A high level of public participation is a much desired state of affairs as it entails numerous benefits for the participants of the political system. Citizens gain access to legislative procedures, can express their opinions often backed by expert knowledge, have a sense of co-responsibility for the ongoing developments, etc. The authorities, in turn, without any serious weakening of their monopoly on decisions, gain access to, among others, expert knowledge, the possibility to build a broader social consensus around their actions and in this way avoid the danger of political turbulence in the form of mass protests. The problem, however, lies in the fact that such participation both at the EU and domestic level is far below the desired degree – for very different reasons citizens do not join in those processes. This inadequacy has in a way forced decision-making centers to undertake various initiatives aimed at improving the state of things. The article is an attempt to answer the question: which of the remarks and conclusions related to the introduction of two essential mechanisms of participation at the EU’s supranational level can be implemented into the state system of the Republic of Poland.
The paper investigates legal funding of the right to petition in Poland. It starts from a comparative background and it introduces the institution in a wider context, as a transparent and accessible for citizens legal solution, that has become an essential instrument of contemporary direct democracy and civic society. The author discusses regulations of the 2014 Acts on Petitions with reference to the Constitution of Poland and organisation of the Sejm and the Senate proceedings. Moreover, the study has placed the right to petition in a fieldwork of Polish system of human rights protection and Polish legal system in general. Finally, the paper presents results of opinion polls on direct democracy and civic engagement in Poland to discuss them with reference to previously presented construction of the right to petition as a legal institution. The author concludes with a relevant question on its further development in times of deep polarisation of Polish politics and during the Constitutional Crisis in the county.
The article reveals the methodological significance of legal constructions and shows their influence on the interpretation of legal norms. It has been found that legal construction is one of the epistemological tools of legal science and means of interpreting legal norms in the process of their implementation. A concentrated expression of the possible conditions of law enforcement determines the methodological significance of legal constructions during the interpretation of legal norms. The legal construction is shown as a set of stable connections of the object, which ensure its integrity and identity. Emphasis is placed on the fact that intraindustry and inter-industry connections of legal norms allow law to preserve its properties as a regulatory in the face of internal and external changes, to be stable and stable. The existence of a stable structure determines the existence of law as a system is a condition for the existence of law. The author came to the conclusion that in order to optimize legal interpretation activity, it is necessary to improve the process of eliminating defects in legal constructions. The ambiguity and inconsistency of legal constructions is a consequence of the increase in the number of scientific terms, special expressions, contradictions and gaps in the normative material. The reason for this is hasty normative design without compliance with the requirements of legal technique. With the help of legal constructions, insightful, detailed and in-depth clarification of the content of legal norms is carried out.
The article is divided into six parts. In Part I, the author gives introductory notes describing the powers of US Congress. In the subsequent sections, he tries to find out what is the actual status of that body in the system of government. He provides a very positive evaluation of that status in Part II, and presents negative arguments thereon in Part III. In Part IV he analyzes - as he himself defines them - the seven deadly sins of Congress: the growing “balkanization” of the Congress; overexposed position of its committees and subcommittees in the political system; its decades-long weak party discipline and lesser legal and political status of the parliamentary party factions; different Achilles heels of Congressmen; doubtful representativeness of Congress, the excessive complexity of the existing procedures that are used by a temporary minority to delay, block or undermine the necessary legislative proposals, and little, as it seems to be, attention of Congress to its image in society. Part V deals with redefinition of the functions of Congress. The author agrees with those researchers who believe that it was many years ago that Congress ceased to be able to effectively and independently perform its legislative function, as well as that its main role is not law-making, but a specifically understood oversight. Part VI ncludes the conclusions.

Autor stawia pytanie, czy współcześnie jest jeszcze miejsce na kodeksy w takiej formie, w jakiej były one tworzone w XIX wieku. Przede wszystkim zmieniły się warunki, w jakich powstawały ówczesne kodeksy, oraz postulaty wobec nich stawiane. Nie oczekuje się już obecnie, że akty te będą całkowicie i wyłącznie regulować daną dziedzinę życia społecznego. Nasiliło się zjawisko dekodyfikacji, polegające na regulowaniu materii właściwych kodeksom w innych ustawach, co rodzi problemy na tle ich wzajemnych relacji. Utrudnieniem dla procesu kodyfikacji jest także brak współpracy pomiędzy nauką prawa i sądami, które do tej pory wspólnie wypracowywały rozwiązania, wpisywane następnie do treści kodeksów. Zdaniem autora kodeksy mogą jednak nadal odgrywać ważną rolę i pełnić funkcję w pewnej mierze symboliczną. Najważniejszym zadaniem kodeksów jest bowiem tworzenie aksjologicznych podstaw danej dziedziny prawa, przede wszystkim formułowanie katalogu zasad decydujących o jej autonomii.

The author of the article asks the question whether there is still space for codes in the form in which they were created in the nineteenth century. The conditions for the creation of codes have changed. Lawyers do not require codes in order to completely regulate a given field of social life. The occurrence of decodification is very strong. Lack of cooperation between legal science and the courts makes it difficult to create new codes. However, in the author’s opinion, codes can still play an important and symbolic role. The most important function of codes is to create the axiological foundations of a given branch of law.
W rzeczywistych postępowaniach prawodawczych niejednokrotnie dochodzi do błędów, to jest do nieodpowiedniego, niejasnego wyrażenia intencji prawodawcy w tekście przepisu. Rozbieżność między tym, co prawodawca powiedział a tym, co chciał powiedzieć, stanowi poważne wyzwanie dla teorii i praktyki interpretacji prawniczej. W niniejszym artykule autor analizuje dwa możliwe zachowania sądu po stwierdzeniu błędu legislacyjnego, to znaczy bądź to dokonanie jego „naprawy”, bądź też zastosowanie przepisu w jego literalnym znaczeniu. Rozważania oparte są na dwóch orzeczeniach wydanych w Izbie Karnej Sądu Najwyższego, ponieważ to właśnie w prawie karnym ochrona rozumienia prima facie stanowi bardzo poważną wartość. W końcowej części autor stara się wskazać, jakie czynniki mogą przesądzać o stosunku sądu do błędu legislacyjnego w konkretnych przypadkach.

In the actual legislative processes, errors are often made: the legislator’s intentions are not always properly expressed in the legal provisions or there is insufficient clarity. The discrepancy between what the legislator said and what they meant to say poses a serious challenge to the theory and practice of legal interpretation. In this paper, the author analyses two possible reactions to a legislative error: correcting it or applying the provision in its literal meaning. The considerations are based on two decisions of the Criminal Chamber of the Polish Supreme Court, because in criminal law the protection of the prima facie understanding of the text is a very important value. In the final part of the paper, the author indicates factors which can affect the court’s attitude towards a legislative error in a specific case.
Symbolicznym przepisom prawa brak klasycznie rozumianej skuteczności; co więcej jednak, prawodawca posługujący się tym instrumentem z tym brakiem efektywności bądź to godzi się lub wręcz obejmuje go swoją intencją. Tego rodzaju przepisy przyjmowane są bądź to dla realizacji niejawnych celów politycznych, bądź też do realizacji jawnych celów, tyle że nie za pomocą wymuszania określonych zachowań, lecz raczej kształtowania w społeczeństwie odpowiednich postaw. Celem opracowania jest przeanalizowanie okoliczności, które mogą prowadzić do przyjmowania symbolicznych aktów prawnych. Dla realizacji tego zadania wybrano dwa przykłady z polskiego prawodawstwa, a następnie dokonano analizy okoliczności ich uchwalenia. W ten sposób wyodrębniono kilka czynników, które mogą uprawdopodobniać fakt, że prawodawca zmierzał do ustanowienia 1) przepisów symbolicznych oraz 2) przepisów symbolicznych mających realizować przede wszystkim niejawne cele polityczne.

Symbolic provisions of law lack effectiveness in the classic sense; moreover, the legislature using this instrument either accepts this lack of effectiveness or even intends it. Such provisions are adopted for the realization of either secret political goals or explicit goals – not by enforcing certain behaviours, but rather by shaping appropriate attitudes in the society. The aim of the study is to analyse the circumstances that may lead to the adoption of symbolic legal instruments. To implement this task, two examples from Polish legislation were selected, and then the circumstances of their adoption were analysed. In this way, several factors have been identified that may justify the fact that the legislature sought to establish: (1) symbolic provisions and (2) symbolic provisions intended primarily to attain secret political goals.
Jasność uznaje się za jedną z cech dobrego prawa. Dotychczasowe opracowania poświęcone postulatowi jasności prawa koncentrują się na prawie krajowym. Niniejszy artykuł jest próbą odniesienia tego postulatu do wielojęzycznego i wielokulturowego prawa Unii Europejskiej. Prawo jasne to takie, które jest zrozumiałe i precyzyjne. Choć nie jest możliwe, by było ono całkowicie jasne, to prawodawca powinien starać się, by prawo było tak jasne, jak to możliwe, ponieważ takie prawo chroni istotne wartości i umożliwia osiąganie istotnych celów, m.in. służy efektywności i pewności prawa. Jednym z zasadniczych warunków jasności prawa jest odpowiedni język tekstów aktów normatywnych – zarówno ich słownictwo, jak i składnia. Dlatego aby prawo było jasne, prawodawca powinien m.in. przestrzegać określonych reguł dotyczących językowych aspektów tworzenia prawa. Również prawo Unii Europejskiej powinno być jasne. Wielojęzyczny i wielokulturowy porządek prawny Unii Europejskiej różni się jednak od krajowych porządków prawnych, w tym porządków wielojęzycznych, dlatego sposoby zapewniania jasności prawa europejskiego różnią się częściowo od tych stosowanych w krajowych porządkach prawnych. Dotyczy to przede wszystkim języka tekstów aktów normatywnych. Stosowanie nowych, europejskich terminów prawnych jest uzasadnione i służy zapewnieniu prawu Unii Europejskiej jasności, nawet jeśli początkowo może się to wydawać nieoczywiste. Nowa, europejska, składnia tekstów aktów normatywnych Unii Europejskiej nie jest natomiast uzasadniona. Aby zapewnić jasność prawa, prawodawca unijny powinien przestrzegać tych samych reguł składniowych, co prawodawca krajowy.

Clarity is one of the basic traits of good law. So far, theory of law has focused on the clarity of law requirement only with reference to national legal orders. The article tries to apply this requirement to multilingual and multicultural European Union legal order. Clear law is understandable and precise. Although it is not possible to make law completely clear, the legislator should try to make it as clear as possible since such law protects important values and enables to achieve important goals, for instance it makes law more efficient and certain. One of the crucial prerequisites for clear law is appropriate language of the texts of legal acts. It concerns both vocabulary and syntax of these texts. Therefore, in order to make law clear, the legislator should follow specific rules regarding linguistic aspects of lawmaking. European Union law should be clear as well. Since European Union multilingual and multicultural legal order is different from national legal orders, including the multilingual ones, the methods of making European Union law clear are partly different from those applied in national legal orders. It concerns, above all, the language of texts of European Union legal acts. The use of new, European, legal terms is justified and helps make European Union law clear, even though this does not have to seem evident. In contrast to the new vocabulary, the new, European, syntax of texts of European Union legal acts is not justified. In order to make law clear, the European Union legislator should follow the same syntactic rules as the national legislator.
Artykuł dotyczy relacji między argumentacyjnym i narracyjnym charakterem teksów prawniczych oraz pytania, czy te ostatnie mogą być pojmowane jako teksty narracyjne. Tekst narracyjny rozumiany jest jako przekazujący odbiorcy opowieść za pomocą określonego medium. Opowieść jest zatem treścią tekstu narracyjnego i stanowi konkretny sposób zamanifestowania fabuły. Fabuła jest więc swego rodzaju wewnętrzną logiką opowieści. Tę samą fabułę można opowiedzieć na wiele sposobów. Tekst narracyjny nie przedstawia wydarzeń bezpośrednio, lecz poprzez opowieść, która wymaga opowiadającego ją podmiotu – narratora. Oczywiście może być on w tekście mniej lub bardziej ujawniony i występują różne jego rodzaje. W konsekwencji można wyodrębnić c co najmniej pięć stanowisk dotyczących relacji argumentacji i narracji w prawie: 1) Sceptyczne – narracja jest zaprzeczeniem rozumności prawa, 2) Narracja jest strukturą prezentacji faktów, 3) Narracja jest środkiem perswazji retorycznej, 4) Narracja jest strukturą meta-argumentacyjną, 5) Narracja jako przedmiot analizy krytycznej – ujawnia tożsamość autora. Teoria narracji zostanie zastosowana do szczegółowego zagadnienia uczestniczenia samorządów zawodowych w tworzeniu prawa.

The paper concerns the relation between argumentative and narrative features of legal texts and the question whether legal texts can be perceived as narrative texts. A narrative text is understood as transferring a story to the recipient through a given medium. The story, being the content of a narrative text, constitutes a specific way of manifesting the plot. The latter is a sort of internal logic of the story. The very same plot might be told in many different ways. Hence, the narrative text does not depict events directly, but through a story that requires a storytelling agent – the narrator. Certainly, there are different kinds of narrators, who can be more or less exposed within the text. In consequence, there are at least five positions concerning the relation between argumentation and narration in law: 1) sceptic – narration is a negation of the reasonableness of law; 2) narration is a structure of presentation of facts; 3) narration is a means of rhetoric persuasion; 4) narration is a meta-argumentative structure; 5) narration is a subject of critical analysis as it reveals the identity of an author. The theory of narration is applied to a particular problem of participation of professional self-governments in law-making.
The author provides an analysis of the issue who should be competent to the notification of the parliamentarian draft bills. The article examines meaning of the notification in different areas of law, particularly international and European Union law. Apart from general remarks on the meaning of notification in the context of principle of loyalty, the analysis shows the character of this institution in connection with the consequences of a breach of the due notification. The author focuses on three main types of the procedure of the notification: notification of the state aid, notification of the technical standards and regulations and notification of the draft legislative provisions falling within the European Central Bank’s field of competence. The analysis shows that there is no complex regulation in polish system of law according to the notification procedure. Due to the need to avoid the problems associated with the breach of the due notification author presents his view on the issue who should notify the parliamentarian draft bills and puts forward a number of arguments supporting the conception of the significant role of the sponsor of the bill in procedure of notification.
In the system of legal sources, apart from typical acts of local law created in accordance with the provisions of the Constitution, there are also acts that do not fall within the constitutional standards of law, although they concern, among other things, important social and economic issues. Such documents (planning acts, programmes, or strategies), although enacted by resolutions, often fail to contain generally binding regulations. Although this does not prevent them from having a binding force, they should nevertheless be made in compliance with the generally recognised rules of lawmaking, including the principles of proportionality, rationality, communicativeness and brevity. The generally applicable provisions often impose on local self-governments an obligation to create acts regulating important social issues, such as for instance programmes preventing and solving alcohol-related problems and determining the way of dealing with alcohol addiction in local conditions. However, these programmes are often developed in violation of the rules of a rational law-making process, and are frequently detached from the local reality, which makes them ineffective. Therefor it may be worth considering another way of responding to the problem of alcoholism, not necessarily by means of resolutions adopted annually. The obligation to develop a prevention and resolution programme addressing alcohol-related problems could be replaced, for example, by certain specific organisational measures, an educational programme, or the implementation of other measures. The law is not always the right way to achieve the goals set, but the above recommendation will requires statutory changes first, anyway.

W systemie źródeł prawa wyróżnić można, obok typowych aktów prawa miejscowego stanowionych zgodnie z przepisami Konstytucji, także takie akty, które nie mieszczą się w standardach konstytucyjnych źródeł prawa, choć dotyczą istotnych kwestii społecznych, gospodarczych itp. Tego rodzaju dokumenty (np. akty planowania, programy, strategie itp.), mimo że są uchwalane w drodze uchwał, nie zawsze zawierają przepisy powszechnie obowiązujące. Bez względu jednak na moc wiążącą aktu normatywnego prawodawca powinien przestrzegać powszechnie uznawanych reguł stanowienia prawa, w tym zasady proporcjonalności, racjonalności, komunikatywności i zwięzłości. Przepisy powszechnie obowiązujące często nakładają na samorządy lokalne obowiązek tworzenia aktów regulujących ważne kwestie społeczne, np. program profilaktyki i rozwiązywania problemów alkoholowych dotyczący zagadnienia sposobu postępowania ze zjawiskiem nałogu alkoholowego w warunkach lokalnych. Programy te często opracowywane są z naruszeniem reguł racjonalnego tworzenia prawa, a ponadto oderwane są od lokalnej rzeczywistości, co powoduje, że są one nieskuteczne. Warto zatem rozważyć możliwość innego sposobu reagowania na zjawisko alkoholizmu, nie za pomocą corocznie uchwalanych uchwał. Obowiązek sporządzania programu profilaktyki i rozwiązywania problemów alkoholowych mógłby zostać zastąpiony np. odpowiednimi działaniami organizacyjnymi, edukacyjnymi itp. Prawo nie zawsze jest właściwym sposobem osiągania zakładanych celów. Wymaga to jednak zmian ustawowych.
The law-making process in the reception of many entities participating in it or monitoring its course is not very transparent and unsatisfactory as far as the level of civic participation is concerned. The authorities should care about civilizing the law-making process. The more discussions and consultations are in the process of creating assumptions for legal acts, the greater the chance of avoiding mistakes and the chance that citizens will approve the existing legal system and abide by the law. In this publication, the author has attempted to make a subjective indication of these elements of the law-making process that require rapid change. At the same time, he pointed to solutions that could significantly contribute to improving its quality.

Proces stanowienia prawa w odbiorze wielu podmiotów w nim uczestniczących lub monitorujących jego przebieg jest mało przejrzysty oraz niesatysfakcjonujący, jeśli chodzi o poziom partycypacji obywatelskiej. a przecież władzom powinno zależeć na tym, aby uspołecznić proces stanowienia prawa. Im więcej dyskusji i konsultacji w trakcie tworzenia założeń do aktów prawnych, tym większa szansa uniknięcia pomyłek oraz szansa na to, że obywatele będą aprobowali istniejący system prawny i przestrzegali prawa. W opracowaniu tej autor podjął próbę subiektywnego wskazania tych elementów procesu stanowienia prawa, które wymagają szybkiej zmiany. Jednocześnie pokazał na rozwiązania, które mogłyby przyczynić się znacząco do poprawy jego jakości.
Prawo pozytywne jest rezultatem grupowej decyzji normatywnej. Jest stanowione przez upoważnionych członków legislatywy, którzy w procesie tworzenia prawa nie są wolni od swoich doświadczeń i motywacji. Pojawia się więc pytanie, jakie procesy dotyczące takich osób mogą wpłynąć na treść prawa. Aby znaleźć na to pytanie odpowiedź (wyjaśnienie) konieczne jest wyjście poza klasyczne badanie prawa i integracja teorii prawa z takimi dyscyplinami jak m.in. psychologia, socjologia, politologia i kognitywistyka. W niniejszym artykule wykorzystana została teoria dysonansu poznawczego wywodząca się z psychologii społecznej i opracowana przez Leona Festingera w 1957 r., by na jej bazie sformułować hipotezę dotyczącą wpływu redukcji dysonansu poznawczego na treść prawa pozytywnego, czego wyrazem może być używanie przez prawodawcę eufemizmów.

The written law is a result of collective normative decision. It is enacted by competent members of legislative body being people which aren’t free from their experiences and motives in the process of the enactment. Therefore the following question appears – what occurring processes at these persons can affect contents of the law. To find an answers (explanations), there is a need to go beyond classical law research, to the direction of outside integration theory of law and derive them from such a disciplines as psychology, sociology, political science, cognitive science and the other. Presented paper uses a theory of cognitive dissonance, derived from social psychology and developed by Leon Festinger (1957’) to formulate a hypotheses about the influence of cognitive dissonance reduction on the content of written law, which expressions may be euphemisms used by legislator.
In Hungary legislative power rests with the National Assembly. According to the Fundamental Law of Hungary the authority to pass legislation is vested in the National Assembly, the supreme body of popular representation. This paper gives a general overview of the role of the branches of powers in law-making in Hungary. We introduce the role of the legislative power in law-making, the role of the executive power, the role of the judicial power in law-making, and finally the role of the President of the Republic in legislation.

Według regulacji Konstytucji węgierskiej kompetencję do uchwalania ustawodawstwa przysługuje Parlamentowi, najwyższemu organowi reprezentacji ludowej. Przedmiotem artykułu jest przedstawienie roli organu władzy ustawodawczej w procesie ustawodawczym. Autorzy odwołują się również do udziału innych organów władzy państwowej w stanowieniu prawa.
The goal of the article is to determine whether the legal interpretation should be made with the assumption of consistency of terminology at the level of a branch of law or at the global level. The question is therefore whether the interpreter should presume that the legislator ‘by default’ refers those who apply the law only to the legal definitions contained in a certain, most general act within one branch of law, or whether, regardless of the branch, the legislator always uses a uniform terminology. An analysis of the law-making practice may be a source of useful cues to answer this question. First, the article reconstructs the requirements imposed on the drafters by the Principles of Legislative Technique. Secondly, several dozen acts passed by the Sejm of the 7th and 8th term of office are examined in terms of the presence of ‘definitional’ references to acts from the same branch of law and acts from another branch of law. In this way, it is established that only the presumption of a legal act maintain terminological consistency with legal definitions set out in the basic act for a given branch of law seems to be legitimate. The basic act should not be understood in an institutional way, but as one relating to a quasi-branch. The article also identifies at least some cases where it is justified or unjustified to use ‘explicit’ references to point out branch-level or global terminological consistency. The results of the analyses may find application in the discussion on the meaning of the directive of legal language in the theory and practice of interpretation, as well as in the theory and practice of legislation – in determining when it is necessary to use a provision referring to a legal definition.

Celem artykułu jest określenie, czy wykładni prawa należy dokonywać z założeniem dziedzinowej czy globalnej spójności terminologicznej. Chodzi tu zatem o ustalenie, czy interpretator powinien domniemywać, że prawodawca „domyślnie” odsyła stosujących prawo jedynie do definicji legalnych zawartych w pewnej najogólniejszej ustawie w granicach jednej dziedziny prawa, czy też iż zawsze, niezależnie od dziedziny, prawodawca posługuje się jednolitą siatką terminologiczną. Źródłem wskazówek przydatnych do udzielenia odpowiedzi na to pytanie może być analiza praktyki legislacyjnej. W artykule dokonano, po pierwsze, rekonstrukcji wymagań, które legislatorom narzucają Zasady techniki prawodawczej. Po drugie zaś – przebadano kilkadziesiąt ustaw uchwalonych w Sejmie VII oraz VIII kadencji pod kątem występowania w nich „definicyjnych” odesłań do ustaw z tej samej dziedziny prawa oraz ustaw z innej dziedziny prawa. W ten sposób ustalono, że uprawnione wydaje się jedynie domniemanie zachowania w akcie prawnym spójności terminologicznej z definicjami legalnymi określonymi w ustawie podstawowej dla danej dziedziny prawa, którą należy rozumieć na sposób quasi-gałęziowy, a nie instytucjonalny. Określono także co najmniej niektóre przypadki, w których uzasadnione lub nieuzasadnione jest stosowanie „wyraźnych” odesłań w celu zasygnalizowania zachowania dziedzinowej lub globalnej spójności terminologicznej. Wyniki analiz mogą znaleźć zastosowanie w dyskusji nad znaczeniem dyrektywy języka prawnego w teorii i praktyce wykładni, a także w teorii i praktyce legislacji przy określaniu, kiedy potrzebne jest użycie przepisu odsyłającego do definicji legalnej.
The question that the paper seeks to answer is formulated through reflections on the is-sues of non-originalism. Non-originalism refers to an approach to the interpretation of the Constitution where the text of the Constitution adapts to new conditions without any formal change. This approach is applied by courts which, in the light of new circumstances, interpret the Constitution in a different way. The question is whether the same approach should also be applied by the legislator. Should it be the legislator who monitors whether the Constitution has changed in substance as a result of changes in society and that some existing statutes thus have become unconstitutional? The paper concludes that the legisla-tor has an obligation to monitor and respond to such changes by amending or abolishing certain statutes or by adopting new ones. If the legislator fails to respond, then his behav-iour – inaction – is unconstitutional. However, the paper does not claim that the legislator must respond to all the changes in society, but only to those that are significant and obvi-ous. The legislator is understood as an institution, not as a member of the legislative body (based on the theory of the legislative intent). However, the institution of the legislator is a human creation and composed of individuals, and it is their knowledge that makes up the knowledge of the legislator. And it is precisely their possibilities that determine the bound-aries of what the legislator should know. In this text, the creation of law is understood as communication between the legislator, who is the author of statutes, and public bodies, who interpret and apply them. As with any communication, context is what determines it. The legislator’s obligations are derived from the content of the context, its function, and its essential position in communication.
