The law-making process in the reception of many entities participating in it or monitoring its course is not very transparent and unsatisfactory as far as the level of civic participation is concerned. The authorities should care about civilizing the law-making process. The more discussions and consultations are in the process of creating assumptions for legal acts, the greater the chance of avoiding mistakes and the chance that citizens will approve the existing legal system and abide by the law. In this publication, the author has attempted to make a subjective indication of these elements of the law-making process that require rapid change. At the same time, he pointed to solutions that could significantly contribute to improving its quality.

Proces stanowienia prawa w odbiorze wielu podmiotów w nim uczestniczących lub monitorujących jego przebieg jest mało przejrzysty oraz niesatysfakcjonujący, jeśli chodzi o poziom partycypacji obywatelskiej. a przecież władzom powinno zależeć na tym, aby uspołecznić proces stanowienia prawa. Im więcej dyskusji i konsultacji w trakcie tworzenia założeń do aktów prawnych, tym większa szansa uniknięcia pomyłek oraz szansa na to, że obywatele będą aprobowali istniejący system prawny i przestrzegali prawa. W opracowaniu tej autor podjął próbę subiektywnego wskazania tych elementów procesu stanowienia prawa, które wymagają szybkiej zmiany. Jednocześnie pokazał na rozwiązania, które mogłyby przyczynić się znacząco do poprawy jego jakości.

Im Artikel werden Veränderungen aufgezeigt, die in der gegenwärtigen Gesellschaft stattgefunden haben. Ich versuche neue Merkmale der Gesellschaft im positiven Recht zu finden, ihren Einfluss auf das Rechtssystem sowie gewisse Herausforderungen für gegenwärtiges Recht zu schildern. Sie haben zum Entstehen einer ganz neuen Art von Gesellschaft geführt, die häufig eine postmoderne Gesellschaft genannt wird. Hier konzentriere ich mich nur auf einen Teilbereich dieser Veränderungen, indem ich aus bestimmter Perspektive sowohl die Gesellschaft als auch das Recht im Kontext ihres neuen Funktionierens in Zeit betrachte. Heute können wir die „Beschleunigung der Zeit“ beinahe in jedem Ausdruck unserer Kultur bemerken. Wie ist folglich unser Recht, hat es ebenfalls eine Beschleunigung erfahren? Wie sieht die Zukunft des Rechts in diesem Zusammenhang aus? Das sind Fragen, die ich im Artikel zu beantworten versuche.

In this article, I would like to point out some of the changes that have taken place in modern society, attempt to find new features of society in the positive law, show their impact on the legal system, and outline some of the challenges for the modern law, which have led to the emergence of a completely new type of society - often called the post-modern society. The paper zooms in on a select segment of the changes from a particular perspective: it looks at both society and the law in the context of their new operation in time. Currently, we can notice the manifestation of the acceleration of the pace of life in almost every expression of our culture. What is, therefore, the current state of the law? Has it also sped up? What is the future of the law in this context? These are the questions I try to answer in this article.

W artykule wskazuję pewne zmiany, jakie zaszły we współczesnym społeczeństwie i próbuję odnaleźć nowe cechy społeczeństwa w prawie pozytywnym, wskazać ich wpływ na system prawa oraz nakreślić pewne wyzwania dla współczesnego prawa. Spowodowały one wyłonienie się zupełnie nowego typu społeczeństwa, które często nazywane jest społeczeństwem ponowoczesnym. Tutaj skupiam się tylko na pewnym wycinku tych zmian z określonej perspektywy, patrząc zarówno na społeczeństwo, jak i prawo w kontekście ich nowego funkcjonowania w czasie. Obecnie „przyspieszenie czasu” możemy dostrzec niemal w każdym wyrazie naszej kultury. Jakie wobec tego jest dziś nasze prawo, czy ono także przyspieszyło? Jaka jest przyszłość prawa w tym kontekście? Są to pytania, na które próbuję odpowiedzieć w tym artykule.
