object of analysis was the firearms licensing decisions based on the jurisdiction of Polish courts. The author points out that everyone who has successfully gone through the process of medical and psychological testing and a thorough training course concerning the use of firearms as well as has passed an exam testing the knowledge of firearms possession and use regulations, is capable of handling firearms and is an individual of good repute, should have an unlimited firearms certificate.

Artykuł dotyczy kwestii administracyjnego cofnięcia pozwolenia na broń. Ta dyskusyjna kwestia została uregulowana w art. 18 ustawy o broni i amunicji. W jego strukturze wyróżnia się dwa bloki tematyczne: obligatoryjne i fakultatywne działanie Policji w tych przypadkach. Artykuł zawiera liczne odniesienia do orzecznictwa Naczelnego Sądu Administracyjnego oraz Wojewódzkiego Sądu Administracyjnego. Autor przedstawia słuszne rozwiązania prawne w tej materii oraz prezentuje regulacje dyskusyjne i budzące wątpliwości. Kwestie polemiczne autor kończy wnioskami de lege ferenda.

The article concerns the issue of administrative revocation of a firearms licence. This questionable issue was regulated in art. 18 of the Act on arms and ammunition. Its structure distinguishes between two thematic blocks: obligatory and optional activities of the Police authority in these cases. The article contains numerous references to the jurisprudence of the Supreme Administrative Court and the Provincial Administrative Court. The author presented the right legal solutions to this issue and presented discussion regulations and questions. The author ends polemical issues with de lege ferenda conclusions.

Niniejszy artykuł poświęcony jest dostępowi do broni w celu ochrony osobistej w Polsce. Jest to zagadnienie, które budzi wiele kontrowersji i które w obecnych czasach z całą pewnością warto poruszyć. W poniższej pracy omówiono następujące kwestie: definicji broni palnej oraz jej istotnych części, warunków uzyskania pozwolenia na broń, obrony koniecznej oraz posiadania broni w celu ochrony bezpieczeństwa państwa. Podjęta została także problematyka umiejętności strzeleckich osób zainteresowanych bronią, badań psychologicznych i posiadania broni w Wielkiej Brytanii, Szwajcarii, Czechach i Niemczech.

This article is dedicated to the access to weapons for self-defense in Poland. This is an issue that raises a lot of controversy and is nowadays certainly worth discussion. The following work raises the issue of the definition of firearms, their essential parts, the conditions for obtaining a permit for a gun, the subject of firearms in self-defense and possession of weapons in order to protect national security. Another issue that is raised are the shooting skills of people interested in possessing a gun, people’s preferences in the choice of weapon and finally psychological research performed on people interested in gaining permission and possession of weapons in the UK, Switzerland, Czech Republic and Germany.
