Renesanční italský filozof Giovanni Pico della Mirandola1 sepsal Oratio de dignitate hominis (Řeč o důstojnosti člověka) v návaznosti na obhajobu heretických tezí. V dosavadním právním myšlení se na tento spis odkazuje, protože Pico zdůrazňuje svobodu člověka určovat sebe sama, což je charakteristickým rysem důstojnosti člověka. Pikovo východisko je (hereticky) metafyzické a kosmologické, a proto je sporné, do jaké míry je Pikův koncept využitelný pro právo. Člověk je bez pevné určené podoby a teprve se utváří. Lidská důstojnost není předem určena a podmíněna pouhým lidským bytím, je až následkem volby a činnosti (sebeutváření) člověka jako cíl života. Přesto důstojnost u Pika spočívá také právě ve volbě samé, ve svobodě volby jako potence a jako výzva k lidství.

Italian Renaissance philosopher Giovanni Pico della Mirandola, wrote Oratio de dignitate hominis as a follow-up to defend his heretical thesis. The current legal thinking refers to his work, becouse Pico emphasizes freedom to self-determination, which is the hallmark of human dignity. Pico’s starting point is (heretical) metaphysical and cosmological, and that’s why it is questionable to what extent Pico’s concept is useful for the law.Man has no fixed form which he gains in the process. Human dignity is not pre-determined and conditioned by mere human being, it is only the result of choice and of activity (of self-creating) which is the goal of life.Nevertheless dignity by Pico also consists precisely in the choice itself, in freedom of choice as a potency and as a challenge to humanness.
