Zgodnie z przepisami Konstytucji Rzeczypospolitej Polskiej Trybunał Konstytucyjny swą kognicją obejmuje kontrolę zgodności z ustawą zasadniczą konstytucyjnych źródeł prawa: ustaw, umów międzynarodowych oraz przepisów wydawanych przez centralne organy państwowe. Skutki orzeczeń Trybunału stanowią niezmiernie ważne zagadnie-nie z punktu widzenia praktyki stosowania prawa. Wobec pojawiających się przypad-ków uchwalania przez parlament przepisów prawnych w brzmieniu, które uprzednio zostało zakwestionowane przez Trybunał, szczególnego znaczenia nabiera kwestia nie-konstytucyjności wtórnej w sferze prawa administracyjnego. Artykuł jest próbą zdefiniowania tego zjawiska i przedstawienia uwag wypływających z aktualnego orzecznic-twa i praktyki.

In accordance with the regulations the Constitution of the Polish Republic Constitutio-nal Court of Justice controls concordances with law of principle of constitutional sour-ces of law: bills, international treaties and regulations given by central State-organs. Re-sults of opinions of Court of Justice determine the extremely important problem from the point of view of the practice of the application of the law. In the face appearing ca-ses of resolving by Parliament of legal provisions in the sound which previously was qu-estioned by Court of Justice, the special meaning gathers the matter of unconstitutio-nal of secondary in the sphere of the administrative law. The article is a test of defining of this occurrence and the performance of attentions effluent from the current jurisdic-tion and the practice.
