Wykorzystanie umów terminowych w Polsce w kontekście skutków światowego kryzysu gospodarczego

Fixed-term employment contacts play important role in the debate on the Polish labour market flexibility and the use of atypical forms of work. The widespread use of this type of contracts caused that European Commission formulated recommendations and the Polish trade unions took actions aimed at reducing the degree of use of such contracts. The article presents the mainstream debate on the excessive use of fixed-term contracts in Poland. It discusses the changes in legislation related to counteracting effects of the economic crisis, the extent of the use of fixed-term contracts in Poland and of employers’ and trade unions’ attitudes toward utilisation of these contracts. In summary, the proposal of the single contact is elaborated.

Istotne miejsce w debacie o elastyczności polskiego rynku pracy i wykorzystaniu atypowych form pracy zajmuje problematyka tzw. umów terminowych. Powszechne wykorzystanie tego typu umów przez przedsiębiorców doprowadziło do sformułowania przez Komisję Europejską zaleceń w stosunku do Polski i podjęcia przez związki zawodowe działań mających na celu ograniczenie stopnia stosowania tych umów. Artykuł prezentuje główny nurt debaty dotyczącej nadmiernego wykorzystania umów terminowych w Polsce. Omówiono w nim zmiany w regulacjach prawnych związane z przeciwdziałaniem skutkom kryzysu, zakres wykorzystania umów terminowych w Polsce i stanowiska pracodawców i związków. W podsumowaniu zasygnalizowano jedno z potencjalnych rozwiązań – wprowadzenia tzw. jednego kontraktu.
