Procedury tworzenia i uchwalania prawa oraz ich przestrzeganie stanowią ważny element działalności państwa podlegającej wnikliwej obserwacji. To właśnie stało się powodem, dla którego autor postanowił przyjrzeć się bliżej procedurom tworzenia prawa z perspektywy Rady Ministrów. Nie ulega wątpliwości, że rząd, będący głównym twórcą prawa w naszym kraju, podejmuje nieustanne próby zmierzające do udoskonalenia procesu stanowienia prawa. Dobrym tego przykładem są cele, jakie zostały sformułowane w programie „Lepsze Regulacje 2015” stanowiącym załącznik do uchwały Rady Ministrów z dnia 22 stycznia 2013 r. nr 13/2013. Mimo to jednak w dalszym ciągu w tym zakresie pozostaje wiele do zrobienia. Właśnie dlatego celem autora oprócz ukazania stopnia zaangażowania rządu w proces tworzenia prawa stało się także sformułowanie postulatów de lege ferenda, które jego zdaniem pozwolą na zwiększenie przejrzystości systemu stanowienia prawa, a tym samym doprowadzą do podwyższenia jego jakości.

The legislatives procedures and norms for law-making are the important elements of good governance. This results with an attempt to examine them from the perspective of Polish Council of Ministers. Such body – as a basic legislator in our political and legal system – keeps putting efforts in improving the legislative procedures. The goals phrased in a governmental programme „Better Regulations 2015” (the Council of Ministers’ resolution of 22.01.2013, no. 13/2013) may be pointed out as a good illustration of aforementioned efforts and approach. However, there is still a lot to be done in such area. For these reasons the paper focuses not solely on the range and the degree of the Council of Ministers’ involvement in legislative level, but also on some remarks de lege ferenda that may lead to increasing the transparency of the procedures and improving the quality of law.
