This article is focused on the examination of the law concerning medical treatment of minors, that is, persons under the age of 18. The first part of this article brings a short overview of the international documents regulating the rights of the child and specifically children’s rights within the area of health care provision. This article analyzes the issue of the maturity and competence of children and discusses whether persons under the age of 18 may be regarded as being capable of consenting to medical treatment. Furthermore this article brings a short comparative overview of the laws concerning medical treatment of minors in different countries and tries to extract the common features of the regulations in the different countries. Finally, the last and longest part of this article analyzes the issue of the capacity of minors to consent to medical treatment in the territory of the Czech Republic from the historical perspective and brings a structured overview of this issue under the current Czech laws.
The paper investigates a new Polish regulation which requires doctors’ permission to use force during medical treatment. It begins with an overview of the former regulations and the dilemmas, especially those associated with patients with medical disorders treated in non-psychiatric hospitals. The second section focuses on the problems with a new procedure regarding the use of force against patients who are treated in psychiatric and non-psychiatric hospitals and are not able to produce legally binding consent. It also looks at the differences between the current and the former procedures. The article concludes that the new regulation has not improved patients’ safety and management of hospitals.
It is mandatory, in the light of legal provisions, that all important information should be saved in personal medical documentation of a patient. This procedure is of vital importance, because it not only records the medical treatment of a given patient applied by medical staff, but it also provides a form of mutual informing on the patient’s condition during diagnosis and therapy. The procedure for creating and providing access to medical documentation has not been audited by NIK to date. However, pre-audit examination revealed that the manner in which such documentation is kept does not meet the current standards, and that patients have difficulties with accessing their documentation when they wish to continue treatment at another medical entity, or when they claim that a doctor has made a mistake during therapy.
A patient’s autonomy determines the scope and terms of medical intervention in the treatment process. In the context of a doctor-patient relationship, autonomy should be understood as a ban on medical intervention without the consent of the patient. Consent is an act of civil law intended to produce legal effects by means of a declaration of intent. For this legal action to be legally considered valid, it must meet a number of conditions. Obtaining consent from a patient is connected with the informative obligation. A physician should provide a patient or his legal representative not only with accurate and accessible information about treatment methods and their scope and benefits, but also the risk posed by the treatment.

W procesie leczenia autonomia pacjenta wyznacza zakres oraz warunki ingerencji medycznej. W relacjach lekarz – pacjent autonomia powinna być rozumiana, jako zakaz podejmowania terapii bez wyraźnej zgody pacjenta. Zgoda pacjenta jest zdarzeniem cywilnoprawnym zmierzającym do wywołania skutków prawnych na podstawie oświadczenia woli. Aby ta czynność prawna mogła zostać w świetle prawa uznana za ważną, musi spełniać szereg warunków. Z wymogiem uzyskania od pacjenta zgody łączy się obowiązek szeroko ujmowanej informacji. Lekarz powinien udzielić pacjentowi lub jego przedstawicielowi ustawowemu dokładnych, przystępnych objaśnień o metodach leczniczych, zakresie, korzyściach, ale także o ryzyku, jakie niesie ze sobą dany zabieg.
Rozwój nauk ścisłych w XIX wieku umożliwił powstanie balneologii, nauki o właściwościach fizycznych i chemicznych wód mineralnych oraz ich zastosowaniu leczniczym. Zaczęli się nią interesować lekarze, a wyjazdy do zdrojów „na kurację” w XIX stuleciu przybrały charakter masowy. Polscy kuracjusze wyjeżdżali głównie za granicę, chociaż polskie wody nie ustępowały zagranicznym. Pojawiła się zatem konieczność przekonania społeczeństwa o walorach rodzimych zdrojowisk oraz podjęcia starań o ich rozbudowę i unowocześnienie. W popularyzacji zdrojowisk dużą rolę odegrały specjalistyczne czasopisma poświęcone balneologii lub dodatki do tytułów lekarskich. Jednym z nich było pismo zatytułowane „Wody Mineralne.

The development of science made it possible for balneology to appear. It deals with physical and chemical properties of water and its use in medical treatment. It attracted interest of doctors and going to spas ‘’for treatment’’ in the 19th century became widespread. Polish bathers and patients used to go abroad, although Polish spas were not worse. That situation made it necessary to convince the society about the quality of our home spas as well as to make efforts to develop and modernize them. Specialist health resort magazines devoted to balneology and supplements to medical press played an outstanding role in popularization of spas. One of the magazines was called ‘’Mineral Water Ciechocinek, Busko, Solec, Druskienniki, Birsztany, Nowe Miasto, Sławinek. Thing Devoted to Spas and Their Guests’’ (1875) – a supplement to ‘’MedicalJournal’’. It was published and edited by Polikarp Girsztowt. It was destined to popularize Polish spas among bathers and patients and thus attract more of them. The magazine popularized information about reasonable use of spas and the treatments they offered.
This article is focused on the examination of the legal nature of the informed consent and its consequences. The first part of this article discusses whether informed consent is juridicial act and the conditions of the validity such as competence, information and voluntariness. A special attention is given to the analysis of the scope of the medical disclosure and to the legal consequences of the failure to warn. Further this article analyses the scope of the civil liability in the cases of the improper medical disclosure.

Tento článek se zabývá právní povahou informovaného souhlasu a následky neúplného poučení z hlediska civilního práva. První část článku se věnuje problematice právního jednání a jeho náležitostí a zasazuje je do problematiky informovaného souhlasu s poskytováním zdravotních služeb. Následně se článek zabývá problematikou vad právního jednání a jejich důsledků pro jeho platnost a vznik povinnosti k náhradě újmy. Existence povinnosti k náhradě újmy je pak podrobně analyzována s ohledem na odlišnost situací, kdy informovaný souhlas nebyl vůbec udělen nebo byl udělen po vadně provedeném poučení. Cílem tohoto článku je poskytnout ucelenější teoretickou analýzu povahy informovaného souhlasu a jeho zakotvení v systematice civilního práva.
The subject of the gloss is Supreme Court’s Resolution of 13 May 2015 (III CZP 19/15). According to the resolution: “a legal representative of a minor may grant a power of attorney to submit a declaration of consent provided for in art. 34.3 of Medical Professions Act of 5 December 1996 (consolidated text: Dz. U. of 2015 item 464)”. The Supreme Court declared absolutely inadmissible power of attorney to carry out parental authority. The Author is of the opinion that the presented resolution is to be approved. The Author analyses several specific issues, which were omitted by the Supreme Court, like requirements to be met by attorney or qualification of the power of attorney to important matters. According to the author power of attorney to submit a declaration of consent should be applied in completely exceptional situations, under taking into account objections arising from civil and medical law.

Przedmiotem glosy jest uchwała Sądu Najwyższego z 13 maja 2015 r. (III CZP 19/15), w której Sąd Najwyższy stwierdził, że „przedstawiciel ustawowy małoletniego dziecka może udzielić pełnomocnictwa do złożenia oświadczenia o wyrażeniu zgody przewidzianej w art. 34 ust. 3 ustawy z dnia 5 grudnia 1996 r. o zawodach lekarza i lekarza dentysty (jedn. tekst: Dz. U. z 2015 r. poz. 464)”. Sąd Najwyższy za bezwzględnie niedopuszczalne uznał udzielenie przez rodziców pełnomocnictwa ogólnego do wykonywania wszystkich czynności z zakresu władzy rodzicielskiej. Autorka, aprobując co do zasady zajęte przez Sąd Najwyższy stanowisko, analizuje związane z nim szczegółowe zagadnienia, pominięte przez Sąd Najwyższy, skupiając się na wymogach, jakie powinna spełniać osoba pełniąca funkcję pełnomocnika, a także na kwalifikacji udzielenia analizowanego pełnomocnictwa jako istotnej sprawy dziecka. Zdaniem autorki udzielenie pełnomocnictwa do wyrażenia zgody powinno być stosowane w sytuacjach zupełnie wyjątkowych, przy uwzględnieniu zastrzeżeń, wynikających z prawa cywilnego i medycznego.
Artykuł porusza problematykę prawnej dopuszczalności chirurgicznego zabiegu „zmiany płci”, poprzez wyłączenie odpowiedzialności karnej lekarza. Tematyka zabiegu uzgodnienia płci budzi kontrowersje w obszarze prawa karnego z punktu widzenia wyłączenia bezprawności dokonania tego rodzaju zabiegu. Część badaczy stoi na stanowisku, że to zjawisko powinno być traktowane jako zabieg medyczny i w konsekwencji opowiada się za pierwotną legalnością chirurgicznej zmiany płci. Z drugiej strony, powyższe stanowisko jest niekoherentne z tendencją do zaprzestania klasyfikowania transseksualizmu jako choroby psychicznej, która ma na celu ograniczenie stygmatyzacji osób transpłciowych. Tym samym należy zaprezentować inne koncepcje uzasadniające wyłączenie bezprawności zabiegu adaptacyjnego wypracowane przez polską naukę prawa karnego, które są związane z tematyką kontratypów. Owe koncepcje obejmują przede wszystkim kwestie zgody dysponenta dobrem oraz stanu wyższej konieczności. Jednocześnie, rozwiązania prezentowane przez doktrynę nie wydają się być adekwatne dla praktyki w tym zakresie, co uzasadnia konieczność omówienia potencjalnych zmian legislacyjnych w analizowanym obszarze.

This paper contains an analysis of the legality of the sex reassignment surgery by excluding criminal liability of a doctor. The issue of sex reassignment in the area of criminal law raises controversies due to the exclusion of the unlawfulness of doctor’s activity. Some scholars share the point of view that presented matter should be concerned as a medical treatment and thus be recognized as primarily legal. Nevertheless, such standpoint may be incoherent with the tendency to exclude transsexualism from the catalogue of mental diseases and to prevent transgender population from stigmatization. Therefore, Polish doctrine of criminal law aims at finding other potential solutions in order to exclude unlawfulness of doctor’s behavior. Consequently, the theories of justifications are presented, particularly with an analysis that concerns the consent of the owner of the good and the force majeure concept. However, presented solutions do not seem to be adequate and comprehensive enough, hence the authors concluded with the necessity of legislative activity in this sphere and eventually pointed out possible de lege ferenda postulates.
