Przedmiotem niniejszego opracowania są przesłanki nabycia statusu osoby bezrobotnej przez cudzoziemca w świetle ustawy o promocji zatrudnienia i instytucjach rynku pracy. Celem artykułu jest zobrazowanie aktualnych regulacji administracyjnoprawnych i zasad dostępu cudzoziemców do świadczeń z tytułu bezrobocia w Polsce – problematyki, która coraz częściej staje się ważnym tematem debaty publicznej. Rozważania oparte zostały głównie na metodzie badań polskich ram prawnych według stanu na dzień 30.06.2015 r. Opracowanie stanowi próbę przybliżenia złożonego tematu – praw i obowiązków bezrobotnych cudzoziemców w Polsce.

The main subject of the present paper concerns the prerequisites for acquiring the status of unemployed person by a foreigner under the Act on the promotion of employment and labour market institutions. The aim of the article is to describe the current administrative- legal regulations as well as rules of access of foreigners to unemployment benefits in Poland - the issue increasingly significant in public debate. Considerations included were mainly based on the research method of the Polish legal framework as of 30th June 2015. The study is an attempt to bring closer a complex issue - rights and obligations of unemployed foreigners in Poland.
