Celem niniejszego artykułu jest zwrócenie uwagi na znaczenie elektronicznej księgi wieczystej dla prawidłowego i bezpiecznego obrotu nieruchomościami. Od 1 stycznia 2015 r. wszystkie papierowe księgi wieczyste zostały zastąpione nowoczesnym informatycznym systemem, który zmienił sposób prowadzenia ksiąg wieczystych. W artykule wskazane są powody, dla których można uznać, że zmiana systemu prowadzenia ksiąg wieczystych skutkuje zwiększeniem bezpieczeństwa obrotu prawnego nieruchomościami. Wyciągnięcie powyższego wniosku poprzedza analiza przepisów regulujących prowadzenie elektronicznej księgi wieczystej, strukturę elektronicznej księgi wieczystej i budowę systemu Nowej Księgi Wieczystej.
The article contents the origins of the entries in the land registers and their evolution especially after Poland regained its independence. In this regard it is necessary to determine the features of entries in the land registers as the specific form of judgments and also annotation or orders. The article shows the phenomenon the broader application new technology in the sphere of disclosing of property rights on real estate especially by the using communication and information system. The author also describes electronic land register proceedings and their co – existence with traditional form of proceedings, as well as possibilities of creating common system of information about real estate between the European countries – European land register.
Długoterminowy charakter kredytów przeznaczonych na finansowanie nieruchomości mieszkaniowych powoduje, że ryzyko związane z jego udzieleniem jest trudniejsze do oszacowania. Konsekwencją tego jest stosowanie przez banki finansujące nieruchomości mieszkaniowe odpowiednich form ograniczania ryzyka. Decydujące znaczenie ma w tym przypadku prawne zabezpieczenie kredytu w postaci hipoteki na nieruchomości, a nie ocena zdolności kredytowej, gdyż banki nie dysponują wiarygodnymi informacjami do jej określenia w tak długim okresie kredytowania. Wobec tego dla sprawnego działania systemu finansowania rynku mieszkaniowego bardzo ważne są zasady funkcjonowania hipoteki. W związku z tym, że 20 lutego br. w naszym kraju weszła w życie nowelizacja ustawy o księgach wieczystych i hipotece1, która ma szeroki zakres, celem niniejszego artykułu jest scharakteryzowanie najważniejszych zmian dotyczących uregulowań hipoteki oraz próba ich ocenienia w kontekście finansowania nieruchomości.

A long-term effect of mortgage loans designed for the purchase of residential real estates causes that the risk associated with loan granting is harder to estimate. Consequently, the banks which provide finances for residential real estates are looking for proper risk limitation forms. In that case, the major role is assigned to the legal security of the loan in the form of mortgage on real estate, and not the evaluation of the client's credit worthiness, because the banks do not have reliable information to determine long-term credit worthiness. As a result, to attain efficient operation of the financing system for the housing market, the mortgage operating rules become important. Owing to the fact that the Law of Land and Mortgage Registers and Mortgage14 was amended in Poland on 20 February 2011, and the Law is very broad in its scope, the purpose of this paper is to describe the most important modifications relating to the mortgage regulations and an attempt at evaluating them in the context of real-estate financing.
This paper concerns the problems that appeared in connection with the land register viewing via electronic way. The first part presents the legal basis of land register, the transfer (migration) of the contents of land register into the structure of land register managed with a computer system and the access to land register through the internet. The issue of access to land register through the internet was illustrated on the example of real estate with multi-family building. The work carried out shows that knowing the perpetual book number of a single premise, through the real estate perpetual book we have access to the perpetual books of all premises being separately owned estates, and thus the personal data of their respective owners.

Praca dotyczy problematyki jaka pojawiła się w związku z możliwością przeglądania Ksiąg Wieczystych "drogą elektroniczną". W pierwszej części pracy przedstawiono podstawy prawne systemu ksiąg wieczystych, podstawy prawne przenoszenia (migracji) treści ksiąg wieczystych do struktury ksiąg wieczystych prowadzonych w systemie informatycznym oraz pod-stawy prawne dostępu do ksiąg wieczystych za pośrednictwem Internetu. Problematyka związana z dostępem do ksiąg wieczystych za pośrednictwem Internetu została zilustrowana na przykładzie nieruchomości zabudowanej budynkiem wielorodzinnym. Z przeprowadzonych prac wynika, że znając księgę wieczystą jednego lokalu, poprzez księgę nieruchomości gruntowej mamy dostęp do ksiąg wieczystych wszystkich wyodrębnionych lokali, a co za tym idzie danych osobowych ich właścicieli.
Sejm RP uchwalił 16 września 2011 r. ustawę o ochronie praw nabywcy lokalu mieszkalnego i domu jednorodzinnego (Dz.U. Nr 232, poz. 1377), zwaną ustawą deweloperską. Określa ona w sposób kompleksowy treść umowy deweloperskiej, wzajemne prawa i obowiązki stron, zasady i tryb jej zawierania, sposób jej wykonania, a także odpowiedzialność stron w razie jej niewykonania lub nienależytego wykonania. Wprowadza silne środki ochrony praw osób nabywających od deweloperów lokale mieszkalne lub domy jednorodzinne, tj. mieszkaniowy rachunek powierniczy oraz prospekt informacyjny, wyposażyła osoby fizyczne w skuteczne środki ochrony ich interesów także na wypadek upadłości dewelopera. Kluczowe znaczenie ma również obligatoryjność formy aktu notarialnego dla umowy deweloperskiej, będącej umową zobowiązującą dewelopera do przeniesienia na nabywcę własności lokalu mieszkalnego lub domu jednorodzinnego po jego wybudowaniu. Umowa ta stanowi podstawę wpisu do księgi wieczystej roszczenia o przeniesienie na nabywcę własności nieruchomości.

The Sejm of the Republic of Poland has passed on 16.09.2011 the act on the protection of buyers of residential premises and single family houses (Journal of Laws, number 232, item 1377), hereinafter referred to as the developer act. It specifies in a comprehensive manner the content of the developer agreement, mutual laws and duties of each party, principles and modes of concluding it and the manner of performing it as well as the responsibilities of parties in the case of failure to perform them or their improper performance. It introduces strong protection of rights of persons purchasing residential premises or single family houses from developers i.e. residential trust accounts and information prospectus, the act also equipped natural persons in effective means of protection of their interest in the case of developer’s bankruptcy. It is also of key importance that the developer agreement has to maintain the form of a notarial deed, this agreement obliges the developer to transfer upon the buyer the ownership of the residential premises or single family house after it is built. This agreement constitutes the basis to the entry into the land and mortgage register of the claim to transfer onto the buyer the ownership of the real estate.
Compulsory real estate mortgage is one of the forms of tax obligations fulfilling security. It is a form of a collateral security. It realizes its functions by means of securing mainly tax obligations. By operation of special regulations one can also secure other public tributes such as social security contribution, Labour Fund. As a rule, mortgage is a right which burdens a real estate and secures a claim. It's a right by operation of which a mortgage creditor can seek satisfaction from a real estate, no matter whose possession it became and with priority over personal creditors of the freeholder. Compulsory real estate mortgage is vested in the creditors of public law: the State Treasury and territorial self-government units on behalf of which tax authorities act. Compulsory real estate mortgage is vested for tax obligations (which emerged by issuing and servicing a decision which determines the amount of tax obligation), back taxes (concern all kind of taxes) and default interest on back taxes. Compulsory mortgage can be established on a real estate of a debtor and on exhaustively enumerated rights connected with a real estate. The subjective scope of mortgage includes: a tax payer, a payer, a tax collector, a successor to the rights of a tax payer or third party. Establishing of every mortgage, including compulsory real estate mortgage, is determined by entry to the mortgage register. A motion on a compulsory real estate mortgage can be put forward by tax authorities of both instances. The entry to the mortgage register is inserted by the court who conducts the mortgage register of the burdened real estate.
