From a psychological perspective, a child hearing is a special form of interaction betweenan adult person and a child. The article is presenting the proposition of a child hearing method, which allows the judge to acquire important information for the proceedings outcome, on the minor and its needs, as well as not to involve the minor in its parent’s conflict, and does not burden him with the responsibility for the judge’s decisions. The elaborations were supplemented with a presentation empirical finding concerning the said legal institution.

Z psychologicznej perspektywy wysłuchanie jest szczególną formą interakcji między dorosłym a dzieckiem. Jest trudną rozmową zarówno dla sędziego, jak i małoletniego. Wysłuchanie wymaga od sędziego wiedzy psychologicznej niezbędnej do nawiązywania kontaktu i prowadzenia rozmowy z dzieckiem znajdującym się w trudnej, konfliktowej sytuacji rodzinnej. Artykuł przedstawia propozycje takiego przeprowadzenia wysłuchania, aby umożliwiło ono sędziemu pozyskanie ważnych dla rozstrzygnięcia postępowania informacji na temat małoletniego i jego potrzeb, a równocześnie nie wikłało dziecka w konflikt rodziców, nie obciążało go poczuciem odpowiedzialności za decyzje sędziego i nie stanowiło doświadczenia urazowego.

From a psychological perspective, a child hearing is a special form of interaction between an adult person and a child. It is a difficult conversation both for a judge and a minor. Performance of a hearing requires from a judge the psychological knowledge, necessary to establish contact and have conversation with a child which is in a hard situation of family conflict. The article is presenting the proposal of a child hearing method, which allows the judge to acquire important information for the proceedings outcome, on the minor and its needs, as well as not to involve the minor in its parent’s conflict, does not burden him with the responsibility for the judge’s decisions, and does not constitute an shock experience.
