According to the classical dogma, the act of stipulatio was performed through the exchange of sollemnia verba, which were, according to my working hypothesis, verbs introducing the duty to perform a future act, a concept lucidly displayed by Pomponian (Dig. 45.1.5.1), hence the ‘Pomponian tenet’. Documents preserved on papyrus, composed by ‘new-Romans’ after the Constitutio Antoniniana, exhibit a completely different concept: a stipulation-clause confirming a past, contractually significant activity. It is asked (but not conclusively answered) to what extend this alternative formulation has paved the way to the abandonment of the ‘Pomponian tenet’ by the emperor Leo in 472 ce (CJ 8.37.10). As we draw from Justinian’s interpretation of CJ 8.37.10 in Inst. 3.15.1, the sollemnia verba, the use of which became outdated after Leo, was not the language of the stipulation-clause as incorporated in the written documentation of the contract, but that of the act of stipulatio, which, as before, was meant in the keep verbal.

Autor, na początku swojej kariery uniwersyteckiej, zajmował się zagadnieniem krzepnięcia krwi i powstanie kaskady krzepnięcia krwi tłumaczył w kategoriach doboru naturalnego. Temat ten został poruszony przez Behe’ego, który stwierdził, że proces krzepnięcia krwi jest nieredukowalnie złożony, a w związku z tym nie mógł powstać na drodze stopniowych zmian ewolucyjnych. Niemniej, jak podkreśla autor, w ostatnich latach zgromadzono nadzwyczajną ilość świadectw ewolucji kaskady krzepnięcia krwi (badania nad duplikacją genów i tasowaniem egzonów), które w przytłaczający sposób przemawiają za słusznością wcześniejszych wniosków autora.

It is a review of Michael J. Behe’s book titled Darwin’s Black Box: The Biochemical Challenge to Evolution (The Free Press, New York 1996), containing the criticism of evolutionary theory. Author, at the beginning of his academic career, dealt with the issue of the blood clotting and he explained the origin of blood clotting cascade in terms of natural selection. This issue was discussed by Behe who stated that the blood clotting process is irreducibly complex and thus it could not have arisen through gradual evolutionary changes. Nevertheless, as author points out, in recent years an enormous amount of evidence of evolution of blood clotting (research over gene duplication and exon shuffling) has been accumulated which overwhelmingly bespeaks the soundness author’s earlier conclusions.

Wskazuje na nieporozumienia i odpowiada na różne zarzuty wobec swojej koncepcji, wysuwane pod adresem podanych przez niego przykładów nieredukowalnej złożoności, takich jak wić bakteryjna, kaskada krzepnięcia krwi czy pułapka na myszy, która jest mechanicznym odpowiednikiem biochemicznych układów nieredukowalnie złożonych. Behe rozmyśla ponadto nad przyszłością teorii inteligentnego projektu.

In the paper author presents briefly the idea of intelligent design, with the special emphasis on his own concept of irreducible complexity of biochemical systems. He points out the misunderstandings and addresses various objections to his concept, especially regarding his examples of irreducible complexity such as bacterial flagellum, blood clotting cascade or mousetrap which is a mechanical counterpart of irreducibly complex biochemical systems. Author is pondering also over the future of intelligent design theory.
