Insurance guarantees as a tool to support risk management procedures in an enterprise

The subject of the article covers the issues related to the possibilities and conditions for the use of insurance guarantees in enterprise risk management processes. In the paper the essence of the guarantee process, its legal basis and the types of guarantees are discussed. The market for insurance guarantees in Poland is presented, with an attempt to refer to the market for guarantees offered by the banking sector. Based on the research conducted, the author presents the role and importance of insurance guarantees as a tool to support business processes in enterprises. The answers to the questions as to in what situations insurance guarantees are an effective tool to support these processes and what are the reasons behind their use are provided. The purpose of the publication is to analyze the role, significance and possibilities of using insurance guarantees as a tool to support risk management processes in the day-to-day operations of companies.

The article is an attempt to trace the rules for entering and returning security in a non-monetary form. The assumption is to take into account the changes that have taken place in the public procurement procedure, it is exactly about introducing full electronization into public procurement. The new rules related to electronization did not provide for any corrections to other statutory and legal regulations regarding the lodging and return of the bid bond in non-monetary form. In the light of applicable regulations, this is a serious problem that may lead to irregularities in the public procurement procedure.

Artykuł jest próbą prześledzenia zasad wnoszenia i zwracania zabezpieczenia wadialnego w formie niepieniężnej. Z założenia uwzględniać ma zmiany, jakie zaszły w procedurze realizacji zamówień publicznych, a dokładnie dotyczyć wprowadzenia pełnej elektronizacji do zamówień publicznych. Nowe zasady związane z elektronizacją nie zakładały wprowadzenia korekt do innych przepisów ustawowych i okołoustawowych, dotyczących wnoszenie oraz zwracania wadium w postaci niepieniężnej. W świetle obowiązujących przepisów jest to poważny problem, mogący prowadzić do nieprawidłowości procedury udzielania zamówienia publicznego.

Celem artykułu jest omówienie w sposób porównawczy i ocena zmian wprowadzonych ustawą o imprezach turystycznych i powiązanych usługach turystycznych w systemie zabezpieczeń finansowych na wypadek niewypłacalności przedsiębiorców turystycznych. Analiza ogranicza się do wybranych zagadnień, które zdaniem autorki mają istotny wpływ na zasady funkcjonowania tego systemu opierającego się głównie na gwarancjach ubezpieczeniowych. Artykuł rozpoczyna się omówieniem przyczyn popularności gwarancji ubezpieczeniowych. Następne rozdziały poświęcone są podmiotom zobowiązanym do posiadania zabezpieczenia, formom i zakresowi zabezpieczeń oraz obowiązkom, jakie ustawa nakłada na podmioty udzielające zabezpieczeń. Aby lepiej zobrazować skalę i znaczenie nowelizacji, regulacje obecnie obowiązujące zostaną zestawione w najważniejszych aspektach z przepisami, które wkrótce wejdą w życie.

This article aims at presenting a comparative analysis and evaluation of the changes introduced by the Act on package travel and linked travel arrangements in the system of insolvency protection provided by traders. The analysis is limited to selected issues which, in the author's opinion, have a crucial impact on the operation of the system, which relies mainly on insurance guarantees. The article begins with a discussion of the reasons for the popularity of insurance guarantees. The following sections are devoted to the entities obliged to have security, the forms and scope of protection as well as the obligations which the law imposes on entities providing security.
