The purpose of the article is to identify legal regulations and present threats to safe transport of hazardous materials by air. Consequently it is an attempt to face the problem if the transport of hazardous materials is safe. According to the author’s experience related to the subject of transporting hazardous materials by air, the literature of the subject matter concerning this section of transport aviation is practically scanty, therefore, in order to receive an answer to the question posed in the title, the article is composed of general characteristics of the transport of dangerous materials by air and conclusions referring to the safety in this area.

W artykule autorzy przybliżyli problematykę związaną z transportem materiałów niebezpiecznych statkami powietrznymi. Przewóz materiałów niebezpiecznych jest bardzo restrykcyjny, wymaga specjalnego przygotowania, pakowania oraz znakowania. Dlatego też w niniejszym opracowaniu została przedstawiona charakterystyka materiałów niebezpiecznych, wskazano regulacje prawne dotyczące zabezpieczenia materiałów niebezpiecznych do transportu drogą lotniczą oraz omówiono sposób bezpiecznego pakowania przesyłek z materiałami niebezpiecznymi do transportu lotniczego. Głównym celem była analiza dostępnych dokumentów normatywnych, monografii oraz artykułów związanych z problematyką przewozu materiałów niebezpiecznych, a następnie na ich podstawie udzielenie odpowiedzieli na następujące pytania: Czy przewóz materiałów niebezpiecznych jest bezpieczny? (czyli, ryzyko wystąpienia zdarzenia lotniczego z udziałem materiałów niebezpiecznych jest minimalne, dzięki odpowiedniemu znakowaniu i pakowaniu materiałów niebezpiecznych) oraz: Czy przepisy prawne w sposób kompleksowy obejmują problematykę ich transportu?

In this paper, the authors present the issues related to the transport of dangerous goods by aircraft. The transport of hazardous materials is very restrictive, requires special preparation, packaging and marking. That is why this paper presents the characteristics of hazardous materials, indicates legal regulations regarding the protection of hazardous materials for air transport and discusses the method of safe packaging of shipments of dangerous goods for air transport. The main goal was to analyze available normative documents, monographs and articles related to the problem of dangerous goods transportation, and then to answer them on the basis of the following questions: whether transport of hazardous materials is safe (safe - the risk of an aircraft incident involving hazardous materials is minimal), and whether the legal provisions cover the issue of transport in a comprehensive way.

At the bottom of the Polish part of the Baltic Sea, over 415 wrecks are lying. In their tanks fuel may still be stored. Over a hundred of wrecks is located in the Gdańsk Bay, this being an area of intense military operations during the Second World War. Chemical ammunition that was submerged after the war is yet another threat. It is estimated that at the Polish border in the Bornholm Depths over 32 tonnes of chemical ammunition were dumped containing, among others, sulphur mustard, Clark I, Clark II, adamsite, phosgene and tabun. Due to the significant danger of the above substances stored in the sea, NIK examined whether competent institutions had taken appropriate measures to secure these materials. The audit was conduc ted at the Ministry of Maritime Management and Inland Navigation, the Ministry of Environment (currently the Ministry of Climate and Environment), the Chief Inspectorate of Environmental Protection, the Maritime Offices (of Gdynia, Słupsk and Szczecin), the Maritime Search and Rescue Service, and several regional offices (in the Pomorskie, Warmińsko-Mazurskie and Zachodniopomorskie Regions). The audit covered the years 2016–2019 (1st half).

Naukowcy od lat alarmują, że w polskich obszarach morskich zalegają setki wraków statków i dziesiątki ton amunicji chemicznej grożące katastrofą ekologiczną. Na skutek postępującej korozji, a także wykorzystania dna Morza Bałtyckiego, wzrasta ryzyko uwolnienia do środowiska paliwa i bojowych środków trujących. Kontrola NIK wykazała, że ani organy administracji morskiej, ani ochrony środowiska, nie tylko nie rozpoznawały zagrożeń z tym związanych, ale także nie przeciwdziałały skutkom wycieków ze zlokalizowanych wraków. Negowały swoje ustawowe kompetencje lub tłumaczyły brak działań niedostatkiem środków.

Celem artykułu jest przedstawianie głównych zagrożeń, jakie towarzyszyć mogą oględzinom oraz czynnościom ratowniczym w związku z zaistnieniem wypadku lotniczego lub innego zdarzenia o podobnych implikacjach. Ponadto tekst przedstawia w syntetyczny sposób podstawowe metody zabezpieczenia uczestników oględzin przed ewentualnymi skutkami oddziaływania przedmiotowych zagrożeń. Jednocześnie wskazuje konieczność szkolenia w zakresie potencjalnych zagrożeń związanych z wypadkiem lotniczym uczestników oględzin i akcji ratowniczych.

The purpose of this article is to present the major risks accompanying visual inspection and rescue operations in relation to an aviation accident or other events with similar implications. Furthermore, the text presents, in a synthetic manner, the basie methods to protect potential inspection participants from the threats of the impact effeets. The need for training on potential aviation accident hazards to inspection participants and rescue operations is also pointed out.
