Authentic interpretation of laws is an interpretation of legal provisions that, due to their lack of clarity or misinterpretation in their application, is provided by the parliament. Unlike the legislative procedure, which is conducted, as a rule, in two (exceptionally three) readings, a proposal for giving an authentic interpretation is discussed in one reading. Starting from the understandings of some authors that the act of authentic interpretation of laws is contrary to the principle of democratic pluralism, and that it lacks the necessary level of democratic control and citizen participation, the author examines whether the Croatian parliamentary law enables public participation in the procedure for authentic interpretation of laws and, if so, what legal instruments can be used to implement it in parliamentary practice. To this end, the paper analyzes several relevant constitutional, legal, and procedural provisions of the Croatian parliamentary law, with reference to a parliamentary practice. Given the fact that the procedure for authentic interpretation in the Republic of Croatia, the Republic of Northern Macedonia, the Republic of Slovenia and the Republic of Serbia is regulated in a similar way by the rules of procedure of their respective parliaments, the relevant regulations of the latter three countries on the possibility of public participation in this procedure are analyzed as well. It was concluded that Croatian parliamentary law enables public participation in the procedure for authentic interpretation, through the instruments of petition, information and involvement in working groups and working bodies, and the same instruments, with certain specifics, are recognized in the parliamentary law of the latter three countries.
The author emphasizes the formal equality of the Deputies founded on the provisions of the Constitution. He points out the impossibility of extending the time for speech of non-aligned Deputies over six minutes for the entire sitting of the Sejm. The term “speech” should not be understood as any of the instances of taking floor by a Deputy, but only those in which they present their views on the issue considered at the meeting of the Sejm. Referring to the rules of procedure of the Sejm, he claims that posing questions by non-aligned Deputies during the third reading shall depend the consent of the Marshal of the Sejm. The author also emphasizes that, in the light of Article 45 para. 1 of the Standing Orders of the Sejm, it is not allowed to submit amendments during the second reading by any of the Deputies individually.
The author claims that there is no possibility for sub‑committee members to submit to the chairperson a written request requiring him/her to convene a meeting or to convene a meeting of the subcommittee by the Presidium of the Sejm. As a means obligating the members of the subcommittee to hold a meeting to consider a bill, she points out, inter alia, a time limit for submission of the report on the work of the subcommittee which could be specified in the resolution appointing it. She also indicates that the committee is allowed to take over a bill considered by a sub‑committee, by taking an appropriate resolution.
An obligation, provided for in the Standing Orders of the Sejm, of a sponsor’s of the bill to present to present outline drafts of principal executive orders is one of the core procedural regulations shaping the content of an explanatory statement of a bill. If the sponsor does not plan to issue any executive orders on the bases on the bill, it has to be indicated in the explanatory statement of the bill, as an information about legal consequences of the bill. In case when entry into force of the statute will result in the necessity of modifying executive orders being in force, it should be notified while presenting the above-mentioned legal consequences.
The analysis concerns the issue of whether a committee considering, based on the indicated provision, amendments submitted during the second reading, should vote on their acceptance or rejection separately for each amendment, or if it is possible, after consideration of the amendment, to automatically (without separate vote) draw a recommendation concerning other amendments, in case it is a logical consequence of acceptance or rejection of the former amendment. The author assessed that there are no obstacles to apply, at this stage of legislative work, per analogiam the institution of the third-reading voting applied in the first instance to the “most far-reaching amendments”, i.e. those whose adoption or rejection determines decision concerning other amendments.
The problems raised in the doctrine of constitutional law related to the implementation of a decision taken in a referendum in matters of particular importance to the state, as well as the generally marginal use of the institution of popular vote in the constitutional prac-tice, give rise to reflection on the introduction of the institution of a referendum law into the Polish constitutional system. In this article the author considers the advantages and disadvantages of such a solution, analyzing at the same time contemporary normative regulations concerning such acts in other countries. The research leads to the conclusion that despite the risks involved, the refer-endum law should appear in the Polish constitutional system in the future, as it would not only give a chance for a more complete reflection of the will of the collective subject of sovereignty without the necessity of its decoding by the parliament, but it could also be an impulse for the development of the referendum practice in the Republic of Poland. However, it is important to introduce proce-dural barriers that will prevent depreciation of this institution.
The author demonstrates the admissibility of consider a petition containing a request to refrain from work on a bill submitted to the Sejm. The suggestion contained in the petition must be interpreted as a request regarding failure to adopt a bill, its rejection by the Sejm, or withdrawal by a sponsor. The Committee on Petitions may disregard the postulate or request a rejection of a dubious bilin the course of work on the bill by another committee or during a second reading of the bill. Allowing the petition’s request is impossible after conclusion of the second reading.
The article deals with the question whether, in the context of the power of appropriate Sejm committees to consider individual parts of draft budgets, as referred to in Article 106 paragraph 2 of the Standing Orders of the Sejm, it is admissible to submit a motion for and to adopt a resolution on holding a public hearing (Article 70a of the Standing Orders of the Sejm). Based on the analysis of the provisions of the Standing Orders of the Sejm, the author draws a conclusion that Sejm committees do not have such a power. According to the Standing Orders of the Sejm, in the course of work on a draft budget, an exclusive right to adopt resolution on holding a public hearing belongs to the Public Finances Committee.
In this study, the authors attempt to assess the procedures for dealing with urgent bills under the Polish legal system, from the perspective of the practice based approach. The analysis in the study is based on the legal status enshrined in the Polish Constitution of 2 April 1997. According to the authors, the gathered research material, covering several years, is so extensive that it can constitute the basis for in-depth analysis and for formulating conclusions. The authors examine the historical and legal-comparative aspects of use of the fast-track procedure in the legislative process, the de lege lata legal status, as well the application of this instrument in practice. The fi nal part of the study provides the conclusions of the research undertaken.
Artykuł dotyczy udziału prezydenta Republiki Litewskiej w procedurze ustawodawczej na gruncie obowiązującej Konstytucji przyjętej w referendum z dnia 25 października 1992, a także, tytułem wstępu i w bardzo ograniczonym zakresie, na tle poprzednich uregulowań konstytucyjnych, począwszy od odzyskania niepodległości przez Litwę dnia 16 lutego 1918 r. Konstytucja Republiki Litewskiej zapewnia prezydentowi udział w stanowieniu prawa już na etapie inicjatywy ustawodawczej, a także przy promulgacji ustaw, która wiąże się z obowiązkiem podpisania i ogłoszenia ustawy, ewentualnie zwrócenia ustawy do Sejmu w celu jej ponownego uchwalenia (weto). W treści artykułu przedstawione zostały konkretne regulacje konstytucyjne dotyczące tych instytucji, jak również wątpliwości, które mogą powstać bądź powstały na gruncie tych przepisów. W tekście uwzględniono również przepisy innych obowiązujących ustaw oraz regulaminów, w zakresie, w jakim wyznaczają one ramy korzystania przez prezydenta z jego kompetencji w procedurze ustawodawczej. Z uwagi na odrębność uregulowań ustawy zasadniczej oddzielnie omówiono kwestie związane z udziałem prezydenta w zmianie bądź uzupełnieniu Konstytucji.

The paper describes the participation of the president of the Republic of Lithuania in the legislative procedure, in relation to the Constitution in force adopted by the referendum on October 25th, 1992. The paper also presents the president’s participation regarding former constitutional regulations, starting from restoration of Lithuania’s independence on February 16th, 1918. This is presented mainly as an introduction and in significantly limited scope. The Constitution of the Republic of Lithuania stipulates that the President participates in establishing law as early as at the stage of the legislative initiative, and also at the promulgation of the acts which is related to the obligation to sign and promulgate the act, respectively to refer it back to the Seimas in order to have it reconsidered (a veto). Particular constitutional regulations related to those institutions, and also the doubts that may arise or have arisen due to those laws, have been presented in this paper. The regulations of other acts and laws in force have been also described in the paper regarding determining the rights that the President may exercise in relation to his or her competences in legislative procedure. Due to the separateness of the basic law regulations, the issues related to the President’s participation in the change or amendment of the Constitution have been discussed severally.
This paper is the next publication in the series intended to conduct wider research into the legal status of the Pridnestrovian Moldavian Republic. It aims at realizing its next phase which is an analysis of the system of Transnistria’s supreme state authorities, and is particularly devoted to Transnistria’s Parliament — the Supreme Council, which is the highest representative authority created to exercise the legislative power. The subject of the work is the origin and evolution of the Supreme Council, its composition and internal organization, the electoral procedure and status of the deputies, its functions and competencies, as well as its operation, presented on the basis of the exegesis of Transnistria’s constitutions (of 1991 and 1995) and the rules of procedure. The result of the research allows us to establish the effectiveness of the state apparatus and contributes to a more precise determination of the region’s legal status.
Youth councils at local government units have existed practically since 1990. However, only since 2001 there has been a legal basis for setting up such bodies. Although this provision remained unchanged, the COVID-19 pandemic significantly reduced the possibilities of youth councils. They had many problems and in many cases no new term of office was appointed for these bodies. As a result, the Parliament dealt with the statutory regulation of the youth council institution and adopted a government bill in 2021 (Dz.U. 2021 poz. 1038). The author tries to investigate the impact of the COVID-19 pandemic on the number of youth councils in operation. In addition, he assesses the most important solutions contained in the applicable law. Finally, the article welcomes the legislative action but notes the incomprehensible decisions. It also draws attention to the sharp decrease in the number of youth councils between March 2020 and September 2021 but notes the upward trend.

Młodzieżowe rady przy jednostkach samorządu terytorialnego działają praktycznie od 1990 r. Dopiero jednak od 2001 r. funkcjonuje podstawa prawna umożliwiająca powołanie takich organów, ale przez 20 lat pozostawała niezmieniona. Pandemia COVID-19 znacząco ograniczyła możliwość funkcjonowania młodzieżowych rad, które zmagały się z wieloma problemami (np. w wielu przypadkach kończyły się kadencje tych organów, a nie powoływano nowych). W rezultacie ustawodawca zajął się ustawową regulacją instytucji młodzieżowej rady i przyjął rządowy projekt ustawy (Dz. U. 2021 poz. 1038). W związku z tym autor starał się zbadać wpływ pandemii COVID-19 na liczbę funkcjonujących młodzieżowych rad. Ponadto przeanalizował najważniejsze rozwiązania zawarte w ustawie. Ostatecznie pozytywnie ocenił działania ustawodawcy, jednakże zwrócił uwagę na jego niezrozumiałe decyzje oraz na zdecydowany spadek liczby młodzieżowych rad między marcem 2020 r. a wrześniem 2021 r. Obecnie widoczna jest tendencja wzrostowa.
I am in favour of the possibility of questioning the course of the legislative process in a constitutional complaint. The objection/the allegation could only concern the procedure of adopting a normative act containing a provision constituting the legal basis of an act of applying the law. The act of applying the law must concern the constitutional rights or freedoms of the complainant. With the current procedural regulation, I believe that there is an obligation to examine this issue ex officio by the Constitutional Tribunal. Practice shows that the Tribunal does not examine the correctness of the legislative process in the proceedings initiated by the complaint, neither on the allegation of the applicant nor ex officio.

Opowiadam się za możliwością kwestionowania przebiegu procesu legislacyjnego w skardze konstytucyjnej. Zarzut mógłby dotyczyć jedynie procedury przyjmowania aktu normatywnego, w którym zawiera się przepis stanowiący podstawę prawną aktu stosowania prawa. Akt stosowania prawa musi dotyczyć konstytucyjnych praw lub wolności skarżącego. Przy obecnej regulacji procesowej, uważam, że istnieje obowiązek badania tej kwestii przez Trybunał Konstytucyjny z urzędu. Praktyka pokazuje, że Trybunał nie bada prawidłowości przebiegu procesu legislacyjnego, w postępowaniu zainicjowanym skargą, ani na zarzut skarżącego, ani z urzędu.
Przedmiotem artykułu jest przedstawienie procedury ustawodawczej w Izbie Ustawodawczej Olij Mażlisa Republiki Uzbekistanu. Artykuł oparty został przede wszystkim o liczne akty prawne. W pracy ujęte zostały zagadnienia prawa inicjatywy ustawodawczej: tryb rozpatrzenia projektu ustawy w trzech czytaniach, rozpatrzenie ustawy odrzuconej przez Senat, w tym instytucja komisji pojednawczej, a także zagadnienie weta Prezydenta Uzbekistanu wobec ustawy.

Według art. 20 Ustawy Zasadniczej Republika Federalna Niemiec jest państwem demokratycznym, socjalnym i federalnym, w którym cała władza pochodzi od narodu i jest przez niego sprawowana poprzez wybory i głosowania. W praktyce głosowania, rozumiane jako instrument demokracji bezpośredniej, znajdują zastosowanie tylko w wypadku nowego podziału terytorialnego landów. Szersze zastosowanie instrumenty demokracji bezpośredniej mają przy stanowieniu prawa w poszczególnych landach. Prawo przewiduje w nich między innymi obywatelską inicjatywę ustawodawczą. Dla uchwalenia prawa federalnego zastosowanie takiego rozwiązania wymagałoby zmiany Ustawy Zasadniczej. Wnoszone do tej pory projekty takich zmian zostały jednak odrzucone przez Bundestag.

According to Article 20 of the Basic Law, the Federal Republic of Germany is a democratic, social, and federal state in which all power comes from the people and is exercised by them through elections and votes. In practice, voting, which is to be understood as an instrument of direct democracy, applies only to the new territorial division of the Länder. The instruments of direct democracy are more widely used in lawmaking in the individual Länder. Among other things, the law provides for citizens’ legislative initiative. This would require an amendment to the Basic Law if federal law were to be passed. To date, proposals for such amendments have been rejected.
Artykuł ma charakter przyczynkarski w ramach badań nad znaczeniem świadomości konstytucyjnej w korzystaniu przez obywateli z różnych prawnych form udziału w sprawowaniu władzy, w tym w procesie stanowienia ustaw. Opiera się na założeniu, że przewidziana w Konstytucji Rzeczypospolitej Polskiej instytucja obywatelskiej inicjatywy ustawodawczej to ważny instrument świadomego oddziaływania społeczeństwa obywatelskiego na proces sprawowania władzy w państwie demokratycznym. Instytucja obywatelskiej inicjatywy ustawodawczej zakłada istnienie procesu deliberacji między obywatelami a władzą, co faktycznie jest możliwe wtedy, gdy społeczeństwo jest zaangażowane w życie publiczne. Demokracja deliberacyjna może być faktycznie realizowana, gdy obywatele są świadomi z jednej strony praw gwarantowanych im na poziomie konstytucyjnym i ustawowym, a z drugiej – potrzeby i zasadności zmian politycznych i społeczno-gospodarczych. Korzystanie z inicjatywy obywatelskiej stwarza faktyczną możliwość przeprowadzenia stosownej kampanii (przy zbieraniu podpisów), przekazywania obywatelom informacji o kwestii będącej przedmiotem projektu, wymiany poglądów oraz dyskusji, również za pośrednictwem mediów czy innych narzędzi komunikacji. W artykule zwraca się uwagę, że obowiązująca w Polsce regulacja prawna inicjatywy ustawodawczej wykazuje wady (w tym luki prawne), które w praktyce mogą zniweczyć istotę tej instytucji. Ponadto ostatecznie o kształcie ustawy decyduje parlament (a więc czynnik polityczny). Z uwagi zaś na niski poziom zaufania wobec instytucji publicznych oraz polityków aktywność obywateli w procesie stanowienia ustaw nie jest wysoka. Niemniej jednak znaczenie obywatelskiej inicjatywy ustawodawczej w urzeczywistnianiu konstytucyjnych zasad demokratycznego państwa prawnego oraz suwerenności narodu jest nie do podważenia. Zadaniem współczesnego państwa demokratycznego jest zatem wzmacnianie świadomości obywateli w zakresie formalnych i materialnych aspektów realizacji konstytucyjnego prawa inicjatywy ustawodawczej. Nie wystarczy jednak posiadanie przez obywateli świadomości co do zagwarantowanej konstytucyjnie możliwości wpływu na proces rządzenia przez inicjowanie zmian w prawie, konieczna jest jeszcze – oparta na komunikacji – interakcja ze strony decydentów politycznych oparta na poszanowaniu woli społeczeństwa (grup społecznych).

The paper is a partial result of the research on importance and scale of constitutional consciousness, in the context of citizen’s participation in power, particularly in law making process. It has been based on the assumption, that the institution of citizens’ legislative initiative provided in the Constitution has become a significant tool of civic participation in power in a democratic state of law. Such institution, in turn, assumes a liaison, a deliberation between the citizens and the authorities which is truly available only if a society is interested in participating in public life. Deliberative democracy becomes real under twofold condition: the citizens are conscious of their constitutional rights and also aware of the changes needed at the political and economical level. The most valuable benefits from citizens’ legislative initiative are: running an election campaign (getting signatures for a petition); passing the information about the project; exchanging views and opinions in a discussion (also through the media). The paper points out lacks and week-points of currently binding legislation that may limit the effectiveness of such institution. What is more: the final content of the legislation depends on the political factors – the parliament. Regarding the low trust-level for public authorities and politicians, the citizens’ participation in the law making process is hardly significant. Nevertheless, the general potential of citizens’ legislative initiative to manifest the constitutional principles of rule of law and sovereignty in practice – is undeniable. Modern democratic state of law shall strengthen the citizens’ consciousness and empower them to implement the constitutional right for citizens’ legislative initiative. The paper leads to the conclusion, that the lone consciousness is not enough and it shall be followed by communication and interactions between citizens and political decisional bodies.

Doubts regarding the compliance with all the requirements of the legislative procedure prompted the President of the Republic of Poland to bring the case to the Constitutional Tribunal for consideration. It was necessary to determine whether the presumption of adoption of the Senate amendment, adopted in the Constitution of 1997, is a regulation on the essential elements of the legislative procedure, violation of which determines unconstitutionality of the legislative act.
W dniu 5 sierpnia 2015 r. na posiedzeniu plenarnym Sejmu poddano pod głosowanie wniosek o przyjęcie poprawek Senatu do ustawy. Mimo uzyskania bezwzględnej większości głosów za ich przyjęciem, Marszałek Sejmu stwierdziła fakt ich odrzucenia przez Sejm. Wątpliwości co do dochowania wszystkich wymogów trybu ustawodawczego skłoniły Prezydenta do wniesienia sprawy do rozpatrzenia przez Trybunał Konstytucyjny. Należało ustalić czy przyjęta na gruncie Konstytucji z 1997 r. konstrukcja domniemania przyjęcia poprawki Senatu jest regulacją dotyczącą istotnych elementów procedury prawodawczej, której naruszenie stanowi podstawę do stwierdzenia niekonstytucyjności badanego aktu normatywnego.

Doubts regarding the compliance with all the requirements of the legislative procedure prompted the President of the Republic of Poland to bring the case to the Constitutional Tribunal for consideration. It was necessary to determine whether the presumption of adoption of the Senate amendment, adopted in the Constitution of 1997, is a regulation on the essential elements of the legislative procedure, violation of which determines unconstitutionality of the legislative act.
Out of the executive bodies of a local self-government, only the voits (mayors, presidents of cities) are elected in direct elections, whereas on the poviat and voivodeship level, we are dealing with collective management boards, the members of which are chosen indirectly by the council of the poviat, and by the voivodeship sejmik (a regional assembly). However, this issue is not discussedparticularly frequently, in parliamentary practice there have been attempts at introducing direct elections of starosts andvoivodeship marshals, which are justified by the need of strengthening the degree of social legitimization for such offices, as well as forharmonizing the regulations which are applicable on all local government levels. The goal of this article was to proceed with a critical analysis of the projects which have been submitted within this scope, as well as to answer the question: which conditions should be met so that the introduction of a fundamental change in the starost and voivodeship martial election procedure could be assessed positively.

Spośród organów wykonawczych samorządu terytorialnego jedynie wójtowie (burmistrzowie, prezydenci miast) wyłaniani są w wyborach bezpośrednich, podczas gdy na szczeblu powiatu i województwa mamy do czynienia z kolegialnymi zarządami, których skład obsadzany jest w sposób pośredni, przez radę powiatu i sejmik województwa. Jakkolwiek nie jest to zagadnienie podejmowane szczególnie często, w praktyce parlamentarnej pojawiały się próby wprowadzenia bezpośrednich wyborów starostów oraz marszałków województw, argumentowane potrzebą wzmocnienia stopnia społecznej legitymacji dla tych urzędów oraz zharmonizowania regulacji obowiązujących na wszystkich szczeblach samorządu. Celem artykułu uczyniono krytyczną analizę wnoszonych w tym zakresie projektów oraz udzielenie odpowiedzi na pytanie, jakie warunki powinny zostać spełnione, aby wprowadzenie zasadniczej zmiany w trybie wyłaniania starostów oraz marszałków województw mogło zostać ocenione pozytywnie.
