Europejski nakaz aresztowania jest decyzją sądową, umożliwiającą bardziej sprawne aresztowanie i przekazanie osoby podejrzanej lub oskarżonej o popełnienie przestępstwa i wydanie jej do kraju, w którym zostanie postawiona przed sądem lub przekazana do wykonania wcześniej orzeczonej kary. W artykule przedstawiono podstawy prawne oraz procedury dotyczące wykonania ekstradycji na terenie Unii Europejskiej. Zaprezentowano również praktyczne rozwiązania organizacyjne i planistyczne stosowane przez polską Policję w celu wykonania ENA. Materiał został sporządzony na podstawie analizy przepisów prawnych przedmiotowej tematyki oraz przeprowadzonych wywiadów eksperckich z policjantami zajmującymi się organizacją i wykonywaniem międzynarodowych konwojów osób zatrzymanych.

The European Arrest Warrant is the decision of a judicial authority which facilitates the detention and conveyance of persons suspected or indicted of having committed criminal actions in another country and the extradition of aforesaid persons to the respective country in order to bring them to justice or where a sentence already imposed has to be completed. The article presents the legal bases and procedures that regulate and control the extradition proceedings within the European Union. Following, this paper outlines the operational implementations applied by the Polish police force in the course of the EAW procedure. The material presented in this article is based on the analysis of the respective applicable international law, supplemented by expert surveys conducted with police officials responsible for the organization and operation of convoys of detainees transferred beyond Polish borders.
