The Market in Guarantee, Bank Guarantee, Insurance Guarantee and Insurance Contracts for Travel Agencies

The article discusses the situation in the Polish market in guarantee, bank guarantee and insurance contracts for travel agencies in 2005-2015, Poland’s legal framework, for which was created by way of the Act on Travel Services of August 1997, as amended, laying down the conditions for the provision by traders of travel services in the territory of Poland and abroad, where contracts with customers for the provision of such services are concluded in Poland. The Act imposes on travel agencies, both on tourism organisers and intermediaries, an obligation to provide security. In 2005-2015, the number of operators taking out compulsory security increased from 1,300 to more than 3,800. In 2014, the total value of guarantee amounts of the twenty largest travel agencies was PLN 740.9 million. The guarantee amounts varied widely between travel agencies. The highest guarantee amount was PLN 200.5 million. In general, the value of guarantee contracts and insurance contracts is sufficient. In 2012, for three travel agencies insurance guarantee funds proved insufficient to cover the cost of repatriation of tourists, therefore the marshals of voivodships covered the missing amounts from the local government (voivodship) budgets – a total of PLN 450,600.

Artykuł omawia sytuację na polskim rynku gwarancji, gwarancji bankowych, gwarancji ubezpieczeniowych i umów ubezpieczeniowych dla biur podróży w latach 2005-2015, polskie ramy prawne, dla którego zostały stworzone w drodze Ustawy o usługach turystycznych z sierpnia 1997 r. wraz z późniejszymi zmianami, tworząc warunki do świadczenia przez przedsiębiorców usług turystycznych na obszarze Polski i za granicą, gdy umowy z klientami o świadczenie takich usług zostały zawarte w Polsce. Ustawa nakłada na biura podróży, zarówno na organizatorów turystyki, jak i pośredników, obowiązek zapewniania bezpieczeństwa. W latach 2005-2015 liczba operatorów zawierających obowiązkowe ubezpieczenia zwiększyła się z 1 300 do ponad 3 800. W roku 2014 ogólna wartość kwot gwarancyjnych dwudziestu największych biur podróży wyniosła 740,9 mln złotych. Kwoty gwarancji znacznie się różniły między biurami podróży. Najwyższa kwota gwarancji wyniosła 200,5 mln PLN. Generalnie wartość umów gwarancyjnych i umów ubezpieczeniowych jest niedostateczna. W roku 2012 w przypadku trzech biur podróży fundusze gwarancji ubezpieczeniowych okazały się niewystarczające, by pokryć koszty powrotu do kraju turystów, wobec czego marszałkowie województw pokryli brakujące kwoty z budżetów samorządów lokalnych na kwotę ogółem w wysokości 450 600 PLN.
