Budżety jednostek samorządu terytorialnego (JST) tworzą różne kategorie dochodów. Obok dochodów publicznoprawnych, w tym o charakterze podatkowym lub niepodatkowym, należy do nich zaliczyć także należności o charakterze cywilnoprawnym. Obowiązek ustalenia i poboru tego typy świadczeń zgodnie z przepisami normującymi finanse publiczne należy do organów zarządzających samorządu terytorialnego. Wszystkie one pobierane są zgodnie z zasadą, że podmiot zobowiązany powinien wywiązywać się ze swych zobowiązań pieniężnych przez ich zapłatę. Szczególne okoliczności towarzyszące realizacji ww. zobowiązań mogą jednak uzasadniać zastosowanie ulgi w ich płatności, a nawet zwolnienie z obowiązku ich zapłaty przez umorzenie. Z uwagi na fakt, że wszystkie takie przypadki powodują zmniejszenie wpływów budżetowych JST ustawa o finansach publicznych wyznacza generalne przesłanki ich stosowania – ważny interes podatnika lub interes publiczny. Opracowanie poświęcono analizie istoty prawnej drugiej z wymienionych przesłanek w przypadku umarzania należności o charakterze cywilnoprawnym.

Budgets of local self-governing bodies form various categories of incomes. Apart from public-legal incomes including those of tax- and non-tax character there are also dues of a civil-legal character. The obligation to establish and collect such fees lies upon the executive organs of the local self-government, according to regulations regards public finances. All of them are collected correspondingly to the rule , that the subject is obliged to acquit himself of any of his obligations by their payments. Particular circumstances, regarding the realization of the above mentioned obligations, can, however, justify the use of an abatement in payments and even an exemption of the obligation of payment by means of the remission of the obligation. Due to the fact that all such cases cause a decrease of local self-government bodies budgetary incomes, the law of public finances determines general prerequisites of their application which is either an important interest of a tax-payer or a public interest. The aim of the present work was to analyze the legal essence of the second of the mentioned prerequisites, in case of remission of payment of a civil-legal character.
L’article a pour objet l’analyse des régulations polonaises et françaises qui décrivent les prémisses d’ingérence du législateur dans le domaine du fonctionnement du marché bancaire. L’étendue de cette ingérence est définie par les valeurs, contenues dans les régulations, dont le respect sur le marché bancaire constitue l’intérêt public. L’intérêt public direct, dont les valeurs constitutives sont définies dans les textes de loi auxquels peuvent se référer tous les déposants, se distingue de l’intérêt public indirect dont les valeurs ne sont pas exprimées directement dans les régulations déterminant le but de l’activité des institutions de protection du marché bancaire. Il est identique à l’intérêt des autorités publiques et se manifeste par le fonctionnement efficace et la continuité de ces institutions de protection du marché bancaire.
W artykule omówiono pierwsze sto dni obowiązywania ustawy z dnia 15 grudnia 2016 r. o przeciwdziałaniu nieuczciwemu wykorzystywaniu przewagi kontraktowej w obrocie produktami rolnymi i spożywczymi. Autor przedstawił prowadzone przez Prezesa Urzędu Ochrony Konkurencji i Konsumentów postępowania związane z wykorzystywaniem przewagi kontraktowej, a także zastosowanie innych instrumentów znajdujących się w kompetencji organu. Następnie rozwinął zagadnienie współdziałania Prezesa UOKiK z innymi podmiotami w zakresie zarówno spraw rozpoznawanych przez organ, jak i możliwego procesu legislacyjnego. Kolejną kwestią analizowaną przez autora było propagowanie przepisów ustawy o przewadze kontraktowej i aktualne problemy związane z jej stosowaniem. Autor wskazał, że aktualnie priorytetowe jest właściwe określenie pojęcia interesu publicznego na potrzeby przedmiotowej ustawy oraz otwarte podejście do definicji praktyk naruszających tę ustawę z należytym uwzględnieniem analiz ekonomicznych. W wyniku tej analizy autor doszedł do wniosku, że pomimo bardzo krótkiego okresu obowiązywania ustawy o przewadze kontraktowej doszło do szeregu działań związanych z realizacją jej przepisów, ale wciąż większość pojawiających się w niej pojęć wymaga rozwinięcia poprzez działalność orzeczniczą organu i sądów, a także twórczą doktryny prawa.

The article discusses 100 days of the Act of 15th December 2016 on the unfair use of contractual advantage in the trade in agricultural and food products. The author describes the cases that the President of the Office of Competition and Consumer Protection (referred as the President of the UOKIK) is currently dealing with along with other instruments used as a tool in combating unfair practices. Next issue tackled is the cooperation of the President of the UOKiK with other relevant bodies in the context of handled cases and possible legislation process. Afterwards the author analyses the popularization of the Act among the public and the obstacles met with its application. The author stresses that at this moment crucial seems to be finding an accurate meaning of the term public interest used in the context of the Act and the flexible approach to the scope of practices described as unfair (keeping in mind the economic analyses). As a result, the author states that despite the very limited time of the Act in force there have been numerous actions taken. Still there are ambiguous terms of the Act that should be elaborated by the court’s ruling and the doctrine.
W artykule rozważono kształcenie religijne jako formę kształcenia ogólnego i jego miejsce w systemie oświaty publicznej z perspektywy pedagogiki ogólnej. Artykuł składa się z czterech części. Najpierw autor przedstawił trzy przykłady obrazujące podejście pedagogów akademickich do religii i kształcenia religijnego, które zostały zaczerpnięte z powojennych dziejów pedagogiki w Polsce. W drugiej części zaprezentował ideę powszechnej edukacji ogólnokształcącej i wyjaśnił interes publiczny związany z koncepcją kształcenia ogólnego. Na tym tle w kolejnej części zademonstrował proces historyczny, który doprowadził do zmarginalizowania problematyki kształcenia ogólnego we współczesnej polskiej pedagogice ogólnej. Na zakończenie sformułował wobec pedagogiki ogólnej trzy dezyderaty wynikające z uznania kształcenia religijnego jako formy kształcenia ogólnego.
Artykuł obejmuje rozważania poświęcone dobru gminy – objaśnienie treści kryjących się w tym pojęciu, powiązań zachodzących pomiędzy tym dobrem i innymi dobrami, czynników wpływających na jego kształt i urzeczywistnianie. Gminę można postrzegać jako swoistą małą ojczyznę, wypełniającą przestrzeń pomiędzy wspólnotą rodzinną i ogólnopaństwową. Mieszkańcy gminy tworzą z mocy prawa wspólnotę samorządową. Ma ona służyć dobru gminy, w tym zwłaszcza członkom jej społeczności. Dobro gminy jest naczelną wartością leżącą u podstaw funkcjonowania wspólnoty lokalnej, jej dobrobytu, ładu i wiążącego ją porządku. Stanowiąc wartość samą w sobie, dobro gminy ma umacniać inne wartości. Katalog tego, co składa się na złożone i niedookreślone prawnie dobro gminy jest rozległy i otwarty. Dobro to ma charakter względny. Można je ukazywać z wielu punktów widzenia i w odmiennych kontekstach. Jego relacje z innymi dobrami przyjmują różną postać. O tym, co uznane zostanie za takie dobro gminy, decyduje wiele czynników odmiennej natury. Tkwią one już w samej wspólnocie, ale też są niezależne od niej. Wyznaczenie i urzeczywistnienie dobra gminy musi opierać się na konsensusie osiągniętym w wyniku dyskusji społecznej. Działania dla dobra gminy są ściśle skorelowane z istotą i rolą podstawowej jednostki samorządu terytorialnego. Dobro wspólnoty gminnej, przy poszanowaniu w szczególności zasad humanizmu, legalności, równości, sprawiedliwości społecznej, demokratyzmu, solidaryzmu i pomocniczości, jest pierwszoplanową racją istnienia gminy i powierzania funkcji publicznych osobom działającym dla jej pożytku.

The article includes considerations devoted to the good of the municipality: the contents that lie behind this concept, the connections between this good and other ones and the factors influencing its conformation. The municipality may be perceived as a small version of the homeland that fills the space between the family and the state-level community. Its residents create a self-government community by virtue of law. It serves the good of the commune, especially – its members. The good of the municipality is a primary value, underlying the existence of the local community, its prosperity, law and order. As a value itself, the good of a municipality should entrench other merits. The list of factors, building that complex and underdetermined term, is non-exhaustive and extensive. This good has also a relative nature. It may be featured from different points of view and in distinct contexts. Its relations to other goods may take different forms. There are various factors, deciding what constitutes such good. They are rooted in the very center of the community, as well as outside of it as the independent ones. Delineating and realization of the good of the municipality has to be based on the consensus reached through the discussion and the social compromise. The actions undertaken for the benefit of the municipality are closely correlated with the nature and the role of the primary territorial self-government unit. The good of the municipality – having regard to the respect for, in particular, the principles of humanism, legitimacy, equality, social justice, democratism, solidarity and subsidiarity – is a primary rationale for its existence and for entrusting public functions to the individuals acting for its benefit.
The paper presents the problem of public interest in the context of water law act established in 2017. In the article, general problems of water-law relations, the institution of public interest itself and European water law are described. The analysis is about conceptual grid of the act and its cohesion, and compatibility with Rules of Proper Legislation. The author assumes that water law regulations have a specific subject, thus, they must be focused on the guarantee of public interest.

Opracowanie przedstawia problematykę interesu publicznego na gruncie ustawy – Prawo wodne, uchwalonej w 2017 r. W pracy zostały omówione ogólne zagadnienia dotyczące konieczności odrębnej regulacji stosunków wodnoprawnych, interesu publicznego jako takiego i europejskich podstaw prawa wodnego. Analiza dotyczy siatki pojęciowej stworzonej przez prawodawcę pod kątem jej spójności i zgodności z zasadami techniki prawodawczej. Autor opiera się na założeniu, że stosunki wodnoprawne – z uwagi na ich przedmiot – w sposób szczególny powinny podchodzić do problemu odpowiedniego zagwarantowania interesu publicznego.
The purpose of the article was to determine the role of public interest in the spatial management system. For this purpose, the perspective of two disciplines was used: law and public policy. It was pointed out that public interest in the spatial management system must be inextricably linked to spatial order. This perspective is currently not sufficiently taken into account when interpreting the provisions related to spatial planning. The article indicates provisions that require special emphasis in the context of the implementation of spatial policy associated with care for the protection of the public interest.

Wskazano, że interes publiczny w systemie gospodarki przestrzennej musi być nieodłącznie powiązany z ładem przestrzennym. Ta perspektywa nie jest obecnie wystarczająco uwzględniana przy wykładni przepisów związanych z planowaniem i zagospodarowaniem przestrzennym. W artykule wskazano przepisy wymagające szczególnego podkreślenia w kontekście realizacji polityki przestrzennej powiązanej z dbałością o ochronę interesu publicznego.
Civil procedure, and civil proceedings in particular serve, per se, the realisation of private (individual) interests of the subjects in private law. This, however, does not mean that an interest, termed public or social, is non-existent in a process initiated, and subsequently in progress, before a civil court. Depending on the type of legal relation on the grounds of which a dispute, being a subject of cognizance and judicial decision, has arisen, this interest is introduced into the process with varying degrees of intensity. In the broadest context, is may be found in relationships of particular social importance, such as marital relations, family relations, or labour relations. It is in those cases where, due to the social importance of the disputed relationships, such interest is subject to the same protection as the interests of the parties to the proceeding. This interest may also constitute an exclusive subject of protection, owing to the prosecution instigated by a prosecutor or other entities entitled to prosecute, pursuant to the provisions of the code of civil procedure and other relevant acts. The prosecution which is so instigated, is not against any particular person but made with a view of protecting a social interest. In situations of a dispute between two parties, the protection of a public interest results from the protection that the court has granted to the parties in question. In a state of law, ensuring the compatibility of actual facts with the existing laws serves the public at large, realising, at the same time, the public interest. However, public interest in a legal process is not only a subject of protection. It is also about the maintenance of the composition of the jurors as well as the introduction of an extended competence and jurisdiction of the judicial decisions in those matters in which public interest, owing to the social significance of the legal relationships that are subject to the proceedings, manifests itself most clearly.

Postępowanie cywilne, zwłaszcza zaś postępowanie procesowe z istoty służy realizacji indywidualnych (prywatnych) interesów podmiotów prawa prywatnego. Nie oznacza to jednak, że interes określany jako publiczny czy społeczny nie jest obecny w procesie wszczętym i toczącym się przed sądem cywilnym. W zależności od rodzaju stosunku prawnego, na podstawie którego wynikł spór będący przedmiotem rozpoznania i rozstrzygnięcia sądu interes ten jest wprowadzony do procesu z różnym natężeniem. W najszerszym zakresie występuje w sprawach wynikających ze stosunków o szczególnym znaczeniu społecznym, jak stosunki małżeńsko - rodzinne czy stosunki pracy. W tych przypadkach właśnie z uwagi na społeczną doniosłość spornych stosunków prawnych podlega on ochronie na równi z interesem indywidualnym stron postępowania. Wtedy też może stanowić wyłączny przedmiot ochrony w procesie, a środkiem dochodzenia tej ochrony jest powództwo prokuratora i innych podmiotów, którym przepisy kodeksu postępowania cywilnego i innych ustaw przyznają uprawnienia, jakimi dysponuje prokurator w postępowaniu cywilnym, wytaczane nie na rzecz określonych osób, lecz właśnie dla ochrony interesu społecznego. W sytuacjach zaś, w których przedmiotem procesu jest spór pomiędzy określonymi podmiotami, ochrona interesu publicznego jest skutkiem ochrony udzielonej przez sąd prawom podmiotowym stron. Zapewnienie zgodności sytuacji faktycznych z prawem służy bowiem w państwie prawa w istocie całemu społeczeństwu, a zatem realizuje również interes publiczny. Ale interes publiczny występuje w procesie nie tylko jako przedmiot ochrony. Szczególnym przejawem jego występowania w procesie jest także utrzymanie składu ławniczego sądu oraz wprowadzenie rozszerzonej prawomocności wyroków w tych sprawach, gdzie interes ujawnia się w sposób najbardziej wyraźny z uwagi na społeczne znaczenie będących przedmiotem postępowania stosunków prawnych.
Przedmiotem rozważań w niniejszym artykule jest konstrukcja interesu publicznego i dobra publicznego w prawie administracyjnym przedstawiona na tle konstytucyjnej zasady dobra wspólnego. W artykule postawiono tezę badawczą: konstytucyjna zasada dobra wspólnego jest aksjologiczną podstawą kształtowania przez administrację interesu publicznego i przy-znawania społeczeństwu określonych dóbr publicznych. Pojęcia ujęte w tytule opracowania są semantycznie bliskie, ale nie jest zasadne stawianie znaku równości pomiędzy nimi. Dobro wspólne jest nadbudową ideową wobec interesu publicznego, o czym świadczy obecność kon-stytucyjnej zasady dobra wspólnego w definicjach administracji publicznej. W konsekwencji należy przyjąć, że dobro wspólne jest swoistą klauzulą generalną wyznaczającą prawidłowe rozumienie interesu publicznego, jak i zakres dóbr publicznych w prawie administracyjnym.

The subject matter of this article is the construction of the public interest and the public good in the administrative law presented against the background of the constitutional principle of the common good. The article puts forward a research thesis: the constitutional principle of the common good is the axiological basis for shaping by the administration of the public interest and the granting of certain public goods to the public. Concepts included in the title of the study are semantically close, but it is not reasonable to put an equality sign between them. Common good is an ideological superstructure in the public interest, as evidenced by the presence of a constitutional principle of common good in the definitions of public administration. As a consequence, the common good must be assumed to be a general clause defining a correct understanding of the public interest as well as the scope of public goods in administrative law.
The aim of the article is to analyse a monographic study entitled Selected Systems of Legaland Institutional Protection of Rights and of the Interests of the State, written by Bronisław Włodzimierz Sitek and published by the Difin publishing house in 2020. Apart from the introduction and conclusion, the work consists of eight chapters, out of which the first one is devoted to the solutions implemented in the times of the Imperium Romanum. Subsequent chapters provide analysis on the selected systems of protecting the state, with regard to Poland, Austria, Italy, Spain, Switzerland, Germany, and the USA. Simultaneously, the historical development of said systems are also discussed. The analysed monographic study has been deemed useful for people interested in issues related to the maxim of Roman law Salus rei publicae suprema lex esto (The safety of the state is the supreme law).

Artykuł ma celu analizę monografii Wybrane systemy prawnej i instytucjonalnej ochrony praw i interesów państwa autorstwa Bronisława Włodzimierza Sitka, wydaną w 2020 r. przez Wydawnictwo Difin. Praca ta, obok wstępu i wniosków końcowych, składa się z ośmiu rozdziałów, z których pierwszy poświęcony jest rozwiązaniom wprowadzonym w czasach Imperium Romanum. Kolejne rozdziały stanowią omówienie wybranych systemów ochrony państwa, tj. polskiego, austriackiego, włoskiego, hiszpańskiego, szwajcarskiego, niemieckiego oraz USA, z równoczesnym omówieniem ich historycznego rozwoju. Analizowana monografia oceniona została jako przydatna dla osób zainteresowanych zagadnieniami łączącymi się z rzymską paremią Salus rei publicae suprema lex esto.
Celem artykułu jest analiza, w jakim stopniu i czyim interesem powinien się kierować organ inspekcji ochrony środowiska, podejmując decyzję o wstrzymaniu użytkowania instalacji dużego obiektu energetycznego spalania. Badaniu poddano jedynie postępowanie w oparciu o art. 367 ustawy z dnia 27 kwietnia 2001 r. – Prawo ochrony środowiska z tego względu, że fakultatywny charakter tego postępowania w połączeniu z możliwością wyznaczenia dodatkowego terminu na usunięcie naruszeń jedynie na wniosek strony budzi wątpliwości autorów niniejszego artykułu w zakresie ważenia interesów publicznego i prywatnego. W analizowanym postępowaniu interes publiczny przejawiający się w obowiązku ochrony środowiska ujęty w art. 5 i 74 Konstytucji RP jest przeciwstawiany interesowi prywatnemu, w głównej mierze wyrażonemu w art. 20–22 oraz 31 Konstytucji RP, tj. zasadom własności prywatnej i swobody działalności gospodarczej. Organ inspekcji ochrony środowiska każdorazowo musi dokonać wnikliwej analizy, przykładając stan faktyczny danej sprawy do wytycznych zawartych w powyżej wskazanych artykułach Konstytucji RP, kierujących rozstrzygnięcie w przeciwnych kierunkach. Autorzy niniejszego artykułu wskazują, że w szczególności w przypadku dużych obiektów energetycznego spalania, interes użytkowników tych instalacji doznaje nieuzasadnionego uszczerbku przejawiającego się specyfiką procedury postępowania o wstrzymanie użytkowania instalacji w oparciu o art. 367 prawa ochrony środowiska.
Łowiectwo w Polsce przeżywa dziś swoisty renesans i niewątpliwie stanowi sprawę publiczną. Cel łowiectwa to cel publiczny, jest nim bowiem: ochrona, zachowanie różnorodności i gospodarowanie populacjami zwierząt łownych; ochrona i kształtowanie środowiska przyrodniczego na rzecz poprawy warunków bytowania zwierzyny; uzyskiwanie możliwie wysokiej kondycji osobniczej i jakości trofeów oraz właściwej liczebności populacji poszczególnych gatunków zwierzyny przy zachowaniu równowagi środowiska przyrodniczego; spełnianie potrzeb społecznych w zakresie uprawiania myślistwa, kultywowania tradycji oraz krzewienia etyki i kultury łowieckiej. Niniejszy artykuł prezentuje rozważania dotyczące dostępu do informacji publicznej w kontekście prawa łowieckiego. Wskazano w nim organy administracji publicznej zobligowane do jej udzielenia, a także podmioty, które mogą się o nią udzielać. Ponadto określono kompetencje w/w organów i wynikające z nich zadania publiczne w obsza-rze szeroko pojmowanego łowiectwa.

Hunting in Poland is experiencing a kind of renaissance today and is undoubtedly a public matter. The purpose of hunting is a public goal, because it is: protection, preservation of diver-sity and management of populations of game animals; protection and shaping the natural environment for the improvement of living conditions of animals; obtaining the highest possible personal condition and quality of trophies and the appropriate number of populations of partic-ular species of animals while maintaining the balance of the natural environment; meeting social needs in the field of hunting, cultivating tradition and propagating ethics and hunting culture.This article presents considerations regarding access to public information in the context of hunting law. It indicates the public administration bodies obliged to provide it, as well as entities that can apply for it. In addition, the competences of the above mentioned bodies and the resulting public tasks in the area of broadly understood hunting were defined.
Social interest and rightful interest of an individual on the basis of the Article 7 in fine of the Polish Code of Administrative Proceedings The following article expands on one of the crucial and basic general principles that lead the administrative proceedings, being at the same time a kind of a guideline in interpretation for the whole system of administrative laws. The aforementioned principle, namely “the principle of accommodating public and private legitimate interests” is included in the article 7 in fine of the Code of the Administrative Proceedings. The rule is of great importance for those proceedings that entail a type of discretion which organs of administration legally possess. That is the time when the two interests must be weighed up and the primacy to one of them must be given. The author also tries to distinguish between the interchangeable terms of “public interest” and “social interest” pointing to their semantic use. The issue of collision of the two interests has been also described in the text. Finally, the legal guarantees of adopting that principle have been touched upon.
Exclusion of application general negative premises of granting a concession from the entrepreneurs law in cases of granting a concession for operating casino games does not cause a limitation of protection of the public interest compared to standard which is appointed by general regulation. Premises of granting the concession for operating casino games from the law on gambling do not have a narrower scope than general negative premises of granting a concession from the entrepreneurs law. That conclusion is based on the comparison between the both regulations. Moreover, on the grounds on the previous freedom of economic activity act, a few general negative premises of granting a concession had a wider scope than premises of granting the concession for operating casino games. Simultaneously, exclusion of application general rules in cases of granting the concession for operating casino games also then was in force. Elimination a few general negative premises in the entrepreneurs law, which were applying on base of the repealed freedom of economic activity act, caused that level of the protection of public interest appointed by scope of general negative premises of granting a concession is not lower than level of the protection of public interest in cases of granting a concession for operating casino games. That solution eliminated a certain systemic inconsistency, which had existed before the entrepreneurs law came into force.
The authors of the paper focused upon the general clause of social interest in the general administrative proceedings, as well as the proceedings before administrative courts and the administrative executive proceedings. Thus we got a comprehensive – although limited, considering the framework of the study – analysis of the function of this clause in the three main sets of proceedings constituting the system of administrative procedure. The paper discusses a complicated concept of social interest and its relationship to a concept of public interest. It must be emphasized that both of the terms mentioned above are used, among other things, in the regulations of the Code of Administrative Proceedings. The authors also analyze the questions regarding possibilities of a conflict between a social interest and an individual interest.

Autorzy opracowania skupili swe rozważania na klauzuli generalnej interesu społecznego w ogólnym postępowaniu administracyjnym, postępowaniu sądowoadministracyjnym oraz postępowaniu egzekucyjnym w administracji. W ten sposób otrzymali kompleksową, aczkolwiek ograniczoną ze względu na ramy opracowania, analizę funkcji tej klauzuli w podstawowych postępowaniach systemu procedury administracyjnej. Artykuł wyjaśnia skomplikowane pojęcie interesu społecznego oraz jego stosunek do pojęcia interesu publicznego. Podkreślenia wymaga, że oba pojęcia występują choćby w przepisach kodeksu postępowania administracyjnego. Przedmiotem rozważań autorzy uczynili również kwestie dotyczące możliwości zaistnienia kolizji między interesem społecznym a interesem indywidualnym.
General clauses cause “flexibility of legal act”, and consequently “application of legal provisions”. Without general clauses it is impossible to extend legal regulations to all events, giving effects, occuring in abandonment of tax collection, exemption from obligation of tax collection or tax deductions, advantages like deferment of the payment of that tax or remitting the whole or a part of tax arrears. Phrases like taxpayer’s important interest and public interest, beeing used in the regulations of the Tax Ordinance Act, have not regular range of content. During dealing with complaints, the tax authorities are obliged to fill these phrases with an appropariete content, in its sole discretion. This is done within the framework of so-called administrative discretion. The tax authorities have also a margin of discretion, both with regard to the interpretation of expressions and phrases being the content of general clauses and in evaluation of factual situation of the case. Simultaneusly, general clauses contained in Tax Ordinance Act, enable to choose legal consequences and resolve conflict of goods specified within. Użyte w przepisach Ordynacji podatkowej takie zwroty, jak „ważny interes podatnika” i „interes publiczny” nie mają stałego zakresu treści. Organy podatkowe podczas rozpatrywania poszczególnych spraw obowiązane są zatem wypełnić te pojęcia właściwą zawartością według własnego rozeznania. Z tego powodu doniosłą rolę w stosowaniu klauzul generalnych mają kryteria oceny ważnego interesu podatnika oraz interesu publicznego, które muszą mieć charakter zobiektywizowany. Klauzule generalne ujęte w Ordynacji podatkowej pozwalają na dokonywanie wyboru określonych w niej konsekwencji prawnych i rozstrzygania konfliktu dóbr. Jest to dokonywane w ramach tzw. uznania administracyjnego. Dyrektywy wyboru tkwią w założeniach ogólnych oficjalnie przyjętego systemu wartości. Ustaleniu właściwego znaczenia norm zawierających tego rodzaju środki techniki prawodawczej musi towarzyszyć przekonanie, że tworzenie prawa nie odbywa się w oderwaniu od wpływów aksjologicznych. Uwzględniają one konstytucyjne wolności gospodarcze, socjalne, kulturalne i inne. Klauzule generalne wykorzystywane w prawie podatkowym, przy zachowaniu stabilności przepisów prawnych, powodują jednocześnie uelastycznienie tekstu aktu prawnego, a co za tym idzie – stosowanie przepisów prawnych. Użycie przez prawodawcę klauzul generalnych nie jest równoznaczne z przyznaniem interpretatorowi absolutnej i pozostającej poza wszelką kontrolą dowolności wykładni przepisów prawnych. Musi on posługiwać się zobiektywizowanymi kryteriami ocen pozaprawnych zdarzeń i zjawisk prawnie istotnych znajdujących uzasadnienie aksjologiczne.
The article regards the problem of public interest as the State Owned Companies’ (SOCs’) objective. SOCs operate according to the same rules as private companies and generally their aim is to achieve gains. However, SOCs as the companies that main shareholder is the state are supposed to operate in public interest. The aim of the article is to decide if Polish SOCs’ objective is to realize public interest or if the public interest is realized by achieving other objectives. All findings are based on classic functional research and consists of regulation analysis and large sample analysis conducted among SOCs’ management and supervisory boards’ members and officials of Polish Ministry of Treasury that supervise SOCs.
The text presents the issue of the Supreme Court’s functions from the perspective of civil law countries. The author argues that the division into cassation, revision and appeal is not an adequate point of reference enabling to define those functions. The author asserts that the most important criterion is whether the Supreme Court acts overwhelmingly in public or private interest. The assessment of that criterion should be made on the basis of the methods of selection of cases by the Supreme Court. What is essential is whether the selection is based on public aims or whether it simply aims at solving a given case accurately. It may be argued that as a result of reforms introduced in the last few years, the majorityof civil law countries have focusedon the implementation of the public rather than private functions. The author concludes that the public function of supreme courts is of a completely different significance than in the times of socialism. The public interest is combined with private interest as it refers to the situation of parties – not parties to the specific proceedings, but all parties which are going to engage in litigation in the future.
Purpose: The purpose of this study is to identify ethical threats faced by Polish statutory auditors in their professional work and the methods of counteracting these threats, i.e., safeguards ensuring compliance with ethical principles of statutory auditors. Methodology/Approach: Survey research was conducted among 45 statutory auditors from the Regional Branch of the Polish Chamber of Statutory Auditors in Gdansk with the aim of identifying the types of ethical threats and safeguards in the practice of Polish stat-utory auditors. Findings: Based on the research, it was found that among all types of ethical threats indi-cated in the survey, statutory auditors indicated the risk of familiarity as the type with which they most often deal. The risk of intimidation was ranked second on the list of threats. When it comes to safeguards used by the audited auditors, they primarily indicat-ed two types, i.e., principles and procedures that enable the identification of interest and business relationship between the firm, the personnel and the client, as well as rotating senior assurance team personnel. Originality/Value: Our study fills the gap in the Polish literature in the field of research on the types of ethical threats in the work of statutory auditors and the safeguards they use. We have audited the occurrence of individual types of ethical threats and assessed which of them appear most often in the practice of statutory auditors, threatening the ethical attitudes of statutory auditors. Our study also enriches the literature by presenting the types of security used by Polish statutory auditors to comply with ethical principles.

122 Cyryl Kotyla, Maciej Hyży Streszczenie Cel: Celem niniejszego opracowania jest identyfikacja zagrożeń etycznych na jakie naraże-ni są polscy biegli rewidenci w pracy zawodowej oraz sposobów przeciwdziałania tym za-grożeniom, czyli zabezpieczeń zapewniających przestrzeganie zasad etycznych biegłych rewidentów. Metodyka/podejście: W celu identyfikacji rodzajów zagrożeń etycznych i zabezpieczeń w praktyce polskich biegłych rewidentów przeprowadzono badanie ankietowe wśród 45 biegłych rewidentów Oddziału Okręgowego Polskiej Izby Biegłych Rewidentów w Gdańsku. Wyniki: Na podstawie przeprowadzonego badania stwierdzono, że spośród wszystkich wskazanych w ankiecie rodzajów zagrożeń etycznych biegli rewidenci, jako typ, z którym mają do czynienia najczęściej, wskazywali na ryzyko znajomości. Ryzyko zastraszenia zajęło drugie miejsce na liście zagrożeń. Jeśli chodzi o zabezpieczenia stosowane przez audytorów, wskazali oni przede wszystkim dwa ich rodzaje, tj. zasady i procedury umożli-wiające identyfikację interesów i relacji biznesowych pomiędzy firmą, personelem i klien-tem oraz rotacyjną kadrę wyższego szczebla zespołu wykonującego prace weryfikacyjne. Oryginalność/wartość: Nasze opracowanie wypełnia lukę w polskiej literaturze z zakre-su badań nad rodzajami zagrożeń etycznych w pracy biegłych rewidentów i stosowanych przez nich zabezpieczeniach. Zbadaliśmy występowanie poszczególnych rodzajów zagrożeń etycznych i oceniliśmy, które z nich najczęściej pojawiają się w praktyce biegłych rewiden-tów, zagrażając postawom etycznym biegłych rewidentów. Nasze opracowanie wzbogaca również literaturę o prezentację rodzajów zabezpieczeń stosowanych przez polskich bie-głych rewidentów w celu przestrzegania zasad etycznych.
Przedmiotem niniejszego opracowania jest przedstawienie organizacji i funkcjonowania instytucji Rzecznika Interesu Publicznego w Niemczech, który występuje przed Federalnym Sądem Administracyjnym. Urząd ten, posadowiony w Lipsku, stanowi namiastkę Prokuratorii w Polsce. Zasadnicza różnica między tymi instytucjami leży w tym, że Rzecznik zajmuje się ochroną interesu publicznego, Prokuratoria zaś ochroną interesu Skarbu Państwa. Celem opracowania jest ukazanie dość oryginalnego pojmowania w Niemczech pojęcia interesu publicznego i systemu jego ochrony Takie rozwiązanie właściwie nie jest spotykane. Praca została napisana za pomocą metodyki dogmatycznej i analizy rozwiązań instytucjonalnych. Efektem pracy jest ukazanie, że niewielki urząd Rzecznika w Niemczech, prowadzi dość skuteczną ochronę interesu publicznego w tym kraju. Rozwiązanie to może być polecane do naśladowania w innych państwach europejskich.

The purpose of this study is to present the organization and functioning of the Institution of Representative of the Public Interest in Germany, which appear before the Federal Administrative Court. This office, established in Leipzig, is a substitute for the General Counsel to the Republic of Poland. The main difference between these institutions lies in the fact that the Representative deals with the protection of the public interest and the General Counsel protects the interests of the State Treasury. The aim of the study is to present a fairly original concept of public interest and its protection in Germany. Such solutions are very rarely met. The work was written using dogmatic methodology and the analysis of institutional solutions. The result of this work is to show that the relatively small office of the Representative in Germany gives a fairly effective protection of the public interest in Germany. This solution can be recommended to be imitated in other European countries.
