Ochrona zdrowia, o której mowa w art. 68 ust. 1 Konstytucji RP, nie dotyczy jedynie zapewnienia każdemu dostępu do świadczeń opieki zdrowotnej, lecz obejmuje także zwalczanie chorób epidemicznych i zapobieganie negatywnym dla zdrowia skutkom degradacji środowiska. Jednym z przejawów zapobiegawczej formy ochrony zdrowia są działania uprawnionych organów zmierzające do zapewnienia bezpieczeństwa i higieny żywności. Nie oznacza to jednak przyzwolenia na brak respektowania innych konstytucyjnie zagwarantowanych praw i wolności człowieka oraz zasad poprawnej legislacji. Czynność nałożenia kwarantanny realizowana w oparciu o akt prawny wydany z naruszeniem wymienionych reguł państwa prawa jest wówczas bezskuteczna.

Health protection, as referred to in article 1 section 68 of the Constitution of the Republic of Poland does not only concern ensuring access to healthcare services for everyone, but also combating epidemic diseases and preventing the negative health effects of environmental degradation. One of the manifestations of a preventive form of health protection are the activities of authorized bodies aimed at ensuring food safety and hygiene. However, this does not mean consent to the lack of respect for other constitutionally guaranteed human rights and freedoms and the principles of correct legislation. The act of imposing a quarantine based on a legal act issued in violation of the above-mentioned legal rules is then ineffective.

The purpose of the article is to introduce the results of carried out own research works based on specific procedure of diagnosing and positioning organizational situation represented by chosen Polish companies running their business during a particular period of time from 2004 to 2013. The research realizes its objectives taking into consideration the perspective and potential influences of Poland’s accession to European Union on these companies. The organizational effectiveness or potential ineffectiveness diagnoses are based on qualitative, long lasted depth analysis of adequately selected companies by means of author's own implement named “The Business Life Cycle Model of Organizational Effectiveness Influenced by Dysfunctions”. The measuring instrument (grading system) of this model is used to introduce the results of the research work. All such way collected outcomes of each individual diagnosis gives the picture of overall organizational performance of given company annually, during the whole period of the research. The outcomes are visualised making the most of the model.

Celem artykułu jest przedstawienie wyników badań, prowadzonych na podstawie autorskiej proceduty diagnozowania i pozycjonowania sytuacji organizacyjnej przedsiębiorstwa. Badaniami objęto wybrane polskie firmy funkcjonujące w latach 2004-2013. Jednym z celów prowadzonych badań było określenie konsekwencji członkostwa Polski w UE dla badanych firm. Diagnoza efektywności organizacyjnej lub potencjalnej nieefektywności opiera się na jokościowej, pogłębionej analizie wieloaspektowych obszarów funkcjonowania organizacji, które mają charakter autorskiego modelu, prezentującego dysfunkcje organizacyjne. Wyniki badań diagnozują wydajność organizacyjną danej firmy tak w ujęciu rocznym, jak i w całym badanym okresie.
