Problematyka artykułu koncentruje się wokół aspektu porównawczo-prawnego współczesnej umowy o pracę uregulowanej w polskim Kodeksie pracy oraz antycznej locatio conductio operarum. Publikacja składa się z 2 części – wskazania punktów wspólnych oraz rozbieżności w obu kontraktach. W artykule w sposób komparatystyczny przeanalizowano aspekty dwustronności, wzajemności, ekwiwalentności oraz odpłatności umowy o pracę i locatio conductio operarum. W podobny sposób regulowana jest w obu umowach kwestia podporządkowania osoby ją wykonującej podmiotowi zlecającemu oraz problematyka dotycząca ryzyka wynikającego ze świadczenia pracy. Biorąc pod uwagę płaszczyzny, w których współczesna umowa o pracę oraz jej antyczna poprzedniczka są zróżnicowane, wskazać można uprawnienia represyjne podmiotu zatrudniającego, zabezpieczenie socjalne, element uczasowienia oraz kwestię bezpieczeństwa i higieny pracy.

The issue of the article concentrates on legal comparative aspect of modern contract of employment which is regulated in Polish Labour Code and ancient locatio conductio opperarum. The publication consist of 2 parts – indicates the points of convergence and differences in both contracts. It is analyzed with comparative method such aspects as bilateral, mutuality, equivalency and remuneration in both contracts - contract of employment and locatio conductio opperarum. In the same way are regulated in both contracts issues of subordination of the person performing the order to the employer and the risk resulting from the provision of work. Differences between contract of employment and its ancient predecessor are repressive powers of the employer, social security, temporality and Health and Safety.
