Celem niniejszej publikacji było przybliżenie ekonomicznego wymiaru problematyki przemieszczania się obywateli Unii i członków ich rodzin na terytorium Unii Europejskiej (UE) w świetle obowiązujących aktów prawnych oraz orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej (ETS). Szczególną uwagę poświęcono ograniczeniom swobody poruszania się na terytorium UE, wynikającym z art. 45 ust. 3 Traktatu o Funkcjonowaniu Unii Europejskiej (TFUE). W przeważającej części pracy ukazano aspekty towarzyszące realizacji ograniczeń przedmiotowej swobody rynkowej poprzez analizę orzecznictwa ETS w zakresie stosowania restrykcji, uzasadnionych przede wszystkim względami „porządku publicznego”.

The aim of this publication is to present the economic dimension of issues of movement of the Union citizens and their family members in the European Union (EU) in the lightof existing legal acts and the judicial decisions of the European Court of Justice (ECJ). Particular attention was given to the restrictions of freedom of movement within the EU, under Article 45 paragraph 3 of the Treaty on the Functioning of the European Union (TFEU). For the most part, the author shows the limitations associated with the aspects of implementation of this freedom in question by analyzing the ECJ case law in applying the restriction, justified primarily on the grounds of ‘public order.’
