The article presents one of the forerunners of the modern public libraries in Germany, Paul Ladewig, and his views on a library contained in The Library Catechism of the public library. The legal issues presented in The Library Catechism… are discussed, in particular those related to the financing of libraries, the library organizer’s responsibilities, library management, library statute, granting access to the collections, and others.

Artykuł przedstawia zagadnienia prawa autorskiego w funkcjonowaniu bibliotek szkół wyższych. Według autora biblioteka główna powinna stać się tą jednostka organizacyjną, której jednym z zadań jest organizacja i prowadzenie szkoleń dla pracowników uczelni, doktorantów i studentów w zakresie ochrony i korzystania z prawa autorskiego. Omówiono problemy, które powinny stać się treścią takich szkoleń np. podmiot i przedmiot praw autorskich, przepisy chroniące osobiste prawa autorskie, dozwolony użytek chronionych utworów, cytaty, czas trwania autorskich praw majątkowych i in.

The article presents the issues of copyright in the functioning of academic libraries. According to the author, the main library should become this organizational unit, which fulfils the task of organizing and conducting training for the faculty, graduate, post-graduate and doctoral students in the protection and use of copyright. The issues that should be the content of such training are discussed, e.g. subject and object of copyright, protecting personal copyright, fair use of the protected works, quotes, duration of copyrights, etc.

Zgodnie z polskim prawem bibliotecznym, usługi świadczone przez biblioteki mają charakter nieodpłatny. Przewiduje się jednak sytuacje, kiedy biblioteka może domagać się od czytelnika uiszczenia opłaty. Jedną z nich jest nieterminowy zwrot wypożyczonych materiałów bibliotecznych. W takiej sytuacji biblioteki powinny przystąpić do wdrożenia procedury o jakiej mowa w przepisach kodeksu postępowania cywilnego, jednak z przyczyn ekonomicznych rzadko korzystają z tej możliwości. Zdecydowanie częściej uciekają się do wypracowanych przez siebie nieformalnych sposobów lub korzystają z usług firm windykacyjnych.

According to Polish library law, services provided by libraries are free of charge. However, there are cases when a library may demand payment from the reader. One of them is a delayed return of borrowed materials. In such a case the libraries are entitled to introduce procedures mentioned in civil procedure code, but due to economical reasons they seldom do this. More often they use self-developed informal methods or hire debt recovery agencies.

The author described of this article described the process of isolation of a subgroup of municipal scientific libraries from the larger group of public ones. First public libraries with scientific functions were created on the Polish territory at the beginning of the 20th century and in the 1920s. In the 1960s, after discussions that lasted for over ten years, 8 big public libraries formally got the status of scientific libraries, which was confirmed in the the Library Act of April 9th, 1968. However, due to lacking detailed regulations and appropriate funding, proper functioning of public scientific libraries was hindered in the time of the People’s Republic of Poland.
