W artykule omówiono problem, czy suma ubezpieczenia oraz składki ubezpieczeniowe w umowie ubezpieczenia na życie podlegają doliczeniu do spadku na potrzeby rozliczeń z osobami uprawnionymi do zachowku, czy podlegają zaliczeniu na poczet zachowku należnego uposażonemu jako osobie uprawnionej do zachowku oraz czy podlegają zaliczeniu na poczet schedy spadkowej przypadającej spadkobiercy przy dziale spadku. W ocenie autora odpowiedź na te trzy pytania jest przecząca. Tym samym uważa on, iż przepisy art. 993 k.c., art. 996 k.c. i art. 1039 k.c. nie mają tu zastosowania.

The article discusses the question whether the sum insured and insurance premiums in the life insurance contract shall be added to the inheritance for the purpose of settlements with people entitled to the legitime, or shall be charged against the legitimate portion due to the beneficiary entitled to the forced share, or whether they shall be included in the inheritance attributable to heirs during the division of estate. According to the author the response to these three questions is negative. Therefore, he believes that the provisions of Articles 993, 996 and 1039 of the Civil Code do not apply here.
