The paper focuses on solutions developed in 2019-2020 by the federal government (often in agreement with the federal states or under the influence of the CDU/CSU and SPD parliamentary groups) in the process of energy transition concentrated on the issue of reducing greenhouse gas emissions, i.e. precipitating actions for climate protection. The instruments adopted in the so-called climate package, the problem of phasing out coal for energy production by 2038 and the precipitation of the pace of renewable energy development, anchored in the prepared amendment to the Renewable Energy Sources Act, were presented. In addition, statistical data on the development of renewable energy sources and the reduction of greenhouse gas emissions in total and by economic sectors were taken into account, which makes it possible to assess the progress of the energy transition, which has an impact on the effectiveness of German climate policy.
Research background: The production and use of energy satisfies human needs, but also gives rise to a host of adverse environmental pressures, such as air pollution and waste generation. The issue of energy efficiency and climate chance resonates in the energy sector as one of the main producers of green-house gas emissions (GHG). While the European Union in general is doing well in reducing emissions and increasing the share of renewables, unfortunately, there are countries that are still far from reaching their goal. Purpose of the article: The paper is focused on the quantitative assessment of the link between the economic growth of the energy sector and the production of GHG emissions by the energy sector in V4 countries during the period 1995?2016. For this purpose, decoupling analysis will be realized. Methods: The decoupling of economic growth and the environmental pressures caused by this growth has a rich tradition within the sustainable development literature. The decoupling method was chosen for its ability to link economic and environmental indicators. Decoupling elasticity will be calculated with the aim of assessing the relationship between the economic growth of the energy sector (measured in GVA) and GHG emissions produced by the energy sector in V4 countries within the research period. Decoupling elasticity indicates different forms of the decoupling and coupling of the two variables. Findings & Value added: The results of the analysis suggest the prevailing strong decoupling of the economic growth of the energy sector and GHG emissions produced by the energy sector, which can be considered a positive trend. The findings of this paper are relevant for the government, state and public institutions and stakeholders in general, who play important roles in the preparation of programs, projects and policies to make energy generation, transport and use more efficient and environmentally sustainable.
The article focuses on analysis of activities for climate protection within the transatlantic cooperation. In the first part of the study general determinants, interests and aims of the EU and the U.S. climate policies have been presented. The divergent interests and different European and American development priorities condition their mixed actions for climate protection, both at domestic level and within the frameworks of international climate negotiations. In the second part of the article difficulties in working out a common position of the EU and the U.S. on global activities for climate protection that consist on reduction of greenhouse gas emissions have been discussed. The analysis encompasses the reasons and implications of the specific U.S. and EU’s stances within the process of negotiations of new global climate agreement with ambitious reduction aims that should be signed in 2015 and implemented after 2020 (post-Kyoto). In the last part of the study some aspects of U.S. and EU’s actions for climate protection within the frameworks of transatlantic cooperation have been presented. The EU aimed at convincing the U.S. about the necessity for reduction of global temperature by two Celsius degrees relative to the level from preindustrial period and at adoption multiyear obligations as to reduction greenhouse gas emissions. That is why these issues have been included into the program of transatlantic cooperation.
Od 2005 roku we wszystkich państwach należących do UE funkcjonuje unijny system handlu uprawnieniami do emisji gazów cieplarnianych (EU ETS – European Union Emissions Trading System). Systemem tym są objęci emitenci instalacji spalania paliw i instalacji przemysłowych oraz emitenci statków powietrznych. Operatorzy instalacji objętych systemem EU ETS rozliczają się corocznie z wyemitowanej ilości gazów cieplarnianych w ramach danego okresu rozliczeniowego. Ustalono trzy okresy rozliczeniowe, obejmujące lata 2005-2007, 2008-2012 oraz 2013-2020. Przewidywane jest dalsze funkcjonowanie systemu EU ETS po 2020 roku. Celem artykułu jest próba ukazania wpływu wprowadzenia EU ETS na rozwój gospodarczy Polski.

Since 2005, the European Union Emissions Trading System (EU ETS) has been operating in all EU Member States. This system is covered by issuers of fuel and industrial combustion installations and aircraft issuers. Operators of installations covered by the EU ETS shall settle annually on the emission of greenhouse gases within a given accounting period. Three settlement periods, covering the years 2005-2007, 2008-2012 and 2013- 2020, were established. It is expected that the EU ETS will continue functioning after 2020. The aim of this article is to demonstrate the impact of EU ETS on Poland’s economic development.
This paper assesses the impact of the decision of the German Federal Constitutional Court of 24 March 2021 on German and European legal regulation in the field of climate protection. The main thesis argues there is a need to change both legal regimes towards a decisive reduction of carbon dioxide emissions. The climate provision has given new impetus to the challenge of ecological transformation, which the German legislator has thus far been unable to meet. Although the Court found the existing regulation of German law to be compatible with the Constitution, nevertheless, as global warming intensifies, the requirements to strengthen environmental protection may increase, and the Court is likely to subject existing legal regulations to more rigorous review. There is currently much speculation in the scholarly literature concerning the significance of the Federal Constitutional Court’s ruling. Ultimately, however, the question of whether this ruling will remain a special case or will initiate a line of jurisprudence towards greater intergenerational justice will only be answered by future judicial decisions.

Przedmiotem opracowania jest ocena wpływu orzeczenia niemieckiego Trybunału Konstytucyjnego z 24 marca 2021 r. na niemiecką i europejską regulację prawną z zakresu ochrony klimatu. Główna teza sprowadza się do konieczności zmiany obu reżimów prawnych w kierunku zdecydowanego ograniczenia emisji dwutlenku węgla do środowiska. Postanowienie klimatyczne dało nowy impuls do podjęcia wyzwania ekologicznej transformacji, któremu dotychczas niemiecki prawodawca nie był w stanie sprostać. Wprawdzie Trybunał uznał dotychczasową regulację prawa niemieckiego za zgodną z Konstytucją, niemniej w miarę nasilania się globalnego ocieplenia wymagania dotyczące wzmocnienia ochrony środowiska mogą wzrosnąć, a Trybunał prawdopodobnie dokona bardziej rygorystycznego przeglądu obowiązującej regulacji prawnej. W literaturze istnieje obecnie wiele spekulacji na temat zakresu znaczenia postanowienia Federalnego Trybunału Konstytucyjnego. Ostatecznie jednak na pytanie, czy orzeczenie to pozostanie szczególnym przypadkiem, czy też zapoczątkuje linię orzeczniczą zmierzającą do większej sprawiedliwości międzypokoleniowej, odpowiedzieć może jedynie przyszłe orzecznictwo sądowe.
The role of environmental tax as an economic instrument to reduce environmental degradation has been under investigation for many years. In this paper, the main research objective is to check whether there were long-term relationships (cointegration) between greenhouse gas emissions, environmental taxes and gross domestic product in Visegrad Group countries under the inverted U-shaped Environmental Kuznets Curve (EKC) hypothesis from 1995 to 2018. It was also checked whether environmental tax has an impact on greenhouse gas emissions. In the first step, the long-run relationship (cointegration) was examined by applying the Autoregressive Distributed Lag (ARDL) bounds test. In the second step, the causal relationship and direction were tested within the Vector Error Correction Model (VECM) framework. The results of ARDL bounds testing confirmed cointegration between variables only in Poland. However, the long-run relationships between the variables are not consistent with the inverted U-shaped EKC hypothesis. They confirm the U-shaped EKC hypothesis, indicating that greenhouse gas emissions decrease with an increase in GDP per capita. After reaching the minimum, emissions increase again. The test of the causal relationship in Poland indicates the existence of convergence to the long-term equilibrium only for the equation where the environmental tax is the dependent variable.

Rola podatku środowiskowego jako instrumentu oddziaływania na gospodarkę w celu zmniejszenia degradacji środowiska jest przedmiotem badań od wielu lat. W niniejszym artykule głównym celem badawczym jest sprawdzenie, czy zachodzą długookresowe związki (kointegracja) między emisją gazów cieplarnianych, podatkami środowiskowymi oraz produktem krajowym brutto w państwach Grupy Wyszehradzkiej zgodnie z hipotezą środowiskowej krzywej Kuznetsa (EKC) w latach 1995–2018. Sprawdzono również, czy podatek środowiskowy ma wpływ na emisję gazów cieplarnianych. Badając, czy istnieje między zmiennymi modelu długookresowa stabilna zależność (kointegracja), przeprowadzono testy z wykorzystaniem modelu autoregresyjnego z rozkładem opóźnień (ARDL). W drugim etapie zbadano występowanie oraz kierunki związku przyczynowego, wykorzystując wektorowy model korekty błędem (VECM). Testy przeprowadzone za pomocą modelu ARDL potwierdziły kointegrację między zmiennymi tylko w Polsce. Jednak relacje długookresowe między zmiennymi nie są zgodne z hipotezą EKC w kształcie odwróconej litery U. Są one zgodne z hipotezą EKC w kształcie litery U, wskazując, że początkowo wraz ze wzrostem PKB per capita emisja gazów cieplarnianych spada, a po osiągnięciu minimum ponownie rośnie. Badania występowania i kierunku związku przyczynowego za pomocą modelu VECM wykazały w Polsce konwergencję modelu do równowagi długookresowej tylko dla równania, w którym zmienną zależną jest podatek środowiskowy.
W artykule przedstawiono wyniki analizy realizacji celów polityki klimatyczno-energetycznej Unii Europejskiej w wybranych państwach członkowskich w kontekście prowadzonej przez te państwa własnej polityki energetycznej. Przyjęty okres analizy obejmuje lata 2008–2014. Do analizy wybrano siedem krajów Unii Europejskiej: Czechy, Danię, Niemcy, Francję, Litwę, Polskę oraz Wielką Brytanię. Realizacja poszczególnych celów polityki klimatyczno-energetycznej Unii Europejskiej przebiega w wybranych krajach w różnym zakresie. Przeprowadzone badania pozwalają na wyciągnięcie wniosku, że coraz więcej państw prowadzi politykę energetyczną, opierając się przede wszystkim na polityce krajowej, która nie zawsze jest spójna z założeniami pakietu klimatyczno-energetycznego Unii Europejskiej.

The main aim of this article is to present the results of the analysis of the EU climate and energy policy goals in selected Member States in the context of their energy policies. The analysis covers the period 2008–2014 and focuses on seven EU Member States: the Czech Republic, Denmark, Germany, France, Lithuania, Poland and the United Kingdom. Each of the countries is implementing EU climate and energy policy goals, but to varying degrees. The research leads to the conclusion that more and more countries implement energy policy primarily based on national policy, which is not always consistent with the assumptions of the EU’s policy.
The study presents the linkages between the challenges of reducing climate change and Germany’s energy security in the second decade of the twenty-first century. Energy security is guaranteed whenever the negative effects on the environment and climate are reduced to a minimum at all stages of energy management, i.e. the acquisition of energy carriers, their processing, transport and consumption. The paper looks at the main directions of the development of Germany’s energy policy since the late 1990s, and discusses the statistics on energy efficiency, the development of renewable energy sources, and the reduction of greenhouse gas emissions. It also outlines the major issues related to safeguarding the security of Germany’s energy supply in the process of energy transformation and climate protection, highlighting the importance to seek and implement relevant solutions that simultaneously protect the climate and improve energy security.

Opracowanie prezentuje zależności między wyzwaniami ograniczenia zmian klimatu a bezpieczeństwem energetycznym Niemiec w drugiej dekadzie XXI wieku. Zapewnianie bezpieczeństwa energetycznego następuje w sytuacji ograniczania negatywnych skutków oddziaływania na środowisko naturalne i klimat na wszystkich etapach gospodarowania energią, czyli pozyskiwania nośników energii, ich przetwarzania, transportu i konsumpcji. Przedstawiono główne kierunki rozwoju polityki energetycznej Niemiec od końca lat 90. XX wieku oraz uwzględniono dane statystyczne dotyczące efektywności energetycznej, rozwoju odnawialnych źródeł energii i redukcji emisji gazów cieplarnianych. Ponadto w artykule omówiono główne problemy zapewniania bezpieczeństwa zaopatrzenia energetycznego Niemiec w procesie transformacji energetycznej i ochrony klimatu. Istotne jest poszukiwanie i wdrażanie rozwiązań służących jednocześnie ochronie klimatu i poprawie bezpieczeństwa energetycznego.
Niewątpliwie największym globalnym wyzwaniem jest obecnie zmiana klimatu, która przekształca świat oraz zwiększa ryzyko niestabilności we wszystkich jej formach. Wpływ globalnego ocieplenia, spowodowanego przez gazy cieplarniane, zmienia nasze środowisko i jest powiązany ze zwiększoną częstotliwością oraz intensywnością ekstremalnych zjawisk pogodowych. Już teraz jesteśmy świadkami zwiększonej liczby powodzi, fal upałów, ulewnych deszczy, pożarów lasów czy zanikania lodowców. Ponadto zanieczyszczenie powietrza i niski poziom ochrony ekosystemów mają już widoczne negatywne skutki i spowodują w przyszłości poważne problemy środowiskowe, gospodarcze oraz zdrowotne. W związku z tym absolutnie konieczne jest podjęcie wspólnych wysiłków na rzecz złagodzenia zmiany klimatu i dostosowania się do jej skutków. Osiągnięcie neutralności klimatycznej w 2050 roku stało się kluczowym wyzwaniem dla wszystkich krajów, zwłaszcza dla państw członkowskich UE. W niektórych krajach rozwiniętych emisje relatywnie spadają, ale kraje te są również historycznie najbardziej odpowiedzialne za emisje gazów cieplarnianych. Z kolei gwałtowny wzrost emisji w krajach rozwijających się jest często powiązany z outsourcingiem oraz globalnymi wzorcami produkcji i konsumpcji. Republika Słowacka zobowiązała się do osiągnięcia celu neutralności klimatycznej do 2050 roku. Chociaż emisje gazów cieplarnianych na Słowacji spadły o 45,6% w latach 1990-2019 i spadły o 5,2% rok do roku (2018-2019), potrzebne będą dalsze wysiłki, aby osiągnąć cele długoterminowe. W niniejszym artykule skupiamy się na ocenie podejść i działań Republiki Słowackiej w kierunku zrównoważonego rozwoju i neutralności klimatycznej. Aby osiągnąć główny cel, zastosowano analizę dokumentów (na poziomie globalnym, unijnym i krajowym), deklarujących różne podejścia i sposoby osiągnięcia neutralności klimatycznej, uzupełnioną ocenami aktualnego stanu i trendów w zakresie emisji gazów cieplarnianych oraz wyników gospodarczych Republiki Słowackiej. Przedstawiono również studium przypadku – ocenę możliwości realizacji zobowiązań klimatycznych na Słowacji.

Undoubtedly, the biggest global challenge today is the climate change, which is transforming the world and increasing the risks of instability in all its forms. The impact of global warming caused by greenhouse gases is changing our environment and is also linked to the increased frequency and intensity of extreme weather events. We are already witnessing an increased incidence of floods, heat waves, heavy rains, forest fires or the disappearance of glaciers. In addition, air pollution and a low level of protection of ecosystems already have visible negative effects and will cause serious environmental, economic and health problems in the future. In view of this, it is absolutely essential to make a concerted effort to mitigate climate change and adapt to its effects. Reaching climate neutrality in 2050 has become a crucial challenge for all countries, especially for the EU member states. In some developed countries, emissions are relatively decreasing, but these countries are also historically most responsible for greenhouse gas emissions. In turn, the sharp increase of emissions in developing countries is often linked to outsourcing and global patterns of production and consumption. The Slovak Republic has committed itself to achieving the goal of climate neutrality by 2050. Although greenhouse gas emissions in Slovakia decreased by 45.6% between 1990 and 2019 and decreased by 5.2% year-on-year (2018-2019), further efforts will be needed to meet the long-term goals. In this paper we focus on the assessment of approaches and activities of the Slovak Republic towards sustainability and climate neutrality. To achieve the main objective, an analysis of documents (at global, EU and national level) declaring different approaches and ways to achieve climate neutrality was used, complemented by assessments of the current status and trends in GHG emissions and economic performance of the Slovak Republic. There is also presented a case study – an assessment of the possibilities of climate commitments implementation in Slovakia.
