The article attempts to evaluate the introduction of legal security of historic, artistic or scientific movables loaned from abroad for temporary exhibitions organised in Poland (the so-called museum immunity); the regulation came into force on 30 November 2015 as the new addendum 4a to the Act on Museums. The author presents the rules which govern the new legal institution and, from a perspective of one year’s operation, presents their evaluation with regard to the achievement of the goals set and their legislative precision, including suggestions of changes. He observes that as far as the terms of protection are concerned, the regulation copies the solutions proposed by the Expert Team of the National Institute for Museums and Public Collections which prepared a report on museum immunity in 2012, it introduces different solutions in terms of procedures for granting protection. In his conclusion, the author emphasises that the new regulation includes many doubtful provisions, including those on the key issue of the moment when the protection ceases.

Tematem artykułu jest ocena wprowadzenia do polskiego systemu prawnego ochrony prawnej rzeczy ruchomych o wartości historycznej, artystycznej lub naukowej wypożyczonych z zagranicy na wystawę czasową organizowaną na terytorium Rzeczypospolitej Polskiej (tzw. immunitet muzealny), która to regulacja weszła w życie 30 listopada 2015 r. jako nowododany rozdział 4.a Ustawy o muzeach. Autor przedstawia zasady rządzące nową instytucją prawną i – z perspektywy ponad rocznego już obowiązywania przepisów o immunitecie – przedstawia ich ocenę z punktu widzenia osiągania założonych celów, jak i precyzji legislacyjnej, włącznie z przedstawieniem postulatów zmian. Zauważa, że o ile w zakresie przesłanek ochrony regulacja powiela rozwiązania zaproponowane przez Zespół Ekspertów Narodowego Instytutu Muzealnictwa i Ochrony Zbiorów, który w 2012 r. przygotował raport na temat immunitetu muzealnego, to w odniesieniu do procedury przyznawania ochrony wprowadza odmienne rozwiązania. W konkluzji autor podkreśla, że nowa regulacja zawiera sporo przepisów budzących wątpliwości, w tym również w kluczowej kwestii momentu stwierdzenia ustania ochrony.
