The term of legal effect (legal force) traditionally breaks down into formal and material (substantive) aspects. While the formal (external, process) legal effect means that decision cannot be appealed by participants of proceeding, the material (internal) legal effect – for which the formal legal effect is the premise – is associated with attributes such as binding and immutability of the decision by the public authorities (neither judicial nor administrative) and creating the impediment of rei iudicatae in the same matter for the same participants of proceeding. At least within the Central European legal system the question of legal effect is not related only with judicial decisions, but also with acts issued by administrative authorities and other public administrators.Public administration has its own procedures to ensure the various interests: on the one hand there is the public interest to be ensured, because the administration should be able to respond to the current public needs, and on the other hand the administration has to ensure the stability of legal relations and protection of acquired rights of individuals. The administrative law admitted the attribute of legal effect to some acts of public administration and its associated rule of rei iudicatae taking inspiration from the historically previously applied and recognized effects of court decisions.Material legal effect was not (and is not even today) possible attribute for all types of administrative acts, while the requirement of ensuring the protection of the public interest tends to the ability of public administration flexibly change the legal situation based by its earlier acts in some cases. The article discusses different approaches to the issue of legal effect in the administrative law mainly from the point of view of the authors who have written about it in the past as well as the contemporary authors, and focuses on the situations where there may be its interference with the binding character and immutability of the administrative decisions.

U vlastnosti právní moci se tradičně rozlišuje mezi její formální a materiální stránkou. Zatímco formální (vnější, procesní) právní moc znamená, že rozhodnutí nemůže být účastníky (stranami) napadeno řádnými opravnými prostředky, s materiální (vnitřní) právní mocí, jejímž předpokladem je právní moc formální, jsou spojeny atributy jako závaznost a nezměnitelnost rozhodnutí ze strany vykonatele veřejné moci (soudu, správního úřadu) a vytvoření překážky rei iudicatae, pro tutéž věc mezi týmiž účastníky. Otázka právní moci se minimálně v rámci středoevropského právního systému netýkala a netýká jen rozhodnutí soudních, ale i aktů vydávaných správními úřady a jinými vykonavateli veřejné správy.Veřejná správa musí svými postupy zajistit různé zájmy: jednak veřejný zájem, neboť správa by měla být schopna reagovat na aktuální veřejné potřeby, jednak i zajistit stabilitu právních vztahů a ochranu nabytých práv osob. Správní právo přiznalo některým jednáním veřejné správy vlastnost materiální právní moci a s ní spojené pravidlo rei iudicatae, přičemž se inspirovalo v historicky dříve uplatňovaných a uznávaných účincích rozhodnutí soudních.Materiální právní moc nebyla (a ani dnes není) možnou vlastností všech druhů správních aktů, když požadavek zajištění ochrany veřejného zájmu tenduje pro potřebu, aby správa mohla v některých případech pružně měnit právní situace založené svými dřívějšími akty. Článek rozebírá různé přístupy k problematice právní moci ve správním právu, a to autorů, kteří o tom psali v minulosti, ale i současníků, a podrobně se věnuje těm situacím, kdy může dojít k zásahům do pravidla o závaznosti a nezměnitelnosti správních rozhodnutí.
