W wyroku z 28 lutego 2013 r., sygn. II AKa 12/13, Sąd Apelacyjny w Szczecinie stwierdził, że jeżeli przestępstwa, które dotychczas tworzyły – w wyroku jednostko-wym bądź w wyroku łącznym – zbieg przestępstw, a rozeszły się w nowym wyroku do nowo utworzonych zbiegów przestępstw, to muszą utracić moc wszystkie dotychcza-sowe orzeczenia o łączeniu kar, dla których podstawę stanowił dotychczasowy zbieg przestępstw, a nie jedynie te rozstrzygnięcia łączne, które zostały ujęte w nowym wy-roku. Analiza przywołanego orzeczenia oraz przepisów bezpośrednio dotyczących po-ruszonego w nim zagadnienia, tj. w szczególności art. 85 k.k. oraz art. 569 § 1 k.p.k. i art. 575 § 1 k.p.k., doprowadziła autora publikacji do zgoła odmiennych wniosków. Stąd niniejszą glosę do wyżej wymienionego wyroku SA w Szczecinie należy traktować jako glosę krytyczną.

In the sentence of February 28th 2013 in the case II AKa 12/13 the Appeals Judge decided that if crimes creating a concurrence of crimes in a single sentence or former cumulative sentence, disbanded into different other concurrences, then all the previous cumulative punishment adjudgements lose their power, and not only the combined set-tlements that were formulated in the new sentence. The analysis of said settlement and regulations directly concerning the raised concern i.e in particular art. 89 k.k., 569 and art. 575 k.p.k. lead the author of the gloss to completely different conclusions. Thus the presented gloss concerning aforementioned sentence of the Appeals Judge should be considered critical.
This paper touches upon an important issue in practical application of law, i.e. aggregate sentence under the laws changed during the great reform of criminal law and criminal procedure. An often highlighted aspect of the said issue is the normative nature of the construct of the aggregate sentence, whose correct theoretical understanding, in the author’s opinion, helps in solving some of the problems with interpretation encountered by scholars. A particularly important issue raised within that area is the negative premise contemplated in Article 85 § 4 of the Polish Criminal Code, and especially the said provision of law, making the wording of the norm requiring the imposition of an aggregate sentence more adequate. Clear highlighting of statutory decoding of the legal definition of the term “conviction” used in Article 114a CC and the importance of the implication of this drafting technique, allows the author to make a clear statement as to the possibility of combining the sentences passed in countries that are not the EU members.
W artykule dokonano analizy modelu wymiaru rzeczonej kary pod kątem jego racjonalnego kształtowania w ramach ustawowej regulacji. Celem opracowania uczyniono odpowiedź na pytanie, czy przyjęty przez polskiego ustawodawcę mieszany system wymiaru kary łącznej w obecnym jego kształcie można uznać za racjonalny. W pierwszej kolejności zaprezentowano wypracowane w teorii prawa podstawowe założenia modelu racjonalnego tworzenia prawa. W dalszej części przedstawiono podstawowe założenia kary łącznej w polskim prawie karnym, system wymiaru kary łącznej oraz jego konsekwencje na płaszczyźnie ustawowej regulacji dotyczącej wymiaru kary łącznej. Rozważając, czy system wymiaru kary łącznej jest racjonalny, skonfrontowano postulaty dotyczące racjonalnego tworzenia prawa z kształtowaniem granic wymiaru kary łącznej, w szczególności z możliwością orzekania w wyroku łącznym kary łącznej surowszej niż suma kar podlegających łączeniu.

The aim of the article is to answer the question whether the mixed system of aggregate penalty adopted by the Polish legislator in its current form can be considered rational. Firstly, the basic assumptions of the model of rational law creation developed in the theory of law were presented. Secondly, the basic assumptions of the aggregate penalty in Polish criminal law were discussed, as well as the aggregate penalty system and its consequences at the level of statutory regulation regarding the aggregate penalty. When considering whether the system of imposing an aggregate penalty is rational, the expectations regarding rational lawmaking were confronted with the statutory limits of the imposition of an aggregate penalty, in particular with the possibility of inflicting in an aggregate sentence an aggregate penalty more severe than the sum of the penalties subject to merger.
This article is dedicated to the amended regulations of Chapter IX of the Penal Code concerning the concurrence of offences and aggregation of penalties and penal measures. The problem of the new definition of actual concurrence is presented and discussed while contrasting it with the concept of apparent concurrence in this respect. Within the framework of changes to the aggregation of penalties, wider attention is given to the new model of aggregation of penalties which takes into consideration the previously imposed cases of aggregation of penalties, exceptions to it, and also directives on sentencing. It was noted „course of offences” changes based on introducing the premise of „in a similar manner” in place of „similar manner of committing” an offence that constitute the course and also the stipulations added to art. 91 § 1 of the Penal Code that „the court shall impose one penalty on the basis of the provision whose attributes each of these offences”
The objective of the study is to present how the institution of aggregate sentencing evolved in Polish criminal codifications – starting from the first 1928 Code of Criminal Procedure through the new codification of the 1969 Criminal Procedure Act and ending up with the codification of the 1997 Code of Criminal Procedure and its subsequent amendments. The aim of the analysis is not to reproduce the content of the legal standards applicable in the above-mentioned codifications in the context of the provisions regulating the procedure for passing an aggregate sentence but to show how the views of the doctrine and judicature evolved with respect to the interpretation problems that arose at the theoretical and practical level. The presentation of the changes that took place over the decades will enable a better understanding of the genesis of the provisions regarding aggregate sentencing in the context of its almost 100-year existence in the Polish penal codifications.

Założeniem niniejszego opracowania jest ukazanie jak kształtowała się problematyka wyroku łącznego w polskich kodyfikacjach karnych, począwszy od pierwszego Kodeksu postępowania karnego z 1928 r., poprzez nową kodyfikację ustawy karnoprocesowej z 1969 r. na kodyfikacji Kodeksu postępowania karnego z 1997 r. oraz kolejnych jej nowelizacjach skończywszy. Celem prowadzonej analizy nie jest odtworzenie treści norm prawnych obowiązujących we wskazanych kodyfikacjach w kontekście przepisów regulujących postępowanie w przedmiocie wydania wyroku łącznego, ale ukazanie ewolucji poglądów doktryny i judykatury na pojawiające się problemy interpretacyjne o wymiarze nie tylko teoretycznym, ale przede wszystkim praktycznym. Prezentacja zmian jakie dokonywały się na przestrzeni dziesięcioleci pozwoli lepiej zrozumieć genezę przepisów obecnie istniejącej instytucji wyroku łącznego w kontekście jej prawie stuletniego istnienia w polskich kodyfikacjach karnych.
Zbieg przestępstw w prawie karnym kanonicznym oraz polskim prawie karnym traktowany jest w sposób równoważny. Wymiar kary przy zbiegu przestępstw w prawie karnym kanonicznym opiera się na zasadzie kumulacji kar za przestępstwa, od której możliwe jest fakultatywne złagodzenie sumy kar ze względu na ich wielkość. Możliwość zmniejszania skumulowanych kar jest wyłącznie w zakresie ferendae sententiae. Polskie prawo karne wymiar kary przy zbiegu przestępstw określa mianem kary łącznej. Jest ona syntezą wszystkich kar za przestępstwa pozostające w zbiegu i wymierzeniem jednolitej kary łącznej w ramach przewidzianych przez ustawodawcę.

Coincidence of crime in the canonical law and in the Polish penal law is treated in the equivalent manner. The term of imprisonment with such coincidence, in Canon Criminal Law, is based on the rule of punishment accumulation for crimes, from which there is a possibility of facultative punishment remission on account of their scale. The possibility of reduction of accumulated punishment is only in the scope of ferendae sententiae. Polish Criminal Law defines the term of imprisonment with the crimes coincidence as combined punishment. It is the synthesis of all punishments for the crimes abiding/remaining in the coincidence and inflicting the unified punishment within the range predicted by the legislator.
The present gloss refers to the thesis and considerations expressed in the Supreme Court judgement of 28 February 2023, I KZP 13/22, concerning the exception to the rule of speciality stipulated in Article 14 par. 1 (b) European Convention on Extradition. The author presents arguments concerning the broad international legal context of the analysed regulation, which develops and confirms the accuracy of the Supreme Court’s stance on a broader than lexical interpretation of the term ‘final discharge’. Moreover, the paper discusses the nature of the exception in question in the light of the standard of protection laid down in Article 52 par. 4 Constitution of the Republic of Poland.

Niniejsza glosa odnosi się do tezy oraz rozważań wyrażonych w postanowieniu Sądu Najwyższego z dnia 28 lutego 2023 r., I KZP 13/22, dotyczącym wyjątku od zasady specjalności unormowanym w art. 14 ust 1 lit. b Europejskiej konwencji o ekstradycji. Autor przedstawia argumentację dotyczącą szerokiego kontekstu prawno-międzynarodowego analizowanego unormowania, która rozwija i potwierdza trafność stanowiska Sądu Najwyższego co do szerszego niż leksykalne rozumienia pojęcia „ostatecznego zwolnienia”. Ponadto w publikacji odniesiono się do charakteru omawianego wyjątku w świetle standardu ochrony wyznaczanego przez art. 52 ust. 4 Konstytucji RP.
The article presents an analysis of the Supreme Court Criminal Chamber resolutions and rulings adopted in the course of interpreting statutes or provisions that raised doubts and caused discrepancies in case law and were referred for examination to the Supreme Court by appellate courts or the First President of the Supreme Court. These concerned: a negative factor for awarding an aggregated penalty in the form of a penalty of deprivation of liberty for an offence committed in the course of serving a penalty (Article 85 § 3 CC); limitation of penalty imposition in the case of cumulative legal classification of an act (Article 101 § 1 CC); the concept of a consequence as a feature of a prohibited act from which the running of limitation starts (Article 110 § 3 CC); evasion of the obligation of maintenance in the context of a legal act that is more favourable to a perpetrator (Article 209 § 1 CC); a concept of an employee in the case of malicious and persistent infringement of an employee’s rights resulting from the labour relationship or social insurance (Article 218 § 1a CC); and the type of dominant activity concerning retail trading jointly in newspapers, public transport tickets, tobacco products, and lottery and betting tickets (Article 6 para. 1(6) of the Act of 10 January 2018 on the limitation of retail business on Sundays, public holidays and some other days).

W artykule została przeprowadzona analiza uchwał i postanowień Izby Karnej Sądu Najwyższego, podjętych w wyniku przestawienia przez sądy odwoławcze i Pierwszego Prezesa Sądu Najwyższego zagadnień prawnych wymagających zasadniczej wykładni ustawy lub interpretacji przepisów prawnych, które wywołały w orzecznictwie sądów rozbieżności w wykładni przepisów prawa będących podstawą ich orzekania. The article carries out an analysis of resolutions and rulings of the supreme Court Criminal Chamber passed as a result of appellate courts’ requests for fundamental interpretation of a statute within the scope of substantive criminal law. the analysis covers: the method of extraordinary mitigation of a penalty for felonies carrying cumulative deprivation of liberty and a fine (article 60 § 2 CC); a conditionally suspended cumulative penalty of deprivation of liberty and a penalty of limitation of liberty (article 87 § 1 CC), and admissibility of cumulating the penalty of deprivation of liberty and the penalty of limitation of liberty that substitutes for a conditionally suspended penalty of deprivation of liberty (article 75a § 1 CC); liability for an offence of failing to pay alimony (article 209 § 1 CC) connected with the modification of its statutory features laid down in act of 23 March 2017; the issue of parents’ liability for the offence of kidnapping or detaining a minor under the age of 15 or a physically or mentally disabled person against the will of a person granted the rights of their caretaker or guardian (article 211 CC).

W artykule została przeprowadzona analiza uchwał i postanowień izby karnej sądu Najwyższego podjętych w wyniku przedstawienia przez sądy odwoławcze zagadnień prawnych wymagających zasadniczej wykładni ustawy w zakresie prawa karnego materialnego. Przedmiotem rozważań są: sposób nadzwyczajnego złagodzenia kary za zbrodnie zagrożone kumulatywnie karą pozbawienia wolności i grzywną (art. 60 § 2 k.k.); kara łączna obejmująca karę pozbawienia wolności z warunkowym zawieszeniem jej wykonania i karę ograniczenia wolności (art. 87 § 1 k.k.), a także dopuszczalność połączenia kary pozbawienia wolności z karą ograniczenia wolności, na którą została zamieniona kara pozbawienia wolności z warunkowym zawieszeniem jej wykonania (art. 75a § 1 k.k.); odpowiedzialność za przestępstwo niealimentacji (art. 209 § 1 k.k.), związana z modyfikacją jego ustawowych znamion ustawą z dnia 23 marca 2017 r.; kwestia odpowiedzialności rodziców za przestępstwo uprowadzenia lub zatrzymania – wbrew woli osoby powołanej do opieki lub nadzoru – małoletniego poniżej lat 15 albo osoby nieporadnej ze względu na jej stan psychiczny lub fizyczny (art. 211 k.k.).
The author agrees with the Constitutional Tribunal’s opinion that Article 87 § 1 of the Penal Code to the extent that it imposes an obligation on the court to combine imprisonment and restriction of liberty and to impose a total penalty of deprivation of liberty after converting the penalty of restriction of liberty into imprisonment is inconsistent with the Constitution of the Republic of Poland. In addition, the author raised the problem of ratio legis of Article 87 of the Penal Code and indicated why the deficiencies in regulation were noticed so late in the case law.

Autorka podziela stanowisko Trybunału Konstytucyjnego, że art. 87 § 1 k.k. w zakresie, w jakim nakłada na sąd obowiązek połączenia kar pozbawienia wolności i ograniczenia wolności oraz wymierzenia kary łącznej pozbawienia wolności po dokonaniu zamiany kary ograniczenia wolności na karę pozbawienia wolności, jest niezgodny z Konstytucją RP. Dodatkowo poruszono problem ratio legis art. 87 k.k. i wskazano, dlaczego tak późno w orzecznictwie zostały dostrzeżone mankamenty regulacji.
The author postulates that as a consequence of introducing in the Act of 20 February 2015 the institution of simultaneous adjudication of imprisonment and restriction of liberty, the legislator should repeal Art. 87 of the Criminal Code. According to Art. 87 § 1 of the C.C., in the case of conviction for concurrent offences for penalties of deprivation of liberty and restriction of liberty, the court shall impose an aggregate penalty, assuming that one month of restriction of liberty is equal to 15 days of deprivation of liberty. The sequence of penalties introduced in Art. 37b of the C.C. undermines the purpose of Art. 87 § 1 of the C.C. Since the legislator introduced a new concept of sequential execution of penalties, he should not preserve the obligation to convert restriction of liberty into imprisonment.

Wprowadzając reformą z dnia 20 lutego 2015 r. możliwość jednoczesnego orzeczenia kar ograniczenia wolności i pozbawienia wolności, ustawodawca powinien konsekwentnie uchylić art. 87 Kodeksu karnego nakazujący w razie skazania za zbiegające się przestępstwa na kary pozbawienia wolności i ograniczenia wolności wymierzenie obligatoryjnie kary łącznej pozbawienia wolności. Przewidziane w art. 37b k.k. sekwencyjne wykonanie kar dezaktualizuje ratio legis unormowania art. 87 § 1 k.k. Skoro bowiem ustawodawca uznał za słuszną ideę kolejnego wykonania obu kar, nie powinien utrzymywać obowiązku zamiany kary ograniczenia wolności na karę pozbawienia wolności przy karze łącznej.
Przedmiotem artykułu jest kara łączna po nowelizacji Kodeksu karnego z 20 lutego 2015 r. Nowelizacja ta wprowadziła daleko idące zmiany w zakresie polskiego modelu kary łącznej, czyniąc go jeszcze bardziej korzystnym dla sprawcy wielu przestępstw. Wśród przesłanek orzekania kary łącznej usunięta została granica pierwszego wyroku za którekolwiek ze zbiegających się przestępstw. Ustanowiono również zasadę nierozwiązywalności kary łącznej. Ponadto nowa ustawa wprowadza do Kodeksu karnego dyrektywy wymiaru kary łącznej i kilka drobniejszych zmian, związanych głównie z modyfikacjami innych rozdziałów Kodeksu karnego.

The article concerns the issue of aggregate penalty after the 20th February 2015 amendment of the Criminal Code. This amendment introduced important changes to the Polish model of aggregate penalty, making it even more beneficial to the perpetrator of several offences. Among prerequisites of imposition of an aggregate penalty, it eliminated the limit of the first judgment rendered with regard to any of concurring offences. It also constituted the rule of the indissolubility of aggregate penalty. Besides, the new act introduced into the Criminal Code the directives of the imposition of the aggregate penalty and a few minor changes, mainly connected with amendments of others chapters of the Code.

Предметом статьи является oбщее наказание после изменений уголовного кодекса от 20 февраля 2015 г. Oни внесли далеко идущие изменения в сфере польский модели общего наказания, изменяя ее на более благоприятнойую для лица, совершившего несколько преступлений. Среди условий для общего наказания было удалено границу первого приговора зa любое из преступлений. Установлено тоже принцип не разделения общего наказания. Кроме того, новый закон вводит в уголовный кодекс директивы размера общего наказания и несколько незначительных изменений, в основном связаных с изменениями других глав Уголовного кодекса.
The purpose of this article is to analyze the institution of the concurrent and the consecutive sentences in the English criminal law. The differences between them are based on the way they are executed and on the premises which courts take into consideration. Generally, the concurrent sentences are imposed for offences which arose out of a single act and therefore the terms of imprisonment shall run at the same time (concurrently). However, a deeper analysis of the literature and the case law of the English courts leads to the conclusion that the differences between them are not so important, because the main role plays the totality principle. It changes the way the institution of the concurrent and the consecutive sentences shall be perceived.
