Etyka brokera ubezpieczeniowego

A broker’s activity is one of the elements of insurance mediation. Brokers sell property and personal as well as life insurance policies. Apart from the range of duties, the quantitative condition of distribution channels, the paper also discusses problems of a broker’s professional ethics, which include broadly understood information reliability, activation honesty and assistance in damage liquidation. Signed in 1998, the Sobieszew Charter lays out the norms of ethical broker’s activity in three dimensions: their contacts with clients, mutual contacts and contacts with an insurance company. As well as that, the Charter created the Commission of Professional Ethics, the role of which is settling conflicts arising in the above-mentioned dimensions. The Charter also established seven main principles of professional ethics including the principle of a fair turnover or that of forming healthy relationships among brokers. The paper investigates the data concerning ethics in broker organizations, the major elements of which are a broker’s impartiality, conducting honest negotiations and the duty of submitting identical requests for proposal to insurance companies. The issue of insurance brokerage is not discussed.

The author observes that on the basis of the Act on the System of Social Security the differentiation between mandate contracts and contracts for specific work is of primarily practical nature. It determines the possibility of recognizing particular contracts as autonomous right to social security. The author indicates a set of criteria enabling to differentiate those two types of contracts–a type of performance, an obligation concerning the result and due diligence action, a range of risk concerning performing such contracts, a possibility to terminate them by one-sided legal acts. The author claims that qualification of civil law contracts in context of the system of social security must not differ from their qualification in civil law. Rules that social security is common and compulsory might justify application of directional directive ordering deciding on the doubts concerning law, only when civil law instruments of interpretation of expressions of will do not allow for qualifying a contract as a mandate contract or a contract for specific work, which might take place in extraordinary circumstances of mixed contracts.

Taking any risky action is connected with the way risk is perceived by the individuals. The influence has also decision-makers’ attitude toward risk. Appropriate perception determines suitable coping with risky situations. Inadequate judgment may cause unsuitable actions in relation to existent danger. The way individuals perceive risk and steer their activities is a key issue for entities bringing new products or services onto the market. This article presents brief survey of researches into factors determining risk perception and affecting decision-makers actions.

Na podjęcie przez podmiot działania obarczonego ryzykiem wpływ ma sposób postrzegania oraz stosunek do ryzyka decydenta. Podkreślić należy zatem, że właściwa percepcja warunkuje odpowiednie radzenie sobie z ryzykiem. Niewłaściwa ocena może prowadzić do działań nieodpowiednich w stosunku do istniejącego zagrożenia. Sposób w jaki podmioty postrzegają ryzyko i ukierunkowują swoje późniejsze działania ma kluczowe znaczenie dla podmiotów wprowadzających na rynek produkty i usługi. Artykuł prezentuje krótki przegląd badań nad czynnikami kształtującymi sposób postrzegania ryzyka i ich wpływem na podejmowane przez podmioty decyzje.

The present paper raises the issue of social insurance for the clergy in the Catholic Church. The first part provides the historical background, norms of the 1917 Code of Canon Law and indications of the Second Vatican Council. The next part discusses the current decrees of canon law and solutions adopted in Poland. At present, the Church has abandoned the beneficial system. Systemic church solutions are based on state legislation. In their absence, decisions are made by the Bishops’ Conference, as well as individual particular Churches. It refers both to social and health insurance.

Opracowanie dotyczy ubezpieczeń społecznych duchownych w Kościele katolickim. W pierwszej części zarysowano historię zagadnienia, następnie normy Kodeksu z 1917 r. oraz wskazania Soboru Watykańskiego II. W dalszej części omówiono aktualne dyspozycje prawa kanonicznego oraz rozwiązania w polskiej sytuacji. Aktualnie Kościół porzucił system beneficjalny. Systemowe kościelne rozwiązania mogą istnieć w oparciu o ustawodawstwo państwowe. W razie ich braku decyzje podejmuje Konferencja Episkopatu, jak i poszczególne Kościoły partykularne. Chodzi tak o ubezpieczenia socjalne, jak i zdrowotne.
