Niniejsze opracowanie dotyczy niezwykle ważnej problematyki związanej z przymiotami stron procesowych i uczestników postępowania nieprocesowego. Przymioty stron i uczestników są niezbędnymi elementami do udziału w postępowaniu sądowym. Dotyczy to zarówno podejmowania czynności procesowych, jak i występowania w określonych rolach procesowych.

This paper concerns the extremely important problems related to the attributes of litigants and of participants in non-contentious proceedings. The attributes of litigants and participants are necessary elements to take part in legal proceedings. This concerns both the procedural steps as well as the appearance in defined roles in the proceedings.

Niniejsza glosa zawiera argumentację negującą stanowisko SN w kwestii nieskuteczności cesji dokonanej po wniesieniu pozwu w postępowaniu nakazowym, a przed doręczeniem go pozwanemu, z uwagi na brak wydania dokumentu nabywcy. W ocenie autorki glosy przedmiotowa cesja powoduje upadek legitymacji materialnej powoda i powinna skutkować oddaleniem powództwa. Brak wydania dokumentu nie uzasadnia bezskuteczności cesji z uwagi na fakt, iż dokument znajdował się w dzierżeniu czysto zastępczym sądu wyłączającym faktyczne władztwo nad dokumentem osób trzecich.

The commentary contains arguments that challenge the High Court ruling on an unsuccessful cession after filing proceedings by writ of payment, but before having it delivered to the defendant; due to not issuing the document to the buyer. It is the author’s opinion that results in the demise of the defendant’s material legitimacy, and should result in dismissal. The lack of issuing of the document does not justify the cession’s ineffectiveness due to the fact that the document was in a substitute lease of the court which excludes actual authority over the document by a third party.

Actio pauliana procedure, fully shaped in the Roman Law during the Classical period, has been deeply rooted in the legal culture of currently unifying Continental Europe. This also applies to Poland where this procedure is very popular in a doctrinal area, often revealing major differences of views, which refers especially to functioning of actio pauliana procedure within the bankruptcy law. In this publication I present these issues, the most important ones, trying to explain/solve them.

This gloss to the judgment of the Supreme Court of 9 December 2021. V CSK 276/21 concerns the legal problem of the right to bring actio Paulina after the debtor has been declared bankrupt. The content of the gloss criticizes the view of the Supreme Court that after the debtor has been declared bankrupt, the creditor retains such legitimacy. At the same time, due to some arguments raised by the Supreme Court, de lege ferenda proposals were formulated in order to improve the legal regulation.

Niniejsza glosa do wyroku Sądu Najwyższego z dnia 9 grudnia 2021 r. V CSK 276/21 dotyczy problemu prawnego, jakim jest legitymacja do wytoczenia powództwa pauliańskiego po ogłoszeniu upadłości dłużnika. W treści glosy poddano krytyce pogląd Sądu Najwyższego, że po ogłoszeniu upadłości dłużnika taką legitymację zachowuje wierzyciel. Jednocześnie z uwagi na argumenty, jakie zostały podniesione przez Sąd Najwyższy, w niniejszym artykule sformułowano propozycje de lege ferenda w celu poprawienia stanu regulacji prawnej.

This paper concerns issues related to the legal standing of a public prosecutor in the cases of marriage annulment. Characteristics, nature, and effects were described along with entitlements resulting from this institution. Presented were marriage obstacles that are base for bringing actions and the dispute of doctrine resulting from marriage obstacles occurring in the narrowed circle that includes marriage obstacles that make possible demanding marriage annulment of constrained entities being explicitly pointed out in regulations. Rights and arguments representing opposite parties were presented in detail along with the standpoint of the author, which was the base for the demanding changes of the regulation entitling public prosecutor to bring actions of marriage annulment. The subject of introducing means of challenging by spouses, that were not entitled to bringing the action was elaborated.

In Polish and also in German law a housing community is entitled to sue the owner of premises and demand their sale by public auction. In both legal systems a resolution must be taken by a housing community and then the case must be referred to court. Grounds for an action, in accordance with Polish law, are as follows: long-term default by the owner on the payment of charges due, flagrant or persistent offence against the applicable order of house rules, inappropriate behaviour that makes the use of other premises or the common property burdensome. Under German law, grounds for a claim may be breach of the obligations incumbent on an owner to other owners of premises in such a blatant way that one cannot expect them to continue to maintain community with him. In both legal regimes, that legal remedy is of a unique and final nature and, therefore, is used when other solutions have produced no effect.
