The carnage made during the First World War on the Christians living in the central and eastern provinces of the Ottoman Empire found its widely reflected in the culture and art of the twentieth century. It became the theme of many works and inspiration for the creators, also outside the circle of civiliza-tion hinted communities affected by the tragedy. A special sensitivity distin-guished themselves in artistic circles in Western Europe and the United States. They formed a significant extent widespread contemporary image of the tragedy that took place a hundred years ago in the area of Western Asia. It contained far-reaching simplification and it was also politically useful, decisive for the durability of the media.

Celem niniejszego artykułu jest przedstawienie mechanizmów ochrony praw pamięci na gruncie strasburskiego systemu ochrony praw jednostki, opartego na literalnym brzmieniu europejskiej konwencji praw człowieka (EKPC), jak również praktyce orzeczniczej Europejskiego Trybunału Praw Człowieka (ETPC). Powyższa problematyka zostanie poddana analizie w oparciu o metodę dogmatyczno-prawną, sprowadzającą się do wykładni poszczególnych postanowień konwencji, jak również linii orzeczniczej ETPC. Podstawową hipotezą stawianą przez autorkę jest istnienie dwupoziomowego standardu ochrony przed negacjonizmem praw pamięci, w zależności od rodzaju zanegowanego prawa pamięci.

The objective of the article hereto is to present the mechanisms of the memory rights’ protection within the Strasbourg system, based upon the literal resonance of the European Convention of Human Rights and judicial practice of the European Court of Human Rights. Such topic will be subjected to analysis through the legal-dogmatic method which relies upon the construction of the concrete provisions of the Convention as well as jurisprudence of ECHR. The basic hypothesis of the author is the existence of the double standards of memory rights’ protection against negationism, depending from the type of denied memory right.

In the article shown genocide of Armenians in Turkey in 1915 and and the picture of pogroms of Armenians who is found in the composition „Choucas: an international novel” by Zofia Nałkowska (1884–1954). She is regarded as a pioneer of the psychological novel in Poland. Set in the Swiss Alps, her novel „Choucas” (1927) reflects the author’s experience of a sanatoria village in the mountains above Lake Geneva, where she stayed from February to April 1925, and the international community she encountered there, including Armenian survivors of the genocide placed there by the Swiss Red Cross. In this text c read fragments of Genocide placed in the creation of the Zofia Nałkowska. Elements of the tragedy of the Armenians and the genocide perpetrated by the Turks in 1915 can be found in the logs of the author and her work „Choucas: an international novel” based on the meeting with Armenian refugees from Turkish pogroms who stay on treatment in a sanatorium in Switzerland.
